APPEAL TO FALSE ALARM CITATION by SUTTON PLACE JEWELERS

Ms. Deptula called the meeting to order at 10:32 a.m. and stated we were here to hear an appeal of
a false alarm citation.
Mr. Navarro stated the first citation was due to a lightning storm. Everything was okay and they paid
their first false alarm citation. Two more citations were reported to the store which were a result of
malfunction in the system. He stated there was no mistake by employees and no control at the store. The
mall in which the store is located was renovated in February and, prior to that, the alarm system had been in
place five years with no problems. It seems since they reopened in February, there have been a few kinks in
the system.
Ms. Deptula asked if ADT Security Systems had been the alarm company the entire time, and it was
indicated this was the case.
Officer Dunn indicated the jewelry company did not get a permit for the alarm company when it
needed to. They did respond to the letter regarding the need for an alarm permit; the application was filed
and a decal issued. He questioned when the system was operational after the rewiring, and Mr. Navarro
indicated this was in the last week of February. Mr. Dunn indicated if a major change had been made in the
system, ADT should have gotten a permit and final inspection.
Mr. Navarro indicated he was unaware of the need for a permit. Officer Dunn stated ADT was aware
of this requirement.
Officer Dunn reviewed the false alarms, stating on April 12th an alarm occurred after midnight that
Mr. Navarro responded to and nothing was amiss. On April 14th at 6:18 p.m. another alarm was sounded;
the subscriber did not respond and the dispatcher indicated it was an apparent mechanical problem.
Mr. Navarro indicated he is not debating the alarms occurred, but he does not feel he was
responsible.
Assistant City Attorney Hull read the section of the code regarding false alarms. He reviewed the
various citations and responses to alarms.
Mr. Navarro indicated he was contesting the false alarm citation due to the fact that he felt the
alarms were out of his control.
Ms. Deptula indicated she had ten days to respond in writing regarding her findings.
The hearing adjourned at 10:51 a.m.
