To provide continuity for research, items are listed in agenda order although not necessarily discussed in that order. Minutes Approval - April 3, 1996 Member Benjamin suggested clarifying language on page 2, second sentence in the fourth paragraph to read, “Staff was requested to delete the word ‘Executive’ from the title of the airpark in all future documents.” In the last paragraph on page 3, he requested changing a reference from “fuel farm” to “hangars.” moved to approve motion Member Bils the minutes as corrected. The was duly carried seconded and unanimously Tenant Report - FBO The Chair received the report and read it into the record. It was indicated 38 shade hangars, 10 enclosed hangars, 23 hard stands and 20 grass tiedowns are occupied. Request for Proposal - FBO In response to a question, Mr. Bahnick said remediation of ADA deficiencies is in the RFP for the new FBO. He said Suncoast Aviation was asked to do what could be done to make equipment more handicap accessible without addressing structural changes such as lowering thresholds or widening doorways. Mr. Bahnick indicated the City has an in-house ADA committee and the entire facility is to be brought into compliance. Discussion ensued regarding an ADA compliance report. It was indicated the Airport Authority takes the ADA seriously and requested staff to implement plans for remediation or appeal very soon. The City is looking at whether to invest grant money into fixing the old building, or building a new one. Staff was requested to provide copies of the ADA report and cost estimates of refurbishment and new construction. maa05.96 05/01/96 1 Annual Report to the City Commission -- May 16, 1996 Chairman Silcox said he would copy his draft report to Mr. Bahnick next week. Business Plan Mr. Bahnick said this issue is scheduled for discussion at the next City Commission meeting. He asked all members to review the copies they received. Security Gates Mr. Bahnick said Smith Fence, the original installer, was issued a purchase order to replace, repair, or rebuild and pull maintenance on both gates. He questioned whether members wished to change the security code at this time. Discussion ensued regarding whether two codes can be programmed at once, to allow time to phase out the old code while tenants are made aware of the new one. Member Silcox will investigate that question and whether it is feasible to have remote controls for those tenants who desire to purchase them. Mr. Bahnick reported the Smith Fence contact, Matt Fischler, can be reached at 573-5440. New Hangar Construction Mr. Bahnick said the City should have FDOT’s response by next week and the City will advertise for bids. He hoped to be able to bring those bids to the next Airport Authority meeting. He said FDOT wants to see the City getting some revenue from the new hangars, because their JPA’s have to show some good going to the community. Discussion ensued regarding pilot controlled runway lights and limited hours of operation. One member stated the national government is going to start redirecting funds away from huge air traffic hubs toward smaller airports and hoped grant money will become available. Mr. Bahnick responded this has to be approached with sensitivity to the community. Lobbyist Registration Ordinance Mr. Carassas explained a new ordinance requires annual registration of compensated lobbyists who try to influence board members, beginning in April, 1997. They are required to sign a statement saying who they lobbied, what was discussed and who compensated them. He stressed it does not affect board members in any way, except that members are requested to tell lobbyists of the registration requirement. Exceptions are City employees, expert witnesses, and attendees of public meetings. Discussion ensued and Mr. Carassas responded to questions. He stated the object of the ordinance is to register professionals who are paid to lobby. The City is not trying to inhibit normal business with customers. He said lobbyist questions are governed by the sunshine laws, and he discouraged two or more board members from receiving information from a third party off the record. City Engineer Rich Baier arrived at approximately 3:30 p.m. and provided additional information on this issue. He said the ordinance is being revised to make it more user friendly. maa05.96 05/01/96 2 He explained everyone being compensated for lobbying special consideration from board members is required to identify themselves and file with the City Clerk a notarized registration form. He said compensation does not have to be monetary, but can include T-shirts, lunch or plane rides. He said the registration form is available in many City offices and encouraged members to adhere to the current ordinance until it is changed. One member expressed strong concern with putting the onus on board members to provide notification when the ordinance is a matter of public record. He did not want to be charged with notifying everyone who attempts to voice an opinion, and questioned the legal responsibility of board members to comply. In response to pointed questions, Mr. Baier said members have no legal obligation to