06/07/2000 AIRPORT AUTHORITY MEETING CITY OF CLEARWATER June 7, 2000 Present: Gary Benjamin Chair Brenda Harris Nixon Board Member Dennis Roper Board Member – arrived 3:10 p.m. Ron Streicher Board Member Bob Lunt Board Member Also Present: William Morris Harbormaster John Carassas Assistant City Attorney Brenda Moses Board Reporter To provide continuity for research, items are in agenda order although not necessarily discussed in that order. The Chair called the meeting to order at 3:00 p.m. at City Hall. ITEM 2 – May 3, 2000, Minutes Approval Member Nixon moved to approve the minutes of the regular meeting of May 3 2000, as motioncarried submitted. The was duly seconded and unanimously. ITEM 3 - Tenant Report/FBO David King, Suncoast Flying Services and FBO (Fixed Based Operator), reported the FBO report is the same as last month (27 t-hangars, 40 shade hangars, 35 hard stands, 19 grass tiedowns, and 10 transients). He said a new contract was negotiated with Phillips 66 at no cost to the Clearwater Airpark or the City. New pumps, new hoses, a new sign, and other improvements will be installed. He anticipated fuel prices will drop within the next few weeks. Flight pattern tests were done as suggested at the last meeting. He felt the only solution to the noise abatement issue is to lengthen the runway. He said Channel 10 and Channel 8 conducted an interview regarding the Airpark which should air tonight. Mr. King said the St. Petersburg Times is writing a feature story regarding a charity flight for a citizen with twins who requires air transportation for them. ITEM 4 – Airpark Leases Update Mr. King said there are currently 35 tenants at the Airpark without signed leases. He said the old lease was retyped for aesthetic purposes and the only change made was to replace “Clearwater Aircraft” with “Clearwater Airpark”. Mr. King has received comments that some tenants are unhappy that the Airpark lease permits the City entry into hangars. Discussion ensued and it was remarked that some tenants feel it unnecessary for the Fire Marshall to perform inspections inside hangars. Tenants also feel they should be informed when someone needs to enter their space even in an emergency situation. Assistant City Attorney John Carassas said the Airpark lease does not contain language or issues that puts the City or tenants of the Airpark in legal jeopardy. The lease permits the City the opportunity to enter its own property at times of emergency. No one is authorized to violate anyone’s maa0600 1 06/07/00 personal property. Rather than separate leases for each tenant, the City has implemented a form lease is to be used for all tenants at the Airpark. It was remarked that in the past, private citizens who gained access into the Airpark have trespassed onto tenants’ property. A concern was expressed that the current lease is different than the one developed with the City and a special committee formed to review it. It was remarked that the current lease was a product of those negotiations. It was suggested the FBO hold a meetings with Airpark tenants to review the terms of the lease. In response to a question, Mr. Carassas said Airpark leases are at-will leases that remain in effect until either party terminates and do not require signatures on an annual basis. As with any commercial lease, should a tenant refuse to sign a lease, the FBO is authorized to notify the tenant he must vacant the premises or be removed from the property. He said the FBO is expected to enforce the terms of the lease. If the FBO fails to enforce the terms of the lease, he could be found in default of his lease. Mr. Carassas requested that Mr. King report the number of tenants without signed leases at the next AA meeting. He said the issue is not the terms of the lease, but that not all tenants have signed a lease as is required. Mr. King said he will personally call all the tenants to discuss their objections to the lease and ensure everyone signs a lease as soon as possible. He wishes to put problems of the past behind him and move forward to make the Airpark pleasurable. In response to a question, Harbormaster Bill Morris said he has received no complaints regarding the terms of the lease. Concern was expressed that some items grandfathered into the current lease are being violated. It was remarked that people are sometimes unwilling to accept change. As some tenants have maintained space at the Airpark for years without a lease, they are reluctant to sign one now. ITEM 5 – Review Proposed Ordinance Amendment to Permit Helipad Mr. Morris said the CDB (Community Development Board) recommended denial of the request for a helipad ordinance to the Commission. Afterward, the applicant withdrew the request and the ordinance was never submitted to the Commission. ITEM 6 – Preliminary Submittal of Master Plan Klaus Palinkas, PBS&J (Post, Buckley, Shuh, and Jernigan) provided an update of the Master Plan schedule. The schedule was revised due to the delay in receipt of the aeronautical obstruction survey and related topographical and geodetic information. It is anticipated that the Master Plan will be presented to the Commission in August or September 2000. ITEM 7 – Other Business Mr. Morris distributed a survey that the CFASPP (Continuing Florida Aviation System Planning Process) West Central Metropolitan Steering Committee requested he share with aviation-interested parties. The survey is geared toward pilots. Mr. Morris said there will be security at the Airpark on an interim basis for the next 60 days. In response to a question, Mr. Morris said the fence on the south end of the Airpark has been repaired. Mr. King said he will have the gate to the Airpark entrance checked and repaired if necessary. Concern was expressed that a card reader system would be more efficient policing of the Airpark than the current gate. maa0600 2 06/07/00 John Atanasio, CAP (Civil Air Patrol), encouraged the FBO to ensure that every person in the Airpark signs a lease immediately to avoid lawsuits.
