Read Carefully.
Additional Provisions
1. The Owner shall be responsible for and warrants ownership of the property for the pool location being within his property lines and not in violation of setbacks or other
restriction.** The Owner, will provide access to the pool site and work space for power excavating equipment and trucks. Unless otherwise stated herein, site preparation,
removal of rock, or changes affected by this construction shall be done at Owner's expense. Should filled ground exceeding 3 feet, underground or surface water, rock or
other major underground obstructions be encountered, either party may cancel this contract on prompt written notice subject, however, to work, stoppage contained in
paragraph 6 herein.
2. Owner shall furnish Tropical Pools and Pavers, LLC, on original construction or warranty work, with an adequate water supply, electricity, gas and sufficient work space for
storage of equipment and mixing materials adjacent to the pool, and the Owner will assume all liability for damage to driveways, walks, curbs, underground lines, planting,
lawn and septic tanks.
3. The owner warrants that he owns the land upon which the pool is to be built or that he has full authority from the Owner thereof, or any co-owner, to enter into this
contract, and the Owner shall indemnify and hold harmless Tropical Pools and Pavers, LLC, in all matters arising on this account. Tropical Pools and Pavers, LLC shall also
have the right to stop all work in the event that payments on the contract, as above set out, are not immediately paid when due, and may discontinue work until the entire
bill is paid and then complete its work. In the event of default on the part of the Owner in making payments when due or in performing any of the other components of this
Agreement, the Owner agrees to pay to Tropical Pools and Pavers, LLC all costs plus overhead and profits as liquidated damages and should Tropical Pools and Pavers, LLC
incur any costs of expenses in collecting payment or enforcing the terms of this Agreement, the Owner agrees to pay all such costs and expenses including a reasonable fee
for Tropical Pools and Pavers, LLC attorney.
4. Until the contract price is paid in full, all equipment and accessories shall continue to be the property of Tropical Pools and Pavers, LLC regardless of being affixed to real-
estateand tied thereto, and shall not pass to the Owner until Tropical Pools and Pavers, LLC has been paid in full. It is agreed and understood that the retention of title in this
Agreement shall constitute a security agreement therefore. This security interest shall ATTACH upon delivery of the equipment and accessories to the job site and prior to
the installation thereof in any manner, or prior to the affixing of such good in any manner into or onto the realty. The retention of such security interest shall not impair or
otherwise affect or limit Tropical Pools and Pavers, LLC rights under the Florida Mechanic's Lien law, Chapter 713, Florida Statues including the right to file a Claim of Lien or
the right to replevin therein contained, it is specifically agreed and understood that in the event of any default in payment Tropical Pools and Pavers, LLC shall have the right
to enforcement of the security interest herein established including the right of removal as contained in Florida Statue 679.9-313. Owner agrees to carry adequate fire and
theft insurance on all equipment placed on job site.
5. If the specifications of this Agreement call for the construction of a pool other than a private pool, this Agreement shall be contingent upon the approval of plans and
specifications by the State Board of Health or during construction, resulting in a change in the anticipated cost of construction, the Contract shall be equitably adjusted.
6. It is agreed that Tropical Pools and Pavers, LLC shall be permitted to prosecute its work without interruptions. If it is delayed at any time by any act or neglect or the Owner,
or the Owner's representatives or employees, or any other Contractor employed by the Owner, or any changes ordered in the work, then Tropical Pools and Pavers, LLC shall
be reimbursed or paid for the additional expense or damage. This shall include loss of use of equipment caused by said delay; that in all cases involving work stoppage, extra
work, changes or cancellation, it is agreed that the Owner will pay to reimburse Tropical Pools and Pavers, LLC for its full costs of labor and/or materials, plus 15% overhead,
plus 10% profit. Payment for all extra work or changes in the work done by Tropical Pools and Pavers, LLC shall be due at time of billing and all changes in the work or extra
work done at the request of the Owner, shall be authorized by a signed memorandum. Tropical Pools and Pavers, -LLC shall not be held liable for any damage to installation,
or delays resulting from storms, floods, earthquakes, swelling of ground, war, governmental controls, strikes, acts of God, or any other accidental or natural causes beyond its
or his control.
