A RESOLUTION OF THE CITY OF CLEARWATER, FLORIDA,
DEDICATING A 30 FOOT DRAINAGE EASEMENT ACROSS A
CITY -OWNED PARCEL OF PROPERTY ON SAND KEY, FROM
THE EASTERLY RIGHT OF WAY OF GULF BOULEVARD TO
THE WATERS OF CLEARWATER HARBOR; PROVIDING AN
01 EFFECTIVE DATE.
WHEREAS, it is necessary and for a proper public purpose to
dedicate a portion of City -owned property, described herein, as a
drainage easement in order for Pinellas County to implement drainage
improvements related to the widening of Gulf Boulevard;
now, therefore,
BE T -T RESOLVED BY THE CITY COMMISSION OF THE
CITY OF CLEARWATER, FLORIDA:
Section 1. The following property is hereby dedicated as a
drainage easement for use by the general public, Pinellas County and the
City of Clearwater as their interests may appear:
See Exhibit A
Section 2. The City Manager is authorized to execute on behalf of
the City of Clearwater the easement agreement in the form attached as
Exhibit B to facilitate drainage improvements for the Gulf Boulevard
widening.
`Section 3. The City Clerk is hereby directed to record this
resolution in the public records of Pinellas County, Florida.
Section 4. This resolution shall take effect immediately upon
adoption.

This easement is for drainage installation and maintenance.

PINELLAS COUNTY, FLORIDA, shall have the right to enter upon the above -
described premises and to construct, install and maintain thereon any
drainage facilities and to inspect and alter such drainage facilities from
time to time.
THE EASEMENT, rights and privileges herein granted shall be used only
for the purpose of drainage installation and maintenance as hereinafter
provided:
1. The easement granted herein shall not interfere with or otherwise
obstruct the Grantor's right to use the real property for public parking,
tennis courts, sidewalks, benches, landscaping or other lawful purposes.
Grantor intends to utilize the surface for an at -grade parking lot, and
agrees not to construct permanent structures that would interfere with
Grantee's use of its facilities, other than pavement and such incidental
structures as are necessary or useful for any of the aforementioned purposes.
2. The Grantee shall bear all costs incident to the installation,
maintenance and repair of drainage facilities as grantee may construct within
the easement granted herein. The drainage facilities shall be installed
underground, and shall be designed and constructed to withstand motor
vehicular traffic and parking over and upon the surface of the property
described herein.
3. At all times during the term of this easement, the Grantee shall
maintain all of its structures, improvements, facilities, pipes and related
equipment located, installed or constructed within the easement area in a
safe and serviceable condition.
4. The Grantee shall be responsible to repair and restore the premises
after the installation of drainage facilities, or any future repair or
maintenance thereof, so that the premises are restored to their prior
condition, including but not limited to any repaving or restoration of the
parking area, pavement, landscaping, signage, or any other improvements
Grantor may reasonably construct within -the easement area granted herein.
The Grantee hereby acknowledges and agrees that any such improvements shall
not constitute encroachments, and that Grantee shall not seek to obtain any
judicial order requiring the removal of such improvements from the easement
on the grounds that the improvements constitute an encroachment.
5. This grant of easement shall run with the land and shall be binding
on and shall inure to the benefit of the parties, their successors and /or
assigns; provided, however, that the easement granted hereunder, shall
terminate when, or at such time as, the purposes hereof cease to exist, are
abandoned by Grantee, or become impossible of performance.
6. Any financial obligations on the part of the Grantee are subject to
specific authorization by the Pinellas County Board of County Commissioners.
