SUMMARY:
Clearwater Gas System’s (CGS) backup fueling compressor was replaced in 2014 at the CNG
fueling station on Hercules Avenue. A new compressor, with a larger fueling capacity,
replaced it and meets the current and future needs of the CNG station. The original backup
compressor did not have sufficient capacity to operate the station when the primary
compressor unit was down for maintenance.
CGS also has numerous inventory service/repair parts and appliances for disposition. These
items generally consist of appliance venting, ignitions controls, flame sensors, thermostats,
steel posts and bases for gas lights, grill hoods, built in oven and a washing machine. The
appliance storeroom items were demo units from the old CGS Sales showroom on Drew
Street and US Hwy. 19, along with accent/component pieces that are now obsolete. In
addition, several of the hotel/resort accounts have replaced their aging gas boilers and spa
heaters with higher efficiency models, therefore, resulting in obsolete repair parts. Most of
these obsolete parts are over 20 years old.
The intent is to sell all surplus designated equipment to the highest bidder. The selected
bidder(s) will be responsible for pick-up and transportation of the equipment from their
locations. The CNG compressor is located at the Solid Waste complex on Hercules and the
service/repair items are located at the Gas Administration Warehouse on Myrtle Avenue.
Pursuant to City of Clearwater Code of Ordinances, Section 2.622, surplus sales of common
bulk items of an estimated value greater than $5,000 shall be through public auction or open
market, following authorization by the City Council. The estimated value of the surplus CNG
compressor is $10,000 and service/repair parts at $41,000. The open market bid opportunity
will be handled in accordance with code and purchasing policy, Division 4, Sale of Surplus
Personal Property, and managed by the Purchasing Division.

Approve a Memorandum of Understanding (MOU) between Westfield Property Management,
LLC, a Delaware limited liability company, in its capacity as agent for the owner of the
premises known as Westfield Countryside (Shopping Center), located at 27001 US Highway
19 North, Clearwater, Florida, and the City of Clearwater Police Department for the purpose of
accessing the video surveillance systems located at the Shopping Center and authorize the
appropriate officials to execute same. (consent)
SUMMARY:
Westfield Property Management, LLC and the Clearwater Police Department have entered
into a cooperative agreement to allow the police department immediate access to the video
surveillance systems at Westfield Countryside (Shopping Center) during an incident involving
an active shooter or other significant life-saving event.
The property manager, however, has requested that the Clearwater Police Department (CPD)
agree to the terms and conditions outlined in the MOU between Westfield Property
Management, LLC, and CPD. Additionally, the property manager has requested that CPD
hold harmless Westfield and its affiliates (including without limitation, the owner of the
Westfield Countryside shopping center) from and against any and all loss liability, damage,
cost or expense arising out of or related to CPD’s use of the video surveillance systems.
Nothing in the MOU, however, shall be deemed a waiver of the limitations on liability contained
in Section 768.28, Florida Statutes, or the doctrine of sovereign immunity.
There are no costs associated with this Memorandum of Understanding .

Approve the purchase of License Plate Recognition equipment, in the amount of $100,642.00,
from Vetted Security Systems of St. Petersburg, Florida, pursuant to City Code Section 2.564
(1)(d) and authorize the appropriate officials to execute same. (consent)
SUMMARY:
In 2010, the Clearwater Police Department implemented License Plate Recognition (LPR)
technology when it purchased two mobile LPR systems from Elsag North America LLC.
These systems were installed on two police cruisers. In 2012, the Police Department received
an additional LPR system at no cost from PLATESMART LLC, which was used in support of
the Republican National Convention deployment.
On July 1, 2016, the Elsag vendor ended service and maintenance support. As a result, the
Elsag systems have become non-functional and obsolete.
The PLATESMART system is currently in service, but has several limitations, including the
ability to process information from multiple directions. The vendor has restricted the system to
a single user. In addition, because the unit was received at no cost as a “demo” product, the
service agreement is contingent on the Department providing product demonstrations for
potential customers or other persons that have an interest in PLATESMART.
The current Police Department LPR technology is outdated, limiting, and does not have the
ability to seamlessly integrate with other LPR technology implemented in Pinellas County.
The Pinellas County Sheriff’s Office has entered into an agreement to purchase LPR
technology from Vetted Security Systems. The Clearwater Police Department recognizes that
criminals are not restricted by jurisdictional boundaries and frequently travel between
jurisdictions to commit crimes.
The purchase of four LPR systems will allow the Police Department to seamlessly share LPR
data in real time with the Sheriff’s Office LPR network. Since the purchase will be a shared
network coordinated by the Pinellas County Sheriff’s Office, the Sheriff’s Office has agreed to
cover the costs associated with the support and maintenance of the Clearwater Police
Department LPR devices.
The ability to share information will exponentially increase the effectiveness of the Clearwater
Police Department to predict, prevent, and protect the City of Clearwater. The Clearwater
Police Department and the Pinellas County Sheriff’s Office are currently collaborating on a
number of task forces that this technology would support. These Task Forces include the
Violent Crime Task Force, the Habitual Offender Monitoring and Enforcement Task Force, and
the High Intensity Drug Trafficking Area Task Force.
Clearwater Police Department restricts access to LPR data to only authorized personnel, and

authorized personnel are only permitted to access the data in furtherance of a criminal justice
purpose. Any other access is strictly forbidden.
The Police Department will fund the purchase using Federal Forfeiture Sharing revenues, in
the amount of $100,642.00; pursuant to City Code Section 2.564 (1)(d), Other Governmental
Contract.
The Police Department's operating budget will fund monthly air card service for the two static
LPR devices at an estimated annual cost of $1,000.

fund the equipment purchase.

