The City Commission of the City of Clearwater met in regular session at the City Hall, Thursday, June 2, 1988, at 6:01 p.m., with the following members present:

The Mayor called the meeting to order and led the Pledge of Allegiance. The invocation was offered by Father John Cippel, St. Cecelia Catholic Church.!

Trish Muscarella requested the City reconsider its policy that requires
annexation in order to receive sewer service.!

Item #9 Request for variance to the minimum distance requirement for alcoholic beverage sales; McVeigh Sub., Blk. B, Lot 7 zoned CG (General Commercial) (Merle Chamberlain) AB 8809

Pursuant to Ordinance 442087, this request was received to permit package sales of beer and wine within 286 feet of a residential zone at 803 S. Missouri Ave. It was pointed out that
the application is actually for a variance of 286 feet, allowing this establishment within 14 feet of a residential zone.!
The Planning and Zoning Board approved a conditional use for alcoholic beverage sales subject to the conditions: 1) a variance to the minimum distance requirement be approved by the
City Commission, and 2) the license be procured within six months.!
Dan Hood, representing the applicant, stated he operates the Shell station at 803 S. Missouri Ave. A small convenience store in conjunction with the service station has been expanded
and modernized, and he is requesting a 2APS license in order to sell beer and wine.!
In response to a question, Mr. Hood stated the station operates 24 hours a day; however, no beer or wine will be sold after midnight and there will be no consumption on premises.!
Commissioner Winner moved to approve the requested variance to the alcoholic beverage minimum distance requirement on the subject property. `Motion` was duly seconded and `carried`
unanimously. !
Item #10 Petition for Annexation and RS 8 Zoning for a .4 acre parcel located on the E side of El Trinidad Dr. at its Northern Terminus; the W 100 ft. of Lot 17 & the W 100 ft. of
Lot 18, Blk. 1,

The property is proposed to be developed with a single family residence on each lot. City sewer service is available.!
The recreation facility fee has been paid on Lot 17, and a letter to Pinellas County regarding availability of City services has been issued on Lot 17 only.!
Commissioner Nunamaker moved to approve the requested annexation and zoning on the subject property and to direct the City Attorney to include this in an ordinance. `Motion` was duly
seconded and `carried` unanimously.!
Item #11 Resolution 8827 Approval to record liens on properties for unpaid utility bills. (`CLK`)
The property owners involved were notified of the Public Hearing by the Utilities Department and the City Clerk regarding the indebtedness, pursuant to Chapter 50, Sec. 50.08 of the
City Code.!
The City Attorney stated Exhibit A, attached to the Resolution, has been amended to delete all but three properties. The City Attorney then read Resolution 8827 as amended.!
Commissioner Regulski moved to pass and adopt Resolution 8827 with amended Exhibit A and authorize the appropriate officials to execute same. Motion was duly seconded and upon roll

Item #48 (`Continued from 5/19/88`) Ordinance 459788 Revising Article I of Chapter 114, Relating to Navigable Waters within the City, to provide definitions; to prohibit the
throwing or discharging of trash, etc.; to require certain equipment in watercraft; to prohibit liveaboard vessels except at marina facilities or pursuant to temporary permit; to provide
for temporary liveaboard permits; to require installation of pumpout systems at certain marina facilities not later than 12/31/88; to require the use of pumpout systems by permitted
live aboard vessels; to provide for removal of disabled vessels; to prohibit diving or jumping from Cityowned docks, piers & bridges; Repealing Sec. 114.54, Relating to Houseboats.!
Three citizens spoke in opposition to the proposed ordinance and requested first reading be postponed in order for all important issues to be addressed. They feel the ordinance is
discriminatory against liveaboards.!
Three citizens spoke in support of the proposed ordinance stating liveaboards pay no taxes and should be made to have sewage facilities.!
Discussion ensued regarding the time frame between first and second reading of the ordinance. The City Attorney stated second reading could be as late as 30 days after first reading.
He stated if the changes to the ordinance broaden the scope of enforcement, the ordinance should be readvertised and a second public hearing held. If the changes narrow the scope of
enforcement, there would be no need to readvertise.!
The Harbormaster stated he feels the ordinance is a valid one as it was worked on for three years, and they have attempted to address the concerns of all who will be affected. He
emphasized that, at the present time under the Land Development Code, all liveaboards are illegal other than those approved under conditional uses.!
Commission consensus was that second reading of the ordinance be postponed until July 7th; the City Attorney will advertise second reading for that date.!

Item #56 Authorization to File Small Claims Suit against Pary, Inc. for damages in the amount of $1,770.11.!
During the course and scope of their employment, employees of the Defendant negligently hit a twoinch gas line belonging to the City. The location of the gas lines had previously
been marked by the City. !
The City incurred $270.38 in expenses to repair the broken gas line, and a gas loss in the amount 2,462 therms, at a cost of $1,499.73, for a total judgement of $1,770.11 against Pary,
Inc.!
Commissioner Nunamaker moved to authorize the filing of the Small Claims suit against Pary, Inc. `Motion` was duly seconded and `carried` unanimously.!

Item #57 Setting meeting date for Comprehensive Plan discussion.!
The City Manager reported a meeting is also needed to discuss water and sewer rates for the Advanced Waste Water Treatment Plants.!
Commission consensus was to set a meeting for June 13, 1988 at 9:00 a.m. to discuss the Comprehensive Plan and Water and Sewer Rates for the Advanced Waste Water Treatment requirements.!
Commissioner Winner stated there is a proposal to rename, as Sunset Point Road, Main Street from U.S. 19 to McMullen Booth Road. Commission consensus was to support this proposal.!
