06/28/2000MUNICIPAL CODE ENFORCEMENT BOARD MEETING CITY OF CLEARWATER June 28, 2000 Present: Franke Huffman Acting Chair David Allbritton Member Sheila Cole Member Joyce Martin Member Absent: Helen Kerwin Chair Lawrence Tieman Vice-Chair Pete Caffentzis Member Also Present: John Carrassas Assistant City Attorney – arrived 3:15 p.m. Tony Tuntasit Attorney for the Board Sue Diana Secretary for the Board Brenda Moses Board Reporter The Chair called the meeting to order at 3:00 p.m. at City Hall. To provide continuity for research, items are in agenda order although not necessarily discussed in that order. Acting Chair Franke Huffman outlined the procedures and stated any aggrieved party may appeal a final administrative order of the Municipal Code Enforcement Board to the Circuit Court of Pinellas County within thirty (30) days of the execution of the order. Florida Statue 286.0105 requires any party appealing a decision of this Board to have a record of the proceedings. 1. PUBLIC HEARINGS A. Case 26-00 Janusz & Roxana Nowicki 2040 Gulf to Bay Blvd. (landscape) – Kurleman In a memo dated June, 22, 2000, Inspector Kurleman withdrew Case 26-00 as the site in now in compliance. B. Case 27-00 Chitranee-A Inc. 1101 Drew Street (landscape/tree) – Kurleman In a memo dated June, 8, 2000, Inspector Kurleman withdrew Case 27-00 as the site is now in compliance. C. Case 28-00 KVB Corp. 2275 Gulf to Bay Blvd. (landscape) – Kurleman In a memo dated June 26, 2000, Inspector Kurleman asked that Case 28-00 be continued to the next meeting. Member Cole moved to continue Case 28-00 to the next meeting. The motion was duly seconded and carried unanimously. 2. UNFINISHED BUSINESS A. Case 20-99 - Affidavit of Compliance Discount Auto Parts, Inc. 1600 N. Myrtle Avenue (landscape) - Kurleman B. Case 25-00 - Affidavit of Compliance Billy J. & Betty J. Bray 1008 Beachwood Avenue (housing) - Wright Member Martin moved to accept the Affidavits of Compliance for Cases 20-99 and 25-00. The motion was duly seconded and carried unanimously. 3. OTHER BOARD ACTION/DISCUSSION A. Case 19-98 - Addressing Board re fine Vasilios & Dimitrios Vassos 111 S. Orion Avenue (building) - Scott Vasilios Vassos, property owner, stated he had a fire on Tuesday and had recently experienced other difficulties. He stated he had obtained a permit on June 16, 1999, as required. Inspector Robert Scott said Mr. Vassos has been cooperative. Although he had obtained a permit in June of 1999, he had neglected to get appropriate inspections. Mr. Vassos indicated he was working several jobs and it was difficult to be available for scheduled inspections. In response to a question, Inspector Scott said as of March 8, 2000, all final inspections have been completed. Member Cole moved to reduce the fine for Case 19-98 from $26,450 to $1,500, payable to the City of Clearwater within 60 days of the date of the Order. The motion was duly seconded and carried unanimously. 4. NEW BUSINESS Jeff Kronschnabl invited the Board to ride along with Planning and Development Services staff and City inspectors to view the code enforcement process. He said the process is continuously being improved. 5. NUISANCE ABATEMENT LIEN FILINGS - None. 6. APPROVAL OF MINUTES - 4/26/00 & 5/24/00 Member Allbritton moved to approve the minutes of the regular meetings of April 26, 2000, and May 24, 2000, as submitted in written summation to each Board member. The motion was duly seconded and carried unanimously. 7. ADJOURNMENT The meeting adjourned at 3:20 p.m.
