A RESOLUTION OF THE CITY OF CLEARWATER,
FLORIDA, ASSESSING CERTAIN REAL PROPERTY
LOCATED IN IRA E. NICHOLSON'S SUBDIVISION,
HAVING A POST OFFICE ADDRESS OF 803 RAILROAD
AVENUE, CLEARWATER, FLORIDA, AS DESCRIBED MORE
PARTICULARLY HEREIN, IN THE AMOUNT OF
$2,000.00 FOR THE COSTS OF DEMOLITION INCURRED
IN REMOVING A DANGEROUS STRUCTURE, WITH THE
CONSENT OF OWNER.
WHEREAS, pursuant to Chapter 47 of the Clearwater Code of
Ordinances and the Standard Building Code, the Building Official
determined that certain real property described herein and the
buildings situated thereon were unsafe, unsanitary, unfit for human
habitation, and dangerous and detrimental to the health, safety,
and general welfare of the community, and did not properly comply
with the requirements of said Code, and found that an emergency
existed which, in his opinion, involved imminent danger to human
life and health, and ordered the demolition of the building; and
WHEREAS, the owners of the property signed a Waiver of Notice
and Hearing, requesting the City of Clearwater to demolish such
structure and for the City of Clearwater to file a lien against the
property for the cost of demolition; and
WHEREAS, the City of Clearwater has caused the demolition of
the building, and the cost of such work should now be assessed as
a lien on behalf of the City of Clearwater against the property;
now, therefore,
BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF CLEARWATER, FLORIDA:
Section 1. The Building Official having ordered the
demolition q-E the building situated on the following described
property:
Lot 14, Block 1, Ira E. Nicholson's Subdivision
#09/29/15/60102 /001/0140
as recorded in Book 5816, Page 1864
Public Records of Pinellas County, Florida
Owners of record: David LeGault and ,lames P. Knight
439 Bluffview Drive
Belleair Bluffs, Florida 34640
and the City of Clearwater having now completed said work, the City
Commission does hereby assess and charge a lien on behalf of the
City of Clearwater against the property for the necessary costs
incurred as follows:
Demolition Cost $2,000.00

Section 2. As soon as practicable, a Certificate of
Indebtedness against the property for the amount of assessment
shall be prepared, which certificate shall constitute a lien prior
to all other liens except the lien for taxes. Said certificate,
when issued, shall be payable to the City in not exceeding ten (10)
equal annual installments with interest at a rate not greater than
eight percent (8%) per annum.
Section 3. The City Clerk is hereby directed to prepare a
Notice of Lien in the amount of the assessment against said
property, and to record the same in the Public Records of Pinellas
County, Florida.
Section 4. This resolution shall take effect immediately upon
adoption
