08/24/2005 MUNICIPAL CODE ENFORCEMENT BOARD MEETING MINUTES CITY OF CLEARWATER August 24, 2005 Present: Douglas J. Diana Secretary for the Board Brenda Moses Board Reporter The Vice-Chair called the meeting to order at 3:01 p.m. at City Hall, followed by the Pledge of Allegiance. To provide continuity for research, items are in agenda order although not necessarily discussed in that order. The Vice-Chair outlined the procedures and stated any aggrieved party may appeal a final administrative order of the Municipal Code Enforcement Board to the Circuit Court of Pinellas County within thirty days of the execution of the order. Florida Statute 286.0105 requires any party appealing a decision of this Board to have a record of the proceedings. 1. PUBLIC HEARINGS A. Case 22-05 (Contd. from 7/27/05) Stowell Properties 2815-2817 Gulf-To-Bay Blvd. Grass Parking – Franco Case 22-05 was withdrawn by staff. B. Case 20-05 (Request for Reconsideration) Thomas C Jessup & Dorothy J Jessup 1770 Drew Street Portable Storage Unit – Parra Case 20-05 was continued by staff to October 26, 2005. 2. UNFINISHED BUSINESS A. Case 17-02 – Affidavit of Compliance Jacqueline Chaplin, Est 1000 Grantwood Ave Fences/Walls maintained, Nuisance Dangers, Exterior Storage – King/Phillips Code Enforcement 2005-08-24 1 AND B. Case 18-02 - Affidavit of Compliance Chuck C. Broadhurst 906 Pennsylvania Avenue Permits and Inspections – Coccia AND C. Case 13-05 – Affidavit of Compliance Frank and Anne Mongelluzzi 818 Snug Island Fees & Inspections - Coccia Member Keyes moved to accept the Affidavits of Compliance for Cases 17-02, 18-02, motioncarried and 13-05. The was duly seconded and unanimously. 3. OTHER BOARD ACTION/DISCUSSION A. Case 33-99 - Request to address board at future meeting re reduction of fine Melvin Spinoza 1632 Drew Street Permits and Inspections – Coccia (Fine - $56,600) Development Services Manager Bob Hall said staff is opposed to a reduction of the fine due to the amount of time the property has remained in a noncompliant state. Member Keyes moved to deny the request to address the Board at a future meeting motioncarried regarding a reduction of fine. The was duly seconded and unanimously. 4. NEW BUSINESS – None. 5. APPROVAL OF MINUTES - July 27,2005 Member Keyes moved to approve the minutes of the regular meeting of May 25,2005, as submitted in written summation to each Board Member. The motion was duly seconded and carried unanimously. 7.
