A RESOLUTION OF THE CITY OF CLEARWATER, FLORIDA,
RUTHORIZING TRAP�SMIITAL TO APPROPRIATE AGENCIES
OF A PROPOSED ORDIPVANCE AMENDING TH� GCIALS,
OBJ�CTIVES, AND POLICIES O� THE COMiPREHENSIVE
PLAN'S FUTURE LAN[7 USE ELEMElVi AS REQUIRED BY
FLORIDA STATUT� 163, AND ESTABLISHING AN
ALTERPdATIVE REVIEW PROCESS FOR THE COORDINATION
AND SITING G� PUBLIC SCFSO4L FACILITES; PROVIDING AN
EFFECTIVE DATE.
VIIHEREA�, the 1995 State Legislature passed CS/HB 1797 entitled the
School Faciliiy Siting Act which amended Florida Statutes 235, 255, and 163;

!lV9�EREAS, the goals, objectives, and policie� identifying the land use
categories in �vhich public schools shaU b� an ailowabie use is �xempt firom the
lienitation on frequency of plan amendments contained in FS 163.3187; and
WhiEREAS, the attached proposed ordinance permits Public School
Facolities as an allowable use within the Residential Estate, Residential
Suburban, Residentiai Low, Residential Urban, Residential Low Medium,
Residential Medi�am, Residential High, Residenfial/Office Limited,
Residential/Office General, anci lnstitutional land use categories §ubject to the
propos�d policies wrhich confain the criteria by which Clearvvater will determino
whether a proposed public educaiion facility �ite or expansion of an exisfing site
is consistent with the Comprehensive Plan; �nd
WHEREAS, an alternative review process has also be�n identified for
review+ing the suit�bility of each proposed public school site to be considered for
appraval by Clearvuater and the Pinellas County �chool Board; now, therefore,
BE IT RESOLVED �Y THE CITY COMfV1fSSiON OF ThOE CITY OF
CLEARWATER, FLORIDA:
Section 1. The City of Clearwater authorizes transmittai io appropriate
agencies of the initial actioro on approving amendmer.ts to th� Clearniater
Comprehensive Plan Future Land Use Element.
Section 2. That staff be directed to submit this Resolutian, the proposed
ordinance, and related staff report on amending the Comprehensive Plan to th�
Department of Community Affairs, Tampa Bay Regional Planning Cauncil and
other appropriate reviewing authorities for such further action as may be deemed
appropriate.
Section 3. This Resolution is effective immediately upon adoption.
