A RESOLUTION OF THE CITY OF CLEARWATER, FLORIDA,
AUTHORIZIt�G THE CITY MANAGER TO REQUEST THAT
THE FLORIDA DEPARTMENT OF TRANSPORTATION EfVTER
INTO A LEASE AGREEMENT WITH THE C17Y OF CERTAIN
DEPARTMEfVT OWPdED LANDS 1'O BE UTILIZED AS A
WELCOME CENTER FACILITY.
WHEREAS, the City of Clearwater, Florida ("City"), desires to maintain a
welcome center to service the needs of highway travelers and to make travelers
aware of the attractions offered by and existing in Clearwater; and,
WHEREAS, the Florida Department of Transportation ("FDOT") has offered to
make a certain parcel of real property as legally described in EXHIBIT "A" (Legal
aescription) attached hereto, available to the City of Clearwafier, at no cost, for
use as a we{come center, provided the City requests a leas� from fhe FDOT and
the following conditions are met:
1. �'he Lessee must be the City, but the Greater Clearwater Chamber of
Cnmmerce will be permitted to operate the site under a pass-through
sublease agreement with the City v�ith terms and conditions identical
to the City's primary lease with the FDOT.
2. �ecaus� of the Gapital investment and because of the public purpose
of the proposed use, the term of the lease may be for five (5) years af
no consid�ration; and,
3. ihe lease musf contain a proper indemnificafion clause; and
WHER�AS, t(ie FDOT has previously reviewed a�ite location plan submitted by
the Greater Clearvvater �hamber of Commerce ("Chamber"), and has approved
the existing site improvements developed by the Chamber as beinc� compatible
with fhe land use concept for which the land was acquired by the FDOT;
NOW, TNEREFORE, BE Il' RESOLVED BY THE CITIf COMMISSION
OF TNE CITY OF CLEARWAT�R, F'LQRIDA:
�ectian 1. The City Commission hereby authorize� the City Manager
to provide written notice to the Florida Department of Transportation of the City
Commission's desire to enter inta a five (5) year lease with fihe FDOT of rea!
property as legally described in EXHIBIi UA" atfached hereto, and subj�ct �o the
conditions enumerated in the preamble to this r�solution, and other such terms
and conditions as may be negotiated between the parties prior to final execution.