notify lobbyists, or verify compliance, and are not held accountable in any way. Mr. Carassas indicated, while board members are insulated when acting in their advisory capacity, it is prudent to advise the public of the lobbyist registration ordinance. Discussion ensued regarding examples of conversations that would and would not be considered lobbying. It was indicated the City Commission is simply asking for cooperation in order be informed who is lobbying whom. A question was raised regarding whether the proposed amendment will relieve board members of this obligation. Mr. Baier indicated many people feel the ordinance is awkward, cumbersome, and reaches too far down into the organization. He will forward the Airport Authority’s comments to the City Attorney. Other Business ?? Assistant City Attorney John Carassas reported a series of depositions were conducted last week with regard to the FBO’s suit against the City. He felt it likely a court date would be set for mid-June. He said the City is proceeding with the RFP as indicated at the last meeting, while waiting for the judicial decision whether the current FBO may exercise a renewal option. A concern was expressed regarding the wasted expense to the bidders if the judge decides in favor of Suncoast Aviation. Mr. Carassas indicated the decision whether or not to respond to the City’s invitation to bid rests with the bidders. In response to a question, Mr. Bahnick said FBO bids are to be in by June 28 for a start date in February, 1997. Member Silcox questioned a memo from Rich Baier concerning Mr. Emshoff’s willingness to continue as FBO and listing airport facilities in comparably populated cities. Mr. Baier stated that correspondence was a draft and was distributed in error. He said he is preparing the data in response to questions regarding issues that come forward repeatedly. The memo will attempt to address those issues with facts not readily available to the City Commissioners. He will refine the data and distribute at a later time. ?? In response to a question, Mr. Bahnick said new runway lights follow the new hangars on the priority list. Both are active and moving forward. ?? Mr. Bahnick announced that Dr. Goss submitted her resignation formally. The Chair will send a letter acknowledging her time investment and community-minded involvement. Concern was expressed her health has not permitted regular attendance in recent months. Staff was asked to copy the code regarding advisory board attendance to the members. Discussion ensued regarding what qualifications members desire and whether to express a preference to the City Commission. ?? Member Silcox stated he has received complaints from the condominium association to the east of the airpark concerning noise from banner towing aircraft. He questioned whether the City could write a letter to the responsible pilot(s). Discussion ensued regarding how and to whom to deliver notice. Mr. Carassas recommended having the FBO post general notice outlining the problem and requesting pilots to follow the rules and established air traffic patterns. Mr. Emshoff said he does this several times a year already and felt stronger measures are needed. It was indicated the individual causing the immediate problem will be moving on soon and immediate action may not be needed. ?? In response to a question from Member Benjamin, Mr. Bahnick stated no action is being taken to change the leases in accordance with the Fire Marshal’s suggestions. The concern expressed about bringing the main hangar into compliance is no longer an issue because compliance will be achieved when the hangar is refurbished. ?? Mr. Baier reported the Engineering Department will relocate this weekend to the second floor of the new Municipal Services building (MSB) on the northwest corner of Myrtle Avenue and Pierce Street. The new telephone number is 562-4747. ?? John Atanasio of the Civil Air Patrol expressed concern that last month’s Airport Authority minutes stated it was not known if consideration of the Civil Air Patrol land request will come forward in June. He expressed concern with the time this has taken and that the issue is still under study. Mr. Bahnick reiterated all leased City properties will be reviewed in June, but pointed out the property in question is not leased. Mr. Baier stated the City Commission will be looking at more than 100 parcels during a series of special public meetings. He said there is nothing anyone in the City can do until the City Commission looks at the philosophy of all the properties at large and gives direction. Some of the other issues they will discuss are City Commission policies, budget, advisory boards, goals and strategic planning. He understood from correspondence that the City Commission intended to make this decision without recommendation from the City Manager. Referring to the draft memo discussed earlier, Mr. Baier pointed out using every property for its highest and best use would rid the City of parks, roads, and alleyways. This is clearly not what is wanted for the City. He felt the Commission wants to ensure the actual uses are in alignment with the long term vision for the City.