SUMMARY:
February 5, 2015, City Council awarded a 2-year contract to Rowland, Inc. for Sanitary
Sewer and Manhole Emergency Repairs based on unit prices. The original contract
included $100,000 for emergency repair within the three Water Reclamation Facilities
(WRFs).
The repairs include work for emergencies that city crews cannot respond to, or get a
contract negotiated in time to avoid other impacts to operations of the plant.
Due to aging of the WRFs and recent impacts from Hurricane Hermine, staff requests an
increase of $750,000 to the existing contract for emergency repairs associated with the
WRFs through January 31, 2018. This will enable the City to respond to issues at the
WRFS immediately.
Rowland, Inc. has performed excellent work for the City and agreed to hold their
competitive unit pricing.
Public Utilities staff will coordinate and direct contractors, to respond immediately in case
of emergency.

SUMMARY:
In 2008, the City entered into Partnership Agreement (PPA) with the Department of the Army
that allowed up to $5,000,000 in Federal funds to be applied towards the Stevenson Creek
Estuary Restoration Project.
At the time the City entered into the agreement, the estimated project cost was approximately
$6,600,000. The City’s contribution was 35% and the remaining 65% Federal.
The project was completed in 2014 and the total cost exceeded the original estimate for a total
cost of $10,124,600.
Increasing the amount of Federal funding to $10,000,000 will allow the Army to contribute 65%
of the total project cost for an amount of $6,580,990.

THIS AMENDMENT NO. 1 is entered into this day of __________,2016, by and
between the DEPARTMENT OF THE ARMY (hereinafter the "Government"), represented by
the U.S. Army Engineer, Jacksonville District (hereinafter the “District Engineer”), and the City
of Clearwater, Florida(hereinafter the "Non-Federal Sponsor"), represented by its Mayor.
WITNESSETH, THAT:
WHEREAS, the Government and the Non-Federal Sponsor entered into a Project
PartnershipAgreement onSeptember 22, 2008(hereinafter the "Agreement") for design and
construction of the Stevenson Creek Estuary Aquatic Ecosystem Restoration Project(the
“Project”), at Clearwater, Florida;
WHEREAS, Section 1030of the Water Resources Reform and Development Act
(hereinafter “WRRDA”) of 2014, Public Law 113-121, amends Section 206(d)ofthe Water
Resources Development Act of 1996(33 U.S.C. 2330(d)), toincrease the amount of Federal
funds that may be allotted for a project at any single localityfrom $5,000,000 to $10,000,000;
WHEREAS, the initial construction contract for the Project was awarded on August 17,
2009 and physical construction of the Project was completed in May,2014, but fiscal closeout of
the Project has not been completed; and
WHEREAS,on August 10, 2015, the Assistant Secretary of the Army (Civil Works)
specifically approved the application of the $10 millionFederal participation limit to the recently
completed Project.
NOW, THEREFORE, the Government and the Non-Federal Sponsor agree to amend the
Agreement as follows:
1. The secondWHEREASclause of the Agreementis amended as follows:
(a)Strike “$25,000,000” and replace with “$50,000,000”.
(b)Strike"$5,000,000" and replacewith "$10,000,000".
2. Article I.K.of the Agreement is amended by striking"$5,000,000" and replacing with
"$10,000,000".
3. Article I.L. of the Agreement is amended by striking “$25,000,000” and replacing with
“$50,000,000”.
4. Article VI.A.1. of the Agreement is amended by striking the current paragraph and replacing
with the following:
“1. As of the effective date of Amendment No. 1 to this Agreement, total project
costs areprojectedto be $10,124,600; the Non-Federal Sponsor's contribution of funds required
byArticle II.B.2. of this Agreement is projected to be$3,177,600; the Non-FederalSponsor's
contribution of funds required by Article II.C.2. of this Agreement is projectedto be$0; the non-
Federal proportionate share is projected to be 35 percent; the Non-FederalSponsor's
contribution of funds required by Article XVII.B.3. of thisAgreement is projected to be $0; the
value included in total project costs for lands,easements, rights-of-way, relocations, and
improvements required on lands, easements,and rights-of-way to enable the disposal of dredged
or excavated material determined inaccordance with Article IV of this Agreement is projected to
be $366,000; and theGovernment's total financial obligations for the additional work to be
incurred and theNon-Federal Sponsor's contribution of funds for such costs required by Article
II.H. ofthis Agreement are projected to be $0. These amounts and percentage are estimates
subject to adjustment by the Government, after consultation with the Non-FederalSponsor, and
are not to be construed as the total financial responsibilities of theGovernment and the Non-
Federal Sponsor.
4. All other terms and conditions of the Agreement remain in fullforce and effect.

