The Chair called the meeting to order at 1:00 p.m. at City Hall, followed by the Pledge of
Allegiance.
To provide continuity for research, items are in agenda order although not
necessarily discussed in that order.

Member Boutzoukas moved to approve the minutes of the December 20, 2016
Community Development Board meeting as submitted in written summation. The motion
was duly seconded and carried unanimously.

Request: The Community Development Board (CDB) is reviewing a proposed 30-
unit multi-family development in the Institutional (1) District and the East Gateway
character of the Clearwater Downtown Redevelopment Plan for the property located
at 1305 Franklin Street. The project will consist of two buildings 38 feet in height,
includes a minimum of 38 parking spaces (1.3 spaces per dwelling unit), requests
allowable flexibility with regard to the use (Community Development Code Section 2-
1204.A) and requests allowable flexibility with regard to landscaping (Community
Development Code Section 3-1202.G); and an allocation of 18 dwelling units from
the Public Amenities Incentive Pool under the provisions of the Clearwater
Downtown Redevelopment Plan; and a two-year Development Order under the

Request: The Community Development Board (CDB) is reviewing a Comprehensive
Infill Redevelopment Project for a fast food restaurant with a drive-thru lane in the
Commercial (C) District for the property located at 1749 Drew Street. The project is
21 feet in height, includes 17 parking spaces, and requests allowable flexibility from
setback, off-street parking spaces, and landscape requirements (Sections 2-7045
and 3-1202.G).

Member Funk moved to accept Kevin Nurnberger as an expert witness in the fields of
zoning, site plan analysis, planning in general, and landscape ordinance. The motion
was duly seconded and carried unanimously.
Senior Planner Kevin Nurnberger reviewed the Staff Report. He said Condition 2 would
be revised.
Concern was expressed that firebush, proposed for the west and north buffers, grows to
12 feet and its location in a sight triangle may pose a safety hazard for pedestrians. It
was recommended a more appropriate landscaping be planted.
Member Funk moved to accept Wayne Wells as an expert witness in the field of
planning. The motion was duly seconded and carried unanimously.
Wayne Wells, representing the applicant, said the developer would work with staff re
suitable shrubs for the subject buffers.
Member Anuszkiewicz moved to approve Case FLD2016-09030 based on the evidence
and testimony presented in the application, the Staff Report and at today's hearing, and
hereby adopt the Findings of Fact and Conclusions of Law stated in the Staff Report
with conditions of approval as listed and a condition that firebush in the west and north
buffers be replaced with a more appropriate bush that will not encroach on site
triangles. The motion was duly seconded and carried unanimously.

3. Level Three Application
Case: TA2016-12004 - Amendments to the Community Development Code
Applicant: City of Clearwater
Request: The Community Development Board (CDB) is reviewing a request to
amend the Clearwater Community Development Code to establish a foreclosure
property registry and associated fee and making a recommendation to City Council.

Code Compliance Manager Terry Teunis reviewed the Staff Report.
In response to questions, Mr. Teunis said the vendor would do all research necessary to
identify properties in the court foreclosure process and advise firms holding mortgages
for those properties re Clearwater's registration requirement. The City's biggest problem
when seeking compliance for a foreclosed property in violation of Code was identifying

a contact person for the bank or mortgage company responsible for the property.
Distressed properties affected the health safety and welfare of neighborhoods by
providing an opportunity for transient activity, further deterioration, and breeding vermin.
Concerns were expressed that posting an owner occupied property in foreclosure would
malign the owners, discouraging them from maintaining the property, the fees would
exacerbate a property owner's financial difficulties, and the proposal would help banks
kick people out of their houses. It was stated Pasco County had rescinded its posting
requirement and its registration rates were lower than those proposed by the City.
Mr. Teunis said the proposal would hold banks more responsible for properties in
foreclosure. Some abandoned homes have been stripped of valuables and /or occupied
by squatters who have to be legally evicted.
Discussion ensued regarding the registration process. It was commented the posting
would not state the property was in foreclosure. It was noted the mortgage holder had
no legal responsibility to maintain a property during foreclosure proceedings.
Assistant Planning & Development Director Gina Clayton suggested Code Sec 3-
1505.D.2 could be amended to limit postings to unoccupied properties.
Mr. Teunis said the vendor would update contact information periodically.
Member Flanery moved to recommend approval of Case TA2016 -12004 based on the
evidence and testimony presented in the application, the Staff Report and at today's
hearing, and hereby adopt the Findings of Fact and Conclusions of Law stated in the
Staff Report and a modification to the ordinance to disallow the posting of owner
occupied homes. The motion was duly seconded and carried unanimously.
