PLANNING & DEVELOPMENT CITY OF CLEARWATER POST OFFICE Box 4748, CLEARWATER, FLORIDA 33758-4748 MUNICIPAL .SERVICES BUILDING, 100 SOUTH MYRTLE AVENUE, CLEARWATER, FLORIDA 33756 TELEPHONE (727) 562-4567 FAx (727) 562 -4865 August 19, 2015 Mr. Istvan Peteranecz Behar & Peteranecz Architects 103 Rogers Street Clearwater, FL 33765 Re: Development Order - FLS2013- 02006A 650 Bay Esplanade Ave. Dear Mr. Peteranecz: On June 6, 2013, the Development Review Committee (DRC) reviewed a Flexible Standard Development application to permit a 102 -room overnight accommodation use in the Tourist (T) District with a lot area of 41,232 square feet (0.95 acres), lot widths of 104 feet along Bay Esplanade (east); 289.98 feet along Bay Esplanade (south) and 182.06 feet along Poinsettia Avenue (west); a front (east) setback of 13.1 feet (to building); front (south) setback of 15 feet (to building); front (west) setbacks of 18 feet (to balconies) and 23 feet (to building); a side (north) setback of eight feet (to balconies) and ten feet (to building); a building height of 75 feet (from Base Flood Elevation to mid -point of decorative roof structure); 131 off - street parking spaces; and a request for a two -year Development Order, pursuant to the Community Development Code Section 2- 802.M, Section 4 -303 and the requirements of the Old Florida District of Beach by Design; and an increase in the maximum density through the allocation of 55 overnight accommodation units from the Hotel Density Reserve created pursuant to Beach by Design, as well as an increase in the percentage of palm trees to 100 percent where 75 percent is allowable, as part of a Comprehensive Landscape Program, pursuant to the Community Development Code Section 3- 1202.G., subject to eighteen conditions of approval. A Development Order, approving the application, subject to conditions of approval, was issued on April 14, 2014. Subsequently, a request for a minor revision was submitted on August 14, 2015 that included the following changes to building design, stepbacks, and setbacks: • The height of the building has been reduced from 75 feet (from base flood elevation to mid- point of decorative roof structure) to 65 feet (to flat roof from base flood elevation); • The decorative roof structure (previous 75 feet to mid -point of decorative roof) has been replaced by 42 inch high parapet walls along the front (south) roofline; • The front (east) setback has been increased from 13.1 feet (to building) to 14.3 feet (to building); M TQum. EMPLOYMENT AND AFFIRMATIVE ACTION Emnm'ER" .w • The front (east) stepback will be 14 feet in width along length of the building, • The pool and pool deck have been relocated from level three to the ground level to the southwest side of building along south facade; • The pool and deck will have a height greater than 12 inches above grade to be considered a primary structure which allows it to be located in front of the principle building; • The balconies are removed from the south elevation. The balconies will be replaced by covered awnings added to windows for facade architectural elements percentage. The south elevation will consist of 61 percent of architectural elements; • The balconies are removed from the east elevation. The balconies will be replaced by covered awnings added to windows for facade architectural elements percentage. The east elevation will consist of 60 percent of architectural elements; • The balconies are removed from the north elevation. The balconies will be replaced by covered awnings added to windows for facade architectural elements percentage. The north elevation will consist of 60 percent of architectural elements; and • The balconies are removed from the west elevation. The balconies will be replaced by covered awnings added to windows for facade architectural elements percentage. The west elevation will consist of 60 percent of architectural elements. In accordance with Section 4- 406.A., CDC, the revisions proposed on plans submitted and date stamped received August 14, 2015 are deemed to be a Minor Revision and are APPROVED, subject to the condition that all conditions of approval as originally set forth in the Development Order of April 14, 2014, are still in effect and enforceable.