7. When the pool is filled with water this Contract shall have been substantially completed. All pool dimensions are approximate with reasonable tolerances either way.
Liquidated damages for errors by Tropical Pools and Pavers, LLC in the water surface area of the pool as specified on the reverse side of this Contract shall be $8.00 per
square foot. This Contract, including the provision on the reverse side hereof, together with plans and specifications attached hereto, constitute the entire Agreement. In
case of conflict between plans and contract, the terms of this Contract shall prevail. No other verbal or written agreements shall affect this Contract and this Contract cannot
be modified except by mutual written consent of Owner and Tropical Pools and Pavers, LLC. In the event that this Agreement is entered into by two or more Owners, any
changes, modifications, alterations or approval in writing provided for in the Agreement signed by one of the Owners shall be binding upon all of the Owners, said Owners
designating and authorizing each other as agents for the other Owners with full authority to accomplish the matters heretofore set forth.
8. Tropical Pools and Pavers, LLC shall pay for all required sales taxes and permits for its work, and Tropical Pools and Pavers, LLC shall carry workmen's compensation, public
liability, and property damage insurance. Owner shall carry builder's risk insurance at his option. The Owner and Tropical Pools and Pavers, LLC agree to comply with the
provision of the Mechanic's Lien Law of the State of Florida (Chapter 713, FS). The Owner shall record a "Notice of Commencement" with the clerk of the Circuit Court, and
forthwith post a Certified Copy thereof upon the property. In the event the Owner shall fail to comply therewith, Tropical Pools and Pavers, LLC shall have the right to act
upon the Owner's behalf as his authorized agent and to cause the "Notice of Commencement" to be recorded and posted as required by law.
9. Tropical Pools and Pavers, LLC guarantees that the concrete structure or pool shell will remain structurally sound fortwenty-five years from the date the pool is filled with
water. The concrete structure is the pool shell encasing the steel reinforcing bars on the surface of the excavation in which the pool is constructed. The pool shell does not
include the marcite finish. This twenty-five year warranty does not extend to items external to the concrete structure such as coping, tile, decking, plumbing, filters, heater
and pool accessories. The marcite, coping and decking is not guaranteed against discoloration or staining in as much as this is commonly due to local water, wrong use of
chemicals or lack of cleaning. This warranty does not cover damage caused by earthquake, earth or fill moment, underground springs or water or damage caused by
explosions, wrecking, flooding, surface drainage or similar events. Hairline cracks in decking and marcite are to be expected and are not covered by this warranty.
** In the event Owner authorizes access through adjacent properties for Tropical Pools and Pavers, LLC use during construction, Owner is required to obtain permission from the
owner(s) of adjacent properties for such use, and Owner agrees to be responsible and to hold Tropical Pools and Pavers, LLC harmless and accept any risks thereof.
LIMITED WARRANTY
Tropical Pools and Pavers, LLC warrants its work to be free from defects in material and workmanship for a period of one year from the date the
completed pool is filled and equipment is set into operation, or the pool is in use, and if any such defects should appear within such time, shall remedy
same without cost to the Owner, provided said Owner has complied in full with the terms of payment and other conditions of this contract. Owner's
failure .to make full payments to Tropical Pools and Pavers, LLC according to the contract and work orders shall void this warranty. Purchased,
assembled, accessories and equipment installed under this contract carry manufacturer's warranty and Tropical Pools and Pavers, LLC neither warrants
or guarantees such equipment beyond or in excess of manufacturer's warranty. Defects or failures caused by obvious mistreatment or neglect shall be
repaired or serviced at Owner's expense.
This concrete structure (or shell) carries a 25 year warranty, which is defined in paragraph 9 above.
This warranty is void when original purchase sells or leases said property.
ANY IMPLIED WARRANTY ARISING BY OPERATION OF STATE LAWS IN LIMITED TO THE DURATION OF THE ONE YEAR WRITTEN WARRANTIES HEREIN CONTAINED.
THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS. YOU ALSO HAVE IMPLIED WARRANTY RIGHTS, IN THE EVENT OF A PROBLEM WITH WARRANTY SERVICE OR