Ratify and confirm a change order increasing the not-to-exceed amount of the Gator Dredging
contract for the dredging of Clearwater Point to $430,000.00 to cover the cost of dredging an
additional 7,081 cubic yards of sand.
SUMMARY:
The original contract to dredge Clearwater Point was awarded to Gator Dredging in the
amount of $310,752.00. On August 4, 2016, Council approved a contract not to exceed
$350,000.00 for the project. The pricing was based on the Army Corps of Engineers survey in
2014 accounting for 14,400 cubic yards of sand. The additional 7,081 cubic yards is an
increase in sand deposited in the Channel since the September 2014 Army Corps of
Engineers survey. A pre-dredge survey was done before work commenced as is normal
procedure for a dredging operation and disclosed that there was more sand in the area to be
dredged then when the contract was initially awarded. The reason for the pre dredge survey is
to verify any movement and depth differences that occur over time. Due to recent storms,
there was an additional 7,081 cubic yards of sand to be dredged in the proposed area. This
sand was stirred up by storms and brought in with the incoming tides, depositing around
Clearwater point. A post dredge survey will also be conducted to provide documentation of the
final volume removed. This additional material needs to be removed in order to achieve our
permitted channel depth. The change order to the Gator Dredging purchase order for the
additional 7081 cubic yards of sand amounts to $102,674.50 at $14.50 per cubic yard.
Dredging operations commenced the week of September 19, 2016.
APPROPRIATION CODE AND AMOUNT:
Funds are available in capital improvement project 315-93422, Dredging of City Waterways, to
fund this amendment.

SUBJECT/RECOMMENDATION:
Approve a Design Build contract to RRT of Melville, NY, in the amount of $6,935,335 for the
rebuild of the Recycling Processing Center (14-0004-SW) and authorize the appropriate
officials to execute the same. (consent)
SUMMARY:
On March 8, 2016, RFP (Request for Proposal) 20-16 was released and on May 10, 2016,
proposals were received for the expansion of the City’s existing recycling center located at
1701 N. Hercules Ave, Clearwater, FL, 33765.
The Design Build Project includes, a new open air metal building, to house a single stream
recycling sorting system. The project also includes a stormwater management system, paving,
and other appurtenances.
When completed, RRT will train and provide the City with a turnkey equipment package
capable of processing a minimum of 10 tons per hour for the City’s residential and commercial
single stream recovered materials.
This project is expected to be completed within 270 days from issuance of notice to proceed
and will be owned and maintained by the Solid Waste Division.
APPROPRIATION CODE AND AMOUNT:
0315-96809-563600-534-000-0000 $6,935,339
Funds are available in capital improvement project 0315-96809, Recycling Process Center
Expansion/Upgrade in the amount of $800,000.
A first quarter budget amendment will transfer $6,135,339 from Solid Waste Recycling Utility
Fund Reserves to capital improvement project 0315-96809, Recycling Process Center
Expansion/Upgrade to fund the contract.
USE OF RESERVE FUNDS:
Funding for this contract will be provided by a first quarter budget amendment allocating Solid
Waste and Recycling Fund reserves in the amount of $6,135,339 to capital improvement
project 315-96809, Recycling Process Center. The Solid Waste Fund and the Recycling Fund
currently have an estimated $21.7 million in available reserves after recognizing monies
previously committed to capital projects.

SPECIFIC OVERRIDING CONTRACT TERMS AND OBLIGATIONS
The following terms, conditions and obligations shall govern the relationship of the Owner and the
Design-Builder for this Project and shall take priority if inconsistent with the terms, conditions and
obligations of the Consensus Docs Document No. 415, Exhibit A and Exhibit B if there is an
inconsistency.
1. Design-Builder will maintain the Schedule of Work shown on Exhibit D by regularly
submitting regular Project progress reports to the Owner. A limited number of design review
meetings are included to ensure that the design/engineering phase of the Project stays on
schedule and on track. The Design-Builder and Owner shall be involved in all these design
meetings.
2. During the construction phase, Design-Builder will have regularly scheduled progress
meetings with the Owner’s representative to address all critical design/
construction/installation activities, create weekly planners, coordinate all site work and
inform the Owner of any upcoming impacts to their work activities.
3. Work will begin upon execution of this Contract by both parties. An executed copy of this
Agreement shall constitute a Notice to Proceed.
4. Schedule of Work: The preliminary schedule is shown as Exhibit D. The Schedule of Work
is based on the Owner’s approval of any required submittals and the final System Drawings
within 5 days of receipt and receipt of building permits within (14) days of submittal such
that the permit related Work is not delayed.
5. Payment Terms
a. The payment terms will be in accordance with the terms in the Milestone & Payment
Schedule attached as Exhibit E.
b. Retainage shall be five (5)% of each invoice amount up until Substantial Completion of
the Work, or of a designated portion thereof. Thereafter no further retainage will be
withheld. Upon Substantial Completion (start-up of the system), Design-Builder will
invoice for the retainage less 150% of the estimated cost of completing the punch list of
unfinished items. The punch list shall be created during a walk-through at Substantial
Completion. Any remaining retainage monies would be invoiced and become payable
upon completion of the items.
c. No retainage will be withheld on Design services or equipment/material downpayments.
6. Warranty
The applicable Warranty shall be in accordance with Exhibit B, Proposal Section 7, pages 1-5
however the cost of extended warranty periods is not included. Spare parts are included as an
allowance item.
7. Miscellaneous Provisions
a. Delays: In addition to the provisions of Section 6.3 of the Agreement, Owner shall
reimburse Design-Builder for all costs and expenses which result from non-Design-
Builder caused delays which prevent Design-Builder from delivering to Owner
equipment previously completed which Design-Builder is able to ship from its place of
manufacture; and in such case Owner shall make payment to Design-Builder as provided
herein as if the delays had not occurred.
b. The Design-Builder and the Owner will agree upon a Project schedule of key milestones
within 5 days of executing this Agreement; the Design-Builder will submit a detailed
schedule for its Work, corresponding to the Schedule of Work, within 10 days of
execution of this Agreement. The Design-Builder will plan its Work to design, procure

