06/26/1996MUNICIPAL CODE ENFORCEMENT BOARD CITY OF CLEARWATER June 26, 1996 Present: Stephen Swanberg, Chairman Dennis Henegar, Member Helen Kerwin, Member Carl Rayborn, Member Peg Rogers, Member Leslie Dougall-Sides, Assistant City Attorney Andy Salzman, Attorney for the Board Mary K. Diana, Secretary for the Board Anne Green, Staff Assistant III Absent: Louise Riley, Vice-Chairman Faustino Dolores, Member The meeting was called to order by the Chairman at 3:00 p.m. in the Commission Chambers at City Hall. He outlined the procedures and advised any aggrieved party may appeal a final administrative order of the Municipal Code Enforcement Board to the Circuit Court of Pinellas County. Any such appeal must be filed within thirty (30) days of the execution of the order to be appealed. He noted that Florida Statute 286.0105 requires any party appealing a decision of this Board to have a record of the proceedings to support such an appeal. 1. PUBLIC HEARINGS A. Case 23-96 (Cont’d from 4/24, 5/22) Robert H. Lickert Vacant Lot - 801 N. Myrtle Avenue (Land Development Code) In a memo dated 6/26/96, Vicki Niemiller, City Inspector, withdrew Case 23-96 as the property is now in compliance. B. Case 25-96 (Cont’d from 4/24, 5/22) Gilbert G. Jannelli 1930 Drew Street (Land Development Code) The City Attorney requested that Case 25-96 be continued as it has been referred to the Engineering Department for further review. Concern was expressed this case has been continued twice previously. Ms. Dougall-Sides indicated the City Engineer can approve parking on grass lots in certain situations. The Central Permitting Department believes some additional approvals may be required. A meeting will be scheduled with all parties concerned. Member Henegar moved to continue Case 25-96 to the meeting of July 24, 1996. The motion was duly seconded and carried unanimously. C. Case 26-96 Samuel J. Castro 601 N. Fort Harrison Avenue (Land Development Code/Environmental) Tom Pearson, attorney retained by the alleged violator, requested a continuance. He indicated Mr. Castro is willing to work to correct the landscape problem but is currently out of town. Discussion ensued and questions were raised regarding this case and the Board Attorney reminded the Board they were getting into the facts of the case and a request had been made for a continuance. Member Henegar moved to continue Case 26-96 to the meeting of July 24, 1996. The motion was duly seconded and carried unanimously. 2. OTHER BOARD ACTION/DISCUSSION A. Request to Reduce Fine Case 19-94 Roy Cadwell 1910 Overbrook Avenue The Board Secretary advised the Board that Mr. Cadwell was out of the country until October and had requested that his request to reduce fine be continued until the October meeting. Member Henegar moved to continue Case 19-94 to October 1996. The motion was duly seconded and carried unanimously. B. Affidavit of Non-Compliance Case 19-96 M. Lenore Holcombe, Property Owner Patrick Media, Lessee (Land Development Code) C. Affidavit of Non-Compliance Case 20-96 Cengiz Gokcen, Property Owner Patrick Media, Lessee (Land Development Code) D. Affidavit of Non-Compliance Case 21-96 William & Mary Moran, Property Owner Patrick Media, Lessee (Land Development Code) Member Kerwin moved to accept the Affidavits of Non-Compliance for Case 19-96, Case 20-96 and Case 21-96 and issue the orders imposing the fines. The motion was duly seconded and carried unanimously. E. Affidavit of Compliance Case 11-95 Antonio Markopoulos 100 Coronado Avenue (Life Safety Code) Member Kerwin moved to accept the Affidavit of Compliance for Case 11-95. The motion was duly seconded and carried unanimously. F. Request to address the Board METCO Development Corp., R/A - Robert J. Metz Case 55-92 1822 Drew Street and Case 57-92 1810 - 1820 Drew Street (Building Code) Member Rogers moved to approve the Request to Address the Board regarding Case 55-92 and Case 57-92. The motion was duly seconded and carried unanimously. G. Request to Address the Board Yvonne Irle Robert E. Hughes, Trustee - Case 65-92 1312 North Garden Avenue and Robert E. Hughes, Trustee - Case 66-92 1310A & B North. Garden Avenue (Standard Housing Code) Member Rogers moved to approve the Request to Address the Board regarding Case 65-92 and Case 66-92. The motion was duly seconded and carried unanimously. 3. APPROVAL OF MINUTES - May 22, 1996. Member Kerwin moved to approve the minutes as corrected. The motion was duly seconded and carried unanimously. 4.
