MULTI-USE TRAIL EASEMENT
FOR AND IN CONSIDERATION of the sum of Thirty Eight Thousand and --
NO/100--Dollars ($38,000.00) in hand paid, the receipt of which is hereby
acknowledged, and the benefits to be derived therefrom,
First Church of Christ Scientist, Clearwater, Florida, Inc.,
a not-for-profit corporation

(herein, "Grantor") does hereby withdraw and void in all respects that prior
unrecorded grant of easement conveyed to the CITY OF CLEARWATER,
FLORIDA, a Florida Municipal Corporation and the public in general (herein,
"Grantee") on March 29, 2007, and does herewith grant and convey to said
Grantee easement over, under and across the following described land lying and
being situate in the County of Pinellas, State of Florida, to wit:
A portion of Lot 5, block 3, "MAP OF TURNERS SUBDIVISION
NO.3", as recorded in Plat Book 1, Page 53 of the Public
Records of Hillsborough County, Florida, of which Pinellas
County, Florida was formerly a part, containing 961 square feet,
more or less, and being more particularly described and
depicted in EXHIBIT "A" attached hereto and by this reference
made a part hereof.
This easement is granted for construction and maintenance of a multi-
use public trail.
The CITY OF CLEARWATER, FLORIDA, shall have the right to enter upon the
above-described premises and to construct, install and maintain thereon such
trail improvements, and to inspect and alter same from time to time.
Grantee covenants with Grantor that existing lawn irrigation system operational
within the easement premises as of the date of this conveyance shall be
relocated at Grantee expense during initial trail construction. Effected system
elements will be reconnected to the irrigation system in a workmanlike manner to
insure equivalent or improved irrigation efficiency.

Grantor warrants and covenants with Grantee that it is the owner of the fee
simple title to the herein described easement premises, that Grantor has full right
and lawful authority to grant and convey this easement to Grantee, and that
Grantee shall have quiet and peaceful possession, use and enjoyment of this
easement.
It is expressly understood that Grantor reserves unto itself all rights of ownership
of the easement premises not inconsistent with the easement rights granted
herein. It is further agreed and understood between the parties that nothing in
this easement shall change the square footage calculation of fee simple
ownership of the Grantor's lot for purposes of determining any present or future
zoning, or other City requirement as to the redevelopment of said lot; but that the
size of the lot, for such purposes, shall remain that prior to the grant of
easement, except that any impervious surface within the easement area will be
included in the overall calculation of impervious surface in the course of future
redevelopment.
This easement is binding upon the Grantor, the Grantee, their successors and
assigns. The rights granted herein shall be perpetual and irrevocable and shall
run with the land, except by the written mutual agreement of both parties, or by
abandonment of the easement premises by Grantee.