and deliver all the equipment and materials per this schedule. The schedule is also
dependent on the completion of the building electrical service upgrade.
c. Taxes: Using the Owner ODP Program, Owner intends to directly purchase the
Machinex system, balers, hydraulic oil, concrete, reinforcing steel, pre-engineered metal
building, light fixtures, electrical switchgear, and fencing material. See Exhibit I.
d. Prevailing Wages: This project is not subject to prevailing wage.
8. Design-Builder’s Work
i. The Work of the Design-Builder is as described in Exhibit A and Exhibit B (as
the base proposal) except as otherwise noted here in Exhibit C with the agreed to
optional items as shown on the Contract Price Summary contained in Exhibit F.
9. Contract Price
The Contract Price shall be in accordance with the Contract Price Summary contained in
Exhibit F.
10. Allowances
The Contract Price Summary as provided in Exhibit F identifies three items of Work that are
allowances.
Provide Landscaping, Exhibit F-Item 11
Provide Spare Parts, Exhibit F-Item 12
Provide Additional Windscreen, Exhibit F-Item 13
These items are allowances due to this portion of Work being of indefinite scope and/or
where the quality, configuration and other specific characteristics have not as yet been
determined. The allowance dollar amount set forth in Article 7 of the Agreement was
established by the Owner. Following the Notice-to-Proceed, the Design-Builder will
promptly advance the engineering and design of the allowance items to define the Work and
the Owner shall make all allowance selections or decisions in time to meet the Design-
Builder’s progress schedule to avoid delay in the Work. The final price for each allowance
item will be finalized and a Change Order(s) will be issued per the following procedure.
For the allowances designated on Exhibit F as Items 11, 12 and 13
a. Design-Builder will submit a fixed price proposal for these allowance items in a
format acceptable to the Owner once the design of each allowance item is finalized to
a level of completion sufficient to reasonably determine the probable costs or at such
time jointly agreed to by the parties. This pricing will include the Design-Builder’s
costs for labor, materials, equipment, freight, subcontracts, bond and insurance
premium costs, engineering, inspections, testing, quality control, supervision. plus the
Design-Builder’s Fee (overhead and profit). If the item is not included with the ODP
Program, the Design-Builder will include applicable sales tax. The Design-Builder’s
Fee shall be the sum of 7.5% of all costs for overhead markup and 5% of the sum of
all costs and overheard, for profit.
b. The Design-Builder will meet with the Owner to review the price proposal for the
allowance item. The Owner shall promptly provide the Design-Builder any
comments relative to the price proposal and identify any inconsistencies or
inaccuracies.
c. If the price proposal is not agreeable to the Owner; the Design-Builder will resubmit
a revised proposal with appropriate adjustments to the price, its basis or both.
d. If the price proposal is accepted by the Owner, a Change Order will be issued
adjusting the Contract Price as required (additive or deductive). The amount of the
Change Order shall reflect the difference between the agreed upon price for the Work
of the particular allowance item set forth in Article 7 of the Agreement and the
corresponding value of the allowance item indicated in Exhibit F.

