Request: The Community Development Board (CDB) is reviewing a proposed City- owned/operated pier/boardwalk in the Tourist (T) District of the Marina character district of Beach by Design within the eastern end of the Papaya Street public right- of-way. The project will consist of a 15-foot deep boardwalk running the breadth of the right-of-way, as well as a pier that extends from the boardwalk 75 feet and is between 15 and 25 feet wide (Section 3-601.C.3). Neighborhood Associations: Clearwater Neighborhoods Coalition, Clearwater Beach Association Presenter: Mark T. Parry. AICP, Senior Planner Chair Barker reported a conflict of interest. In response to a suggestion that the pier be modified to permit paddleboard launching, Administrative Support Manager Felicia Donnelly said the project was based on Beach by Design guidelines and permitted as designed. It may be possible to modify the pier in the future. Case: FLD2016-05015 — 45 Causeway Boulevard Level Two Application Owner: City of Clearwater Applicant: Terri Skapik, Woods Consulting, Inc. (1714 County Road 1, Suite 22, Dunedin, FL 34698; phone: 727-786-5747, email: terriskapik(aD-woodsconsulting.org) Location: 18 acres at the Clearwater Beach Marina directly east of the intersection where South Gulfview Boulevard meets Coronado Drive. Request: The Community Development Board (CDB) is reviewing a proposed deck, pier and boatlift addition to the existing commercial dock in the Institutional (1) District, Open Space Recreation District (OSR) and the Preservation (P) District of the Pier 60 character district of Beach by Design for property located at 45 Causeway Boulevard. The addition will feature 395 square-feet of deck, pier and boatlift to existing slip one with a side (south) setback of six feet and is being reviewed consistent with the dock/marina standards. Case: FLD2016-05013 — 667 Bay Esplanade Level Two Application Owner: Clearwater Bay Club, LLC. Applicant: Robin Gage, Northside Engineering Inc. (300 S. Belcher Road, Clearwater, FL 33765; phone: 727-531-8517; email: robin(aD-northsideengineering.net) Location: 1.93 acres on the east side of Bay Esplanade, approximately 385 feet east of Poinsettia Avenue. Request: The Community Development Board is reviewing a proposed 14 unit overnight accommodation in the Tourist (T) District for the property located at 667 Bay Esplanade. The project is 58 feet in height (from BFE), includes 17 off-street parking spaces and requests allowable flexibility from lot width and setback requirements, the Design Guidelines of Beach by Design, and a two-year Development Order (Sections 2-803.D and 4-407). Community Development 8/16/2016 3 Neighborhood Associations: Clearwater Neighborhoods Coalition, Clearwater Beach Association Presenter: Kevin W. Nurnberger, Senior Planner Member Funk moved to accept Robert Tefft as an expert witness in the fields of zoning, site plan analysis, code administration, and planning in general. The motion was duly seconded and carried unanimously. Planning Manager Robert Tefft reviewed the Staff Report. Housh Ghovaee, representing the applicant, said they had worked closely with staff to meet all requirements of the Old Florida District and Beach by Design. A resident expressed concerns that construction would be noisy and could damage his property, that the planner had not responded to questions from him or his manager, and that he had not been able to review the plans even though he visited City offices. Mr. Tefft said Senior Planner Nurnberger, who was ill today, had reported no contacts regarding this development. The referenced manager had been to the Planning & Development Department office and said all was fine. All materials for this case were available online and at the department. It was noted the resident had opportunity to review all materials and could have discussed concerns with a different planner. Mr. Ghovaee said he always had good responses from Mr. Nurnberger. He said the developer would make every effort to minimize construction noise and dust and meet City guidelines. Member Funk moved to approve Case FLD2016-05013 based on the evidence and testimony presented in the application, the Staff Report and at today's hearing, and hereby adopt the Findings of Fact and Conclusions of Law stated in the Staff Report with conditions of approval as listed. The motion was duly seconded and carried unanimously. Alternate Board Member Quattrocki did not vote. 5. PULLED FROM CONSENT AGENDA Level Three Application Case: CPA2016-04001 —Amendments to the Clearwater Comprehensive Plan Applicant: City of Clearwater Request: Review and recommendation to the City Council of an amendment to the Clearwater Comprehensive Plan to support the implementation of the US 19 Corridor Redevelopment Plan and new US 19 future land use categories, establish criteria for plan amendments in the Coastal Storm Area, and update various terms and references. Community Development 8/16/2016 4 Neighborhood Association: Clearwater Neighborhoods Coalition, Presenter: Lauren Matzke, AICP, Long Range Planning Manager Member Boutzoukas reported a conflict of interest. Long Range Planning Manager Lauren Matzke reviewed the Staff Report. In response to a question, she said the City had held open houses for stakeholders and mailed more than 6,700 notices regarding items E5 and E6; the City received no letters of opposition. She spoke with many interested parties and answered their questions; some of the 50 messages she received were hang ups or repeats. She anticipated more responses to the next phase of amendments re rezoning and zoning district standards. One person questioned the impact of changes to a shopping center. One person questioned the impact of changes to a mobile home park. One person expressed concerns re the environment and that changes would allow commercial development closer to residences. Ms. Matzke said the amendments would not go into effect before January 2017 or nullify current site plan agreements. The Doral mobile home park was a grandfathered use on US 19. The plan included portions of the US 19 corridor outside City limits should future annexations occur. Zoning standards will consider transitions to residential areas. She recommended everyone with concerns to contact staff. She met with the speakers after the meeting to answer questions. Member Funk moved to recommend approval of Case CPA2016-04001 based on evidence in the record, including the application and the Staff Report, and hereby adopt the Findings of Fact and Conclusions of Law stated in the Staff Report. The motion was duly seconded. Members Funk, Allbritton, Anuszkiewicz, Lau, Flanery, Acting Member Quattrocki and Chair Barker voted "Aye"; Member Boutzoukas abstained. Presenter: Lauren Matzke, AICP, Long Range Planning Manager Member Boutzoukas reported a conflict of interest. Long Range Planning Manager Lauren Matzke reviewed the Staff Report. One person expressed concern the plan was unclear, would affect property taxes, and appeared to encroach into a neighborhood. Ms. Matzke said the plan only included commercial properties in the questioned area south of Curlew Road. Drafts of zoning district standards were posted online 2 years ago; ongoing revisions were based on stakeholder feedback. It was recommended that people with concerns speak with Ms. Matzke. It was noted this item only addressed future land use designations. Member Anuszkiewicz moved to recommend approval of Cases LUP2016-06004, LUP2016-06005, and LUP2016-06006 based on evidence in the record, including the application and the Staff Report, and hereby adopt the Findings of Fact and Conclusions of Law stated in the Staff Report. The project requests allowable flexibility from Coastal Construction Control Line setback requirements (2 -204.E and 3- 905.C.3). The motion was duly seconded and carried unanimously. Senior Planner Matthew Jackson reviewed the staff report. Nearby properties had similar amenities. The City received one letter opposing the request. Jeff Knight, representing the applicant, said the Building /Flood Board of Adjustment and Appeals had declared the seawall to be non functioning.
