In order to provide continuity for research, the items will be listed in agenda order although not necessarily discussed in that order.
The meeting was called to order by the Chairman at 3:00 p.m. in the Commission Meeting Room in City Hall. He outlined the procedures and advised any aggrieved party may appeal a final
administrative order of the Municipal Code Enforcement Board to the Circuit Court of Pinellas County. Any such appeal must be filed within thirty (30) days of the execution of the order
to be appealed. He noted that Florida Statute 286.0105 requires any party appealing a decision of this Board to have a record of the proceedings to support such an appeal.
Case 01-95

In a memo dated January 10, 1995, Code Inspector Rick Rosa requested a continuance of Case 01-95. He stated the owner has shown intent to comply and is being given additional time to
initiate the permit process.
Member Riley moved to continue Case 01-95 to the meeting of January 25, 1995. The motion was duly seconded and, upon the vote being taken, carried unanimously.
Case 02-95

In a letter dated January 4, 1995, Code Inspector Rick Rosa withdrew Case 02-95, stating the subject property is being considered for rezoning.
Case 03-95

No representative was present.
Code Inspector Janice King gave the background of the case, stating the violation is for vehicle parking on an unpaved area. The ownership was verified through the Pinellas County Property
Appraiser records. The owner was notified via regular and certified mail. The certified mail receipt was not returned. Ms. King listed the dates of violation and notification, stating
the original complaint was received March 17, 1994 and a courtesy letter sent to the owners on March 22 was returned unclaimed. Another complaint was received August 19, 1994. A vehicle
was observed parked on the grass on September 13, 1994 and the Notice of Violation was sent with a compliance date of September 26, 1994. Another complaint was received on November
18, 1994; however, no violations were observed at that time. In response to a call from the complainant on December 1, 1994, the violation was photographed and a hearing before the
Board requested. Photographs of subsequent violations were taken on December 6 and December 30, 1994.
It was noted the green certified mail receipt for the Notice of Hearing was not returned. Ms. King stated the Notice of Hearing on the property was posted today.
City Exhibit A, photographs of vehicles parked on unpaved areas of the subject property on December 1, 6, and 30, 1994, and of the posting were submitted for the record.
Discussion ensued regarding the certified letters to the property owner returning unclaimed. Members Riley and Henegar noted he does not live at the violation address as listed on the
affidavit of violation. They contend Mr. Natsis lives on Clearwater Beach and recalled a recent case which listed a Poinsettia Avenue mailing address. Attorney Salzman suggested continuing
this case to ensure proper notice is served by ensuring the mailing address is correct and the property is posted a couple of days in advance of the hearing.
Member Riley moved to continue Case 03-95 to the meeting of January 25, 1995 and for notification to be sent to the Poinsettia Avenue address. The motion was duly seconded and carried
unanimously.

In correspondence dated January 11, 1995, Lt. Kronschnabl stated Cases 04-95 and 0595 would be handled by a new inspector and requested a continuance to the meeting of January 25, 1995.
Member Riley moved to continue Cases 04-95 and 05-95 to the meeting of January 25, 1995. The motion was duly seconded and carried unanimously.

MINUTES
Member Riley moved to accept the minutes of December 14, 1994, in accordance with copies submitted to each board member in writing. The motion was duly seconded and carried unanimously.