e. The parties agree to expedite finalization of these allowances items to avoid delay in
the Work.
11. Owner shall clean all surfaces and remove all recyclables, debris, trash and other loose
materials from all surfaces, pits, bunkers and bins prior to Design-Builder commencing its
demolition, installation and renovation work. Owner shall also vacate offices, and remove
other supplies and spare parts as required. Owner will commence its cleaning and demolition
work in sufficient time prior to Design-Builder’s mobilization so the Design-Builder can
commence with its demolition and removal work without obstruction or delay; however, it is
recognized that portions of the Owner’s cleaning and demolition will occur concurrent with
Design-Builder’s demolition. The parties shall cooperate fully throughout this period to
comply with each other’s safety policies and to avoid delays. At least 30 days prior to the
commencement of demolition and removal, the Owner and Design-Builder will meet at the
Worksite to review and schedule in detail each other’s work and to establish a safety plan.
12. Start-Up & Training
a. Substantial Completion occurs when the Work is substantially complete such that
system start-up has been completed in the unloaded mode (referred to as Phase 2 in
the Design-Builder’s start-up plan as noted in Exhibit H), and the system is deemed
ready by the Design-Builder for operational start-up and testing of the system with
feed stock material (i.e. Phase 3 of the Design-Builder’s start-up plan as noted in
Exhibit H).
b. Following Substantial Completion, operational start-up and testing with feed stock
material will commence. During this period, the feed stock will be gradually
introduced and material flow and equipment performance will be monitored. The
Owner’s operating staff will be trained as to the operation of the system with feed
stock. The feed rate and amount of system run time will be increased to verify that
the system is operating at the guaranteed levels. The Design-Builder will correct any
system deficiencies and the Owner will correct any training errors encountered
during this startup/debugging period.
13. The Owner selects Design-Builder’s Base Proposal as described in Exhibit B and this Exhibit
C which clarifies all items that were selected as part of the Contract negotiations:
I. Items do not change base price:
1. Not reduce single stream tipping area by 3750 sf
2. Not reduce bale storage and clean tipping area by 3200 sf
3. Not add Glass Clean Up System
4. Not add Elevated Visitor Viewing Platform
5. Not add Wheelchair Platform lift (for elevated viewing platform)
6. Exclude all optional warranty options
7. Performance bond to be procured by RRT. City wishes not to take on this task to save
money
8. Keep the 16’ fence as proposed (see exception below on III.11) See also item I.10 below.
9. Manually operated windscreen from the roof level extending down to the ground with a
capability to prevent rain water from coming into the building during windy time (see
exception below on III.12) See also item I.10 below.
10. Based upon the conference call of August 2, 2016 between the city and RRT, the
following summarizes the agreed upon design features of the Fencing and Windscreens for
the building:
A. All windscreens will be fixed and not retractable. RRT to investigate the best method of
connecting the windscreens during design phase.
B. Except as noted below in items I.10.D through I.10.Q , 16’ high fencing will be provided

around the perimeter of the building.
C. Except as noted below in items I.10.D through I.10.Q , all windscreens will be provided
from elevation +/- 12’ (approximate lowest height of sorting platforms) up to the roof
line.
D. Windscreens are not provided from elevation +/- 12’ down to the ground.
E. An allowance of $20,000 to provide windscreens on the lower sections of the fencing
(below +/- 12’) will be included and the City shall decide where they want windscreens
on the lower sections of fencing, note the $20,000 has been added to item II.4 below.
F. Windscreen fabric will be Green PVC 85% as discussed and shown through samples
provided to the City at the meeting. Window openings could be provided (to be
determined during detailed design). Color could also be changed subject to manufacturer
standard colors.
G. Manually retractable gates will not be provided with windscreens. City will consider
adding windscreens per item I.10.E above.
H. In the northwest corner of the building, a 16’ high manually retractable gate will be
provided in order to allow loader/vehicle access onto the Clean Load Tipping Floor. No
windscreens will be provided above this retractable gate, this area will remain open up to
the roof.
I. Along the west wall, from the ground to +/- 12’ elevation, fencing will not have
windscreen; from +/- 12’ elevation to the roof, windscreen will be provided.
J. Along the south wall (except as noted in item I.10.K below), from the ground to +/- 12’
elevation, fencing will not have windscreen; from +/- 12’ elevation to the roof,
windscreen will be provided.
K. Midway along the south wall, 16’ high manually retractable gates will be provided in
order to allow access to Pre-Sort rolloff containers. Windscreen shall be provided above
the gate to the roof.
L. In the southeast corner of the building moving north from column line K-1 to K-2, from
the ground to +/- 12’ elevation, fencing will not have windscreen; from +/- 12’ elevation
to roof, windscreen will be provided.
M. For the entire Single Stream Tipping Floor (except as noted in item I.10.N below)
windscreens will be provided from the top of the 12’ high tipping floor pushwalls up to
the roof.
N. Midway along the Single Stream Tipping Floor east wall, 16’ high manually retractable
gates will be provided in order to allow access to the Single Stream Tipping Floor. No
windscreens will be provided above the retractable gates, this area will remain open up to
the roof.
O. Along the east wall in the area of the loading docks, windscreens will be provided from
+/- 12’ elevation to the roof. No fencing will be provided at the loading docks and an
opening in the fence immediately north of the loading docks will be provided.
P. In the northeast corner of the building, the office area will be located. Fencing in this area
will be eliminated as noted in item III.11 below. Windscreen will be provided from the
top of the office to the roof. We will try to match the color of the windscreen to the color
of the building, to be determined during the design phase.
Q. Along the north wall of the building, from +/- 12’ elevation to the roof, windscreen will
be provided.
II. Items increase base price:
1. Add 15” HMI Screen for $13789 for the downstairs supervisor’s office. This option includes
the reporting software.
The City wants to include Proposal Option #4; the 15” HMI Screen to be used in the

