OCCUPATIONAL LICENSE APPEAL

Mr. Rabun opened the meeting and explained this is an appeal of the denial
of an occupational license. He informed the appellant that he had the right to
request a further appeal before the City Commission. if the denial of the license
is upheld as a result of this appeal.
Chief Klein presented the results of the background check. Laverna
Kaepernik submitted authorization for background check to the Police Department
on December 21, 1988. On May 30, 1989, The Police Department notified the
Planning & Urban Development Department that they recommended denial of the
occupational license based on the fact that Mr. Kaepernik had been found guilty
of violating his probation on a theft charge.
Mr. Kaepernik stated that in 1981 he became involved with a woman and when
the relationship broke up she instituted a civil suit against him. Because he
was no longer living in New Jersey, the charge was changed to a criminal one to
facilitate his return to New Jersey. Upon pleading guilty, he was placed on non-
custodial probation until such time as he completed scheduled payments totaling
$20,000.00. In 1985 he was unable to-make.the full payments.as`''`scheduled and
be Was".sept,back to New mosey to answer the charge of violation.of probation.
He presently owes a balance of $6,000.00 to $7,000.00. He stated a willingness
to supply letters of reference from landlords at his other franchise locations
and Better Business Bureau. Matchmaker International is a legitimate personal
introduction service that has been in business 16 years. He has been a franchise
owner for approximately two and a half years.
Sgt. Master emphasized that the investigation was only in conjuction with
the application for an occupational license and was not brought about due to any
complaints. A check was made in the other cities where Mr. Kaepernik has.
franchises and no problems were reported.
Mr. Rabun asked Mr. Kaepernik, and Mr. Kaepernik agreed to supply
letters of reference within 10 days so he could consider them as he makes a
decision whether to grant or deny the request for an occupational license.
