Due to the logistics of this removal, it is recommended to remove the existing coatings to a depth of to 3/4 inch, removing all loose and flaking coatings to provide a good bondable surface, so that no damage is done to the structural surface. ➢ Note: This proposal is contingent that all tile is being removed and Blasters, Inc. will have access to blast the entire surface area. A Note: Extensive delays beyond the control of Blasters, Inc. are subject to a standby rate of $495.00 per hour. Note: Blasters, Inc. will make every effort to remove the entire surface area as per the specifications; however, Blasters, Inc. will not be liable or responsible for any removal in areas that are not accessible to the waterblasters. Beyond this time period prices will be subject to re- negotiation. 2. Changes to the scope of work contained in this proposal will be considered a change order and subject to re- negotiated pricing. 3. Contractor shall not give instructions or orders directly to employees or workmen of Blasters, Inc. except to persons designated as authorized representatives of Blasters, Inc. 4. Contractors and Blasters, Inc. agree to cooperate in scheduling of work to avoid conflicts or interference with either party's performance. 5. Contractor agrees to pay Blasters, Inc. within thirty (30) days from date of invoice if credit has been approved by Blasters, Inc. Contractor also understands and agrees that accounts not paid when due shall be subject to a FINANCE CHARGE on the unpaid balance from time to time at the rate of 1 1/2% per month which is an ANNUAL PERCENTAGE rate of 18 %. It is understood and agreed that in the event of non - payment, applicant shall be in default if there is any part of applicant's account remaining unpaid after said thirty (30) day period from due date of an invoice. In the event Blasters, Inc. declares a default to exist, all unpaid balances together with finance charges thereon shall be and become immediately due and payable. No retainage shall be withheld from balances due to Blasters, Inc. nor shall any deduction be made from balances due to Blasters, Inc. without prior written notification and confirmation by Scott F. Boos. 6. Contractor shall make no demand from Blasters, Inc. for any liquidated damages or claims arising out of or in consequence of the performance of this contract. 7. Blasters, Inc. company policy is to file Notice to owner when applicable 8. If a signature of acceptance is not received by Blasters, Inc., by the scheduled starting date, it is agreed and understood that upon commencement of this project that the proposal including the terms and conditions are accepted as presented. 9. This Agreement shall be construed and enforced in accordance with the laws of the State of Florida. It is agreed that venue for all claims, actions or suits concerning the validity, interpretation or performance or any of the terms, provisions or warranties of this Agreement, or of any other matter relating to this Agreement shall be in the courts of the State of Florida, and at Employer's sole discretion in Hillsborough County, Florida, and the United States District Court for the Middle District of Florida. 10. Should Blasters, Inc. employ an attorney to enforce any of the provisions hereof, or to protect its interest in any matter arising under Proposal or these Terms and Conditions, or to collect damages for the breach of the Proposal or the Terms and Conditions, or to prosecute or defend any suit resulting from the Subcontract or these Terms and Conditions, or to recover against any surety bond given by Contractor under the Subcontract or these Terms and Conditions, expenses and attorneys' fees, including expert witness fees, expended or incurred therein in mediation, arbitration or through appeal.