ground floor level supervisor’s office; Increase price $13,789.
3. Include $120,000 in the contract for an allowance pay item for spare parts. List of parts to be
decided during design phase.
The City has decided to include spare parts allowance which would include cost of
freight based upon our discussions at the meeting of 6/30/16; Increase price
$120,000.
3. The City may be interested in extending the 8’ exterior concrete wall of the clean load tipping
area to the edge of the office building. Please provide cost increase for this potential add on
for evaluation.
The City has decided not to add any extension of the proposed 8’ clean load tipping
floor concrete wall. RRT’s proposal includes the 8’ clean load tipping floor concrete
wall as shown on our proposal drawings.
4. As discussed on 8/2/16, the allowance of $20,000 for windscreens per item I.10.E above will
be included in the allowance; Increase price $20,000.
III. Items reduce base price:
1. Deduct 2nd Ballistic Separator; Decrease price $229,172.
2. Credit to the City for RRT to remove and purchase existing Marathon Baler; Decrease price
$13,235.
3. Eliminate Scale House and move scale operation to the new office under building; Decrease
price $40,522.
4. Eliminate Elevated Office and use NEMA 12 rating for the control panel; Decrease price
$40,825.
5. Eliminate Fiber (Newspaper) bunker and shorter sort belt; Decrease price $26,206.
6. Change to Single Eject Block for Optical Sorter; Remove HDPE sort conveyors and Air
Blowers (AB-18 and AB-19) Decrease price $100,815.
7. Not use fiberglass additive in concrete floor; Decrease price $2,700.
8. Eliminate the need for NACE inspector and special paint/finishes
RRT takes exception to RFP requirement section 7.4.4. As discussed during our meeting
of 6/30/16, Butler Buildings does not classify this area as a coastal environment and
therefore RRT will not provide NACE inspector nor the special paint finishes. RRT will
provide a standard acrylic coating. There is no reduction in price.
9. Additional soil borings for foundation may not be needed. RRT will provide all soil borings
as determined necessary for its design.
10. Additional savings realized from exceptions taken to RFP by RRT; as discussed, finalized and
approved by all parties, there are no further items to realize cost savings from exceptions.
11. Eliminate approx. 70’ lineal foot of 16’ high fence at the NE corner office. The intent is to use
the office exterior walls to serve as litter control.
The 16’ high fence will be eliminated in this area. The internal office building goes up 10
feet, the remaining open gap will be covered with windscreen as noted in item I.10.P
above. Eliminating this fence will decrease the price $5,250.
12. Eliminate lineal foot of manually operated windscreen at the NE corner office. The intent is to
use the office exterior walls to block rain from coming into the building.
The windscreen will not be eliminated in this area, see item I.10.P above.
IV. Items selected for the Owner Direct Purchase Program:
1. The Owner will issue a change order reflecting the sale tax savings and the cost of the
Owner Direct Purchase of three items: Machinex single stream system, balers, and pre-
engineering metal building.
2. The total estimated sales tax savings is $171,741 for the three Owner Direct Purchase

(ODP) items as noted below. This was calculated based on the taxable portion of the
expected purchase cost for the items. The actual tax savings to be issued as a credit to the
Owner will be based on the purchase price under the ODP program.
a. Machinex Single Stream System $114,465 (based on taxable portion of $1,907,758).
b. Balers $38,280 (based on taxable portion of $638,000).
c. Pre-Engineered Metal Building $18,996 (based on taxable portion of $316,600).
14. For clarity, Exhibit B, Tab 6 Attachment, Exceptions & Clarifications (pages 1-4) shall apply
except as otherwise modified here in Exhibit B, document from RRT dated 6/7/16 (page 1-9)
supplementing RRT’s original proposal dated 5/10/16 and Exhibit C.
15. The fees for all permits is included and to be paid by the Design-Builder. This supersedes
Agreement Section 3.2.5.
16. The line item value of Design-Builder’s base proposal price for “Fire Protection (Sprinkler &
Alarm)” as listed in Exhibit B, original RRT Proposal Tab 4, Page 1, is incorrectly typed. The
line item is changed to $117,190 from $17,190. Also, the $1 difference between the sum of
the seven line items and the base price is due to rounding. Disregard this difference, the
“Total Base Price” is the applicable and correct value.

Owner Direct Purchase (ODP) Instructions
1. Upon contract award and execution, a Purchase Order (PO) shall be issued to Contractor for the
full amount of contract.
2. Contractor shall submit a list (ODP Summary) of potential ODP vendors and estimated dollar
amounts (minimum of $10,000) to the City for consideration prior to initial pay application.
Certain bid proposals will list pre‐determined item(s) for ODP and the accompanying tax
savings. The ODP Summary shall list: (a) item cost and (b) sales tax savings associated with the
item. Direct purchase shall be considered for single items that exceed $10,000 in value and/or
items identified in Section V, Bidders Proposal.
3. Contractor shall prepare Request to Requisition forms (see attached) for each vendor to the
City for review and approval, in electronic, MS Word format. The City will review, code, and
process the requisition form. The City prefers that all Request to Requisitions be included in a
single submittal.
4. A Change Order (CO) shall be issued to Contractor reducing their PO by the amount of the ODP
purchase(s) and the sales tax savings (per Request to Requisitions). COs will be drafted by the
City and will be forwarded to the Contractor for execution. Contractor shall submit two (2)
originals, signed, sealed and witnessed, to the City for execution. One fully executed original CO
shall be returned to the Contractor.
5. Concurrently, the City Purchasing Department shall issue ODP POs directly to each vendor (via
email), along with an executed Certificate of Entitlement and the City’s Certificate of Tax
Exemption. The Contractor and City Project Manager will be copied.
6. City’s Project Manager shall coordinate delivery with Contractor and Vendor. Material shall be
delivered to the project site. Contractor will verify contents and check for defective materials.
Vendor to send original invoice to the City as the purchaser and a copy to the Contractor.
Invoices shall include the ODP PO number and invoice number.
7. Contractor shall review invoice copy for accuracy and send electronic approval to the City
Project Manager within fourteen (14) calendar days after date of receipt of invoice. This
electronic approval shall consist of the Contractor’s signature, date, and indication of approval
on the scanned invoice as well as scanned copies of the delivery documentation or an
explanation as to why the invoice should not be paid. These items shall be emailed to the City
Project Manager and City Engineering Department’s Senior Accountant, copy to Construction
Inspector.
8. Contractor shall provide delivery documentation (delivery ticket, packing slips, bill of lading,
etc.) in hard copy form to the City Project Manager attached to a copy of the invoice within
thirty (30) calendar days after date of receipt of invoice. If these hard copy items are delivered
within fourteen (14) calendar days after date of receipt of invoice, then electronic approval as
noted in paragraph seven (7) above may be excused.
9. City Project Manager shall have final approval to pay invoices and City Accounting Department
shall issue payment to the Vendor for materials or equipment received.
10. ODP POs must be closed out prior to closing out the contract/Contractor PO. If material costs
needed for the project exceed the ODP PO amount, the ODP PO will not be increased. Amounts
in excess of the ODP PO will be paid for by the Contractor.

