A. CALL TO ORDER, INVOCATION, PLEDGE OF ALLEGIANCE
The Vice Chair called the meeting to order at 1:00 p.m. at City Hall, followed by the
Invocation and Pledge of Allegiance.
To provide continuity for research, items are in agenda order although not
necessarily discussed in that order.

Member Lau moved to approve the minutes of the September 20, 2016 Community
Development Board meeting as submitted in written summation. The motion was duly
seconded and carried unanimously.

E. CONSENT AGENDA: The following cases are not contested by the
applicant, staff, neighboring property owners, etc. and will be approved by

Request: The Community Development Board (CDB) is reviewing a 1,357 square-
foot restaurant in the Tourist (T) District for the property located at 600 Mandalay
Avenue. The project is twelve feet in height with zero off-street parking spaces, and
requests allowable flexibility from lot area, setback, parking, and landscape
requirements (Sections 2-803.D and 3-1202.G)

In response to questions, Development Review Manager Robert Tefft said the use
would be a restaurant, not a bar; the applicant would need to return to the City if the use
changed. Trash bins will be stored indoors. Renderings re outdoor seating differed. Staff
will review outdoor seating as part of the approval process for a sidewalk cafe permit.
Member Boutzoukas moved to approve Case FLD2016-07025 on today's Consent
Agenda based on evidence in the record, including the application and the Staff Report,
and hereby adopt the Findings of Fact and Conclusions of Law stated in the Staff
Report, with conditions of approval as listed. The motion was duly seconded and carried
unanimously.
2. Case: FLD2016-08026 —409 S. Old Coachman Road Level Two Application
Owner: Greek Orthodox Church of The Holy Trinity, Inc.
Applicant: Mazas Pantazes Architecture and Design (2551 Drew Street, Clearwater,

Location: 6.53 acres generally situated at the northeast corner of Old Coachman
Road and Gulf-to-Bay Boulevard (not including the Duke Energy parcel or the parcel
occupied by Chick-Fil-A)
Request: The Community Development Board (CDB) is reviewing a renovation and
expansion for an existing place of worship in the Institutional (1) and Commercial (C)
Districts for property located at 409 South Old Coachman Road. The project is 68
feet in height with 224 off-street parking spaces, and requests allowable flexibility
from landscaping requirements (Sections 2-1204.A and 3-1202.G)

Report, with conditions of approval as listed. The motion was duly seconded. Members
Funk, Allbritton, Anuszkiewicz, Lau, Flanery, and Acting Member Quattrocki voted
"Aye"; Member Boutzoukas abstained. Motion carried.

This form is for use by any person serving at the county, city, or other local level of government on an appointed or elected board, council,
commission, authority, or committee. It applies equally to members of advisory and non - advisory bodies who are presented with a voting
conflict of interest under Section 112.3143, Florida Statutes.
Your responsibilities under the law when faced with voting on a measure in which you have a conflict of interest will vary greatly depending
on whether you hold an elective or appointive position. For this reason, please pay close attention to the instructions on this form before
completing the reverse side and filing the form.
INSTRUCTIONS FOR COMPLIANCE WITH SECTION 112.3143, FLORIDA STATUTES
A person holding elective or appointive county, municipal, or other local public office MUST ABSTAIN from voting on a measure which
inures to his or her special private gain or loss. Each elected or appointed local officer also is prohibited from knowingly voting on a mea-
sure which inures to the special gain or loss of a principal (other than a government agency) by whom he or she is retained (including the
parent organization or subsidiary of a corporate principal by which he or she is retained); to the special private gain or loss of a relative; or
to the special private gain or loss of a business associate. Commissioners of community redevelopment agencies under Sec. 163.356 or
163.357, F.S., and officers of independent special tax districts elected on a one -acre, one -vote basis are not prohibited from voting in that
capacity.
For purposes of this law, a "relative" includes only the officer's father, mother, son, daughter, husband, wife, brother, sister, father -in -law,
mother -in -law, son -in -law, and daughter -in -law. A "business associate" means any person or entity engaged in or carrying on a business
enterprise with the officer as a partner, joint venturer, coowner of property, or corporate shareholder (where the shares of the corporation
are not listed on any national or regional stock exchange).
ELECTED OFFICERS:
In addition to abstaining from voting in the situations described above, you must disclose the conflict:
PRIOR TO THE VOTE BEING TAKEN by publicly stating to the assembly the nature of your interest in the measure on which you
are abstaining from voting; and
