VVHEREAS, the City has completed the installation of a natural gas mainline
under the Pithlachascotee River ; and
WHEREAS, the State desires that a Sovereign Submerged Lands use Agreement
be executed for the natural gas main that will be installed under the Pithlachascotee
River; now, therefore,
BE IT RESOLVED BX THE CITY COMMISSION OF THE
CITY OF CLEARWATER, FLORIDA:
cf T'he Sovereign'Submerged Lands Use Agreement, a copy of which is
attached hereto as Exhibit A, is hereby approved, and the Iv�ayor of the City of Clearwater
is authorized to execute said agreement on behalf of the City.

the aubject rule.
3. Whenevar it ehould become neceaeary or desirable �for the Florida
Departmcent of Tranepoitation or auch local governmental entiLy having
maintenance reeponeibility, to repair�tionrofetherGrantee`smstructureo�asa)ce
.alterations or relocate all or any po
determined by the Florida Department of Tranaportation or the loeal
governmental entity, any�or all facili.bies and rulated structures authorixed
hereunder ehall ba immediately removed, reset or relocated ae required�by the
Florida Department of Transportation or the local governmental antity and at

4. The righte hereby granted shall be aubject to any and all prior
righte of the Vnited Statas and any and all prior granta by the Grantoe tn and

an indemnity or a waiver of �soveteign immunity enjoyed by any p Y

any other law providing limitatione on claima.
11. Granbee waivee venue as to any litigation arteing from mattere
relating to�thie Aqreement and any euch litigation between Grantor and Grantee
shall be initiated and maintained only in Leon County, Florida.

without prior written coneent of the Grantor� or ite duly authorized agent.