INSURANCE
1. Pursuant to Section 10.2.1, prior to the start of the Work, the Design-Builder shall procure and
maintain in force Worker's Compensation Insurance, Employers’ Liability Insurance, Business
Automobile Liability Insurance, and Commercial General Liability Insurance (CGL) in the
following amounts or values:
a.) Commercial General Liability Insurance with limits not less than $1,000,000 per occurrence,
$2,000,000 general aggregate, $2,000,000 products and completed operations. Commercial
general liability shall be on an occurrence basis with the general aggregate applicable for
each Project. This insurance shall name the Owner as an additional insured and shall require
at least a 30 day notice to the Owner of cancellation or intent to cancel prior to the effective
date of such cancellation.
b.) Business Automobile Vehicle Liability Insurance with limits not less than $1,000,000 per
occurrence combined single limit covering any auto owned, non-owned and leased vehicles.
If the company owns vehicles, this insurance shall name the Owner as an additional insured
and shall require at least a 30 day notice to the Owner of cancellation or intent to cancel prior
to the effective date of such cancellation.
c.) Workers Compensation and Employers’ Liability insurance in accordance with all applicable
laws.
d.) Umbrella/Excess Liability Insurance with a limit of $5,000,000.00 per occurrence and annual
aggregate.
2. Pursuant to Section 10.7, the Design-Builder shall obtain, either itself or through the Design
Professional, professional liability insurance for claims arising from the negligent performance
of professional services under this Agreement, which shall be general office coverage in an
amount not less than $2,000,000. The Professional Liability Insurance shall include prior acts
coverage sufficient to cover all services rendered by the Design-Builder and by its Consultants.
3. All insurance required by the Agreement shall be with companies licensed to do business in the
applicable State and in a form satisfactory to Owner. For items 1a. and 1d., Holder Certificates
naming the Owner with a thirty (30) day cancellation clause shall be filed with and approved by
Owner at least five (5) days in advance of commencing work under this Agreement.

SUMMARY:
August 4, 2016, City Council approved the use of Construction Manager at Risk Services
(CMR) for Continuing Contracts Biltmore Construction Co., Inc. of Belleair, FL; Cathey
Construction and Development, LLC of Mexico Beach, FL; Certus Builders, Inc. of Tampa, FL;
J. Kokolakis Contracting, Inc. of Tarpons Springs, FL; J.O. Delotto & Sons, Inc. of Tampa, FL;
Keystone Excavators, Inc. of Oldsmar, FL; Khors Construction, Inc. of Thonotosassa, FL; and
Wharton-Smith, Inc. of Sanford, FL.
These firms were selected in accordance with Florida Statutes 255.103 and 287.055 under
Request for Qualifications 24-16 based upon construction experience, financial capability,
availability of qualified staff, local knowledge and involvement in the community.
The General Services/Garage office project is a result of many of the following items having
reached the end of their useful lifespan to include; windows (1st and 2nd floor), mechanical
system, ceiling, and lighting (2nd floor).
This project will replace all of these items and include an upgraded electrical system and
energy efficient led lighting. Also, the addition of foam insulation to the underside of the roof
deck and walls will create a properly sealed building envelope to ensure maximum efficiency
of the new mechanical system.
Work shall commence upon award and execution of the proposal and will be completed 75
calendar days from the notice to proceed date.

GMP Narrative
September 20, 2016
The following Project Narrative outlines our GMP considerations and approach to the renovation of the
second of the General Services offices as detailed in the provided Construction Documents. Our estimate is
based upon the Construction Documents prepared by Advanced Systems Engineering and Empad Architecture
as listed in the Exhibit, and the following clarifications.
GENERAL CLARIFICATIONS
1. Comprehensive General Liability and Umbrella Excess Liability Insurances are included.
2. Builder’s Risk Insurance and deductibles are excluded. General Risk coverage is provided by Owner
3. A Payment and Performance Bond is included
4. We have not included consumption charges for any temporary utilities (water, electric, etc). This is to
be provided by Owner. We have included temporary restroom facilities for our workers on-site.
5. All sales tax is included.
6. Warranties shall commence on the date of project substantial completion, this includes any extended
warranties as stated in the project specifications.
7. Asbestos survey to be provided by Owner prior to commencement.

