Parry, AICP, Senior Planner Community Development 2/21/2017 2 Member Anuszkiewicz moved to accept Mark Parry as an expert witness in the fields of redevelopment planning, comprehensive planning, annexation implementation, zoning, land use/rezoning applications, land development general planning code amendments, landscape ordinance, and special area plans/overlay districts. The motion was duly seconded and carried unanimously. Senior Planner Mark Parry reviewed the Staff Report.. Attorney Katie Cole, representing the applicant and City of Clearwater, said the applicant requested CDB (Community Development Board) approval of the bridge's termination seaward of the CCCL (Coastal Construction Control Line). She said the City Attorney was drafting a license use and maintenance agreement for the City right-of- way. She said by agreement, 400 spaces in the hotel's parking garage were available to the public. Member Anuszkiewicz moved to accept Robert Pergolizzi as an expert witness in the fields of transportation and urban planning. The motion was duly seconded and carried unanimously. Robert Pergolizzi, representative for the applicant, said the bridge would improve safety, keep traffic flowing as pedestrians walk over the street, and reduce conflicts between pedestrians and traffic; an increase in beach visitors and Gulfview Boulevard traffic was anticipated. He said the bridge conforms to Beach by Design guidelines. In response to a question, he said the at-grade crossing will remain. Attorney Cole said the hotel project's original 2001 plan included the bridge but the owner removed the bridge when the hotel was constructed in 2007. She said the property was sold 18 months ago and the new owner wanted to revive plans for the bridge. She said the pedestrian bridge from the hotel's second floor common area/garage access and sea side elevator were designed with a low profile to retain water views from 3rd floor units. She suggested the board could add a condition of approval requiring the City Council approved License and Use Agreement between the developer and City. Three people expressed concerns similar bridges were not proposed for nearby parking garages and the bridge: 1) was 2 feet higher than previously proposed; 2) would block views of the beach; 3) would attract loiterers; 4) would increase noise near onsite condos; and 5) would not be used as most pedestrians would cross the street. Attorney Cole said this property had the only parking garage obligated to provide public accessible parking. The bridge would provide safe access to the beach from the parking garage. Community Development 2/21/2017 3 Assistant City Attorney Camilo Soto said the License and Use Agreement is in the Staff Report and a memo was distributed requesting a change to condition of approval 5. Member Anuszkiewicz moved to approve Case FLD2016-12038 based on evidence in the record, including the application and the Staff Report, and hereby adopt the Findings of Fact and Conclusions of Law stated in the Staff Report, with conditions of approval as listed with a change to condition of approval 5 to read "That an application for a building permit be submitted no later than February 21, 2019 unless time extensions are granted pursuant to CDC Section 4-407' plus a condition requiring the City Council approved License and Usage Agreement between the City and applicant. Neighborhood Associations: Clearwater Neighborhoods Coalition Presenter: Kyle Brotherton, Planner Planner Kyle Brotherton reviewed the Staff Report. Community Development 2/21/2017 4 Claire Clements, representing the applicant, concurred with the Staff Report. She reviewed her application from last year to develop this property. She said she had addressed concerns and requested continuance of the development agreement to next month to improve the plan. She submitted letters of support. Seven people spoke expressing concerns the development would lower nearby property values, be too tall and encroach on nearby residences, drain stormwater runoff into abutting neighborhoods, disrupt the peace of abutting neighborhoods, exacerbate resident egress difficulties to McMullen-Booth Road, and have a significant number of vehicles on site with an insufficient single entrance. It was stated that wildlife in nearby ponds would endanger project residents, drainage from the site to headwaters abutting the site needed to be environmentally safe, and dumpster enclosures should be located away from residences. It was commented a large number of nearby assistant living facilities already existed and a home purchase was based on the subject property's single-family zoning. A complaint was made that notification was delayed when mail was forwarded out of state. Concern was expressed that site signage had not been updated to notify residents of the continuance to today's meeting, making residents responsible for going door to door and explaining the change. Staff said all notification requirements had been met. In response to a question, Mr. Brotherton compared the development potential of a residential low vs. residential low medium Future Land Use. Ms. Clements said assistant living facilities were the lowest traffic generators. She said the development's 3-story building would buffer lights and noise from bars at the retail shopping center to the north. She said she had a good connection with the community, would share the site plan with abutting communities, and hold meetings. She said a 1-story building along the site's west and south side would block access to Barton Lane. She said the site was prohibited from draining stormwater onto nearby properties, She said the development had been reduced from 4 stories to 3 and would have 56 fewer beds than previously proposed. It was noted the board was not considering the development today, only future land use and zoning. Member Boutzoukas moved to recommend approval of Case LUP2016-02002 based on the evidence and testimony presented in the application, the Staff Report and at today's hearing, and hereby adopt the Findings of Fact and Conclusions of Law stated in the Staff Report.
