A RESOLUTION OF THE CITY OF CLEARWATER,
FLORIDA, DEDICATING A CONSERVATION EASEMENT
ACROSS CITY -OWNED PROPERTY, CURRENTLY LEASED
TO CHI CHI RODRIGUEZ YOUTH FOUNDATION, INC.,
LOCATED IN SECTIONS 20 AND 21, TOWNSHIP 28
SOUTH, RANGE 16 EAST, PINELLAS COUNTY,
FLORIDA; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Clearwater owns the property described
herein, which property was leased to Chi Chi Rodriguez Youth
Foundation, Inc., for the construction of the McMullen -Booth Golf
Center golf course facilities; and
WHEREAS, as a condition of approval of the golf course
facilities, the Florida Department of Environmental Regulations
(FDER) requested that a conservation easement be dedicated and
recorded over all associated wetlands; and
WHEREAS, in response to this request, the City adopted
Ordinance No. 4812 -89 establishing an Aquatic Land /Interior zone
on the property; and
WHEREAS, the FDER has requested that a conservation easement
be dedicated and recorded over all the wetlands as an additional
action to meet the permit requirements; now therefore,
BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF CLEARWATER, FLORIDA
Section 1. The property described in Attachment A to this
resolution is hereby dedicated as a conservation easement for the
use and benefit of the Florida Department of Environmental
Regulation and the City of Clearwater. The terms and conditions
of the conservation easement shall be as set forth in Attachment
B to this resolution.
Section 2. The City Clerk is hereby directed to record this
resolution in the public records of Pinellas County, Florida. .
Section 3. This resolution shall take effect immediately upon
adoption.

TERMS AND CONDITIONS OF CONSERVATION EASEMENT
The City of Clearwater, as owner of the property described in
Attachment "A" (the "Property "), on behalf of itself and its
successors, heirs and assigns dedicates a conservation easement,
pursuant to Section 704.06 Florida Statutes, over the Property for
the use and benefit of the Florida Department of Environmental he
Regulation ( "FDER") and the City of Clearwater (the "City ") for
purpose of retaining land or water areas predominately in their
natural, scenic, open or wooded conditions; retaining such areas
as a suitable habitat for fish, plants, or wildlife; or maintaining
existing land uses.
The following acts and activities are expressly prohibited
within the boundaries of the Property, except as provided herein:
(a) Construction or placement of buildings and structures,
including but not limited to roads, signs and other advertising
structures, on or above the ground;
(b) Construction, placement or maintenance of utilities on,
below, or above the ground without appropriate local, state and
federal permits or other authorization, and, in the case of
construction or placement of utilities on or above the ground, the
consent of any lessee having a right of possession;
(c) Dumping or placement of soil or other substances or
material as landfill, or dumping or placement of trash, waste or
unsightly or offensive materials;
(d) Removal or destruction of trees, shrubs, or other
c vegetation; provided that the City or any lessee having right of

water areas to remain in their natural condition;
(g) Activities detrimental to drainage, flood control, water
conservation, erosion control, soil conservation or fish and
wildlife habitat preservation; and

(h) Acts or uses detrimental to retention of land or water
areas.
A dead tree will be deemed to pose a safety hazard where such
dead tree, subject to natural or expected conditions, could be
expected to fall outside the limits of the Property and onto public
access areas immediately outside of the Property and cause bodily
injury or property damage. Written notice of the removal of any
dead tree shall be delivered to FDER by the City or lessee removing
the tree contemporaneous with such removal.
The City acknowledges that this Conservation Easement shall
serve as a limitation and restriction upon construction, placement
and maintenance of public utilities on, below, or above the ground
within those easements set forth in Attachment "C ".