FLORIDA 33764, UPON ANNEXATION INTO THE CITY OF
CLEARWATER, AS RESIDENTIAL LOW (RL); PROVIDING
AN EFFECTIVE DATE.
WHEREAS, the amendment to the future land use plan element of the
comprehensive plan of the City as set forth in this ordinance is found to be reasonable,
proper and appropriate, and is consistent with the City's comprehensive plan; now,
therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CLEARWATER, FLORIDA:
Section 1. The future land use plan element of the comprehensive plan of the City
of Clearwater is amended by designating the land use category for the hereinafter
described properties, upon annexation into the City of Clearwater, as follows:

AN ORDINANCE OF THE CITY OF CLEARWATER,
FLORIDA, ANNEXING CERTAIN REAL PROPERTY
LOCATED ON THE SOUTH SIDE OF MERRILL AVENUE
APPROXIMATELY 450 FEET WEST OF MCMULLEN
BOOTH ROAD, WHOSE POST OFFICE ADDRESS IS 3041
MERRILL AVENUE, CLEARWATER, FLORIDA 33759, INTO
THE CORPORATE LIMITS OF THE CITY, AND
REDEFINING THE BOUNDARY LINES OF THE CITY TO
INCLUDE SAID ADDITIONS; PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the owner of the real property described herein and depicted on the
map attached hereto as Exhibit A has petitioned the City of Clearwater to annex the
property into the City pursuant to the Interlocal Service Boundary Agreement authorized
by Section 171.204, Florida Statutes, and the City has complied with all applicable
requirements of Florida law in connection with this ordinance; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. The following-described property is hereby annexed into the City of
Clearwater and the boundary lines of the City are redefined accordingly:
Lot 8, Block I, Kapok Terrace First Addition, as per plat thereof, recorded in Plat
Book 49, Page 48, of the Public Records of Pinellas County, Florida;
(ANX2016-08026)
The map attached as Exhibit A is hereby incorporated by reference.
Section 2. The provisions of this ordinance are found and determined to be
consistent with the City of Clearwater Comprehensive Plan. The City Council hereby
accepts the dedication of all easements, parks, rights-of-way and other dedications to the
public, which have heretofore been made by plat, deed or user within the annexed
property. The City Engineer, the City Clerk and the Planning and Development Director
are directed to include and show the property described herein upon the official maps and
records of the City.
Section 3. This ordinance shall take effect immediately upon adoption. The City
Clerk shall file certified copies of this ordinance, including the map attached hereto, with
the Clerk of the Circuit Court and with the County Administrator of Pinellas County, Florida,
within 7 days after adoption, and shall file a certified copy with the Florida Department of
State within 30 days after adoption.

AN ORDINANCE OF THE CITY OF CLEARWATER,
FLORIDA, ANNEXING CERTAIN REAL PROPERTY
LOCATED ON THE WEST SIDE OF PINELAND DRIVE
APPROXIMATELY 360 FEET SOUTH OF SUNSET POINT
ROAD, WHOSE POST OFFICE ADDRESS IS 1846
PINELAND DRIVE, CLEARWATER, FLORIDA 33755, INTO
THE CORPORATE LIMITS OF THE CITY, AND
REDEFINING THE BOUNDARY LINES OF THE CITY TO
INCLUDE SAID ADDITIONS; PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the owner of the real property described herein and depicted on the
map attached hereto as Exhibit A has petitioned the City of Clearwater to annex the
property into the City pursuant to Section 171.044, Florida Statutes, and the City has
complied with all applicable requirements of Florida law in connection with this ordinance;
now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. The following-described property is hereby annexed into the City of
Clearwater and the boundary lines of the City are redefined accordingly:
Lot 21, Block B, HARBOR VISTA, according to the map or plat thereof, as recorded
in Plat Book 18, Page 41, of the Public Records of Pinellas County, Florida;
(ANX2016-08027)
The map attached as Exhibit A is hereby incorporated by reference.
Section 2. The provisions of this ordinance are found and determined to be
consistent with the City of Clearwater Comprehensive Plan. The City Council hereby
accepts the dedication of all easements, parks, rights-of-way and other dedications to the
public, which have heretofore been made by plat, deed or user within the annexed
property. The City Engineer, the City Clerk and the Planning and Development Director
are directed to include and show the property described herein upon the official maps and
records of the City.
Section 3. This ordinance shall take effect immediately upon adoption. The City
Clerk shall file certified copies of this ordinance, including the map attached hereto, with
the Clerk of the Circuit Court and with the County Administrator of Pinellas County, Florida,
within 7 days after adoption, and shall file a certified copy with the Florida Department of
State within 30 days after adoption.

CITY OF CLEARWATER, FLORIDA:
Section 1. The future land use plan element of the comprehensive plan of the City
of Clearwater is amended by designating the land use category for the hereinafter
