05/12/1993 MUNICIPAL CODE ENFORCEMENT BOARD May 12, 1993 Members present: William Murray, Chairman D. Wayne Wyatt, Vice-Chairman Stephen D. Swanberg Louise C. Riley E.J. Robinson Peg Rogers Absent: 7th Seat Vacant Also present: Andy Salzman, Attorney for the Board Cynthia E. Goudeau, Secretary for the Board In order to provide continuity for research, the items will be listed in agenda order although not necessarily discussed in that order. The meeting was called to order by the Chairman at 3:00 p.m. in the Commission Meeting Room in City Hall. He outlined the procedures and advised any aggrieved party may appeal a final administrative order of the Municipal Code Enforcement Board to the Circuit Court of Pinellas County. Any such appeal must be filed within thirty (30) days of the execution of the order to be appealed. He noted that Florida Statute 286.0105 requires any party appealing a decision of this Board to have a record of the proceedings to support such an appeal. PUBLIC HEARINGS Case No. 25-93 Orville/Shirley Tucker 2970 Gulf to Bay Boulevard (Land Development Code) Complied prior; request to withdraw Case No. 26-93 Equator Inc. 2516 Gulf to Bay Boulevard (Land Development Code) Complied prior; request to withdraw Case No. 27-93 Jack A. Bocook/William J. Hunter Greenwood Avenue South (Land Development Code) Complied prior; request to withdraw Case No. 29-93 William & Hope Georgilas/John Menihtas 1849 Gulf to Bay Boulevard (Land Development Code) Complied prior; request to withdraw Member Riley moved to withdraw Case Nos. 25-93, 26-93, 27-93 and 29-93 as compliance has been obtained. The motion was duly seconded and carried unanimously. UNFINISHED BUSINESS Case No. 3-93 Frank McKinley/Joel Kehrer 206 South Greenwood Avenue Affidavit of Non-Compliance The Secretary to the Board read a letter to the Board from Mr. McKinley dated April 12, 1993 regarding circumstances brought about by the March storm which delayed their ability to comply with the Board's order to dismantle the auto parts storage racks on the property. Consensus of the Board was they be updated regarding compliance status. Member Swanberg moved to continue receipt of the Affidavit of Non-Compliance to the next meeting. The motion was duly seconded and carried unanimously. OTHER BOARD ACTION/DISCUSSION Case No. 4-92 David Gangelhoff d/b/a Gulf Marine 405 North Fort Harrison Avenue Staff request re foreclosure Status re compliance Continued from 4/14/93 The Secretary stated staff has requested that foreclosure proceedings be initiated in this case. At the April 14, 1993, the Assistant City Attorney stated he found there are several large, superior liens on the property. The Inspector stated the violator is moving forward to come into compliance. The Board continued the case for another update. In response to a question regarding the current status, Geri Doherty, Code Enforcement Inspector, stated they are acting on all the remaining violations. She was given a verbal commitment for compliance by the end of May. They have removed a lot of the boats; some of the junk boats still remain. The Inspector recommended the Board allow until May 31 before taking further action. If they do what they have committed to do, they will be in complete compliance. Consensus of the Board was that no action be taken. MINUTES - Meeting of April 14, 1993 Member Riley moved to accept the minutes of the meeting of April 14, 1993 as submitted. The motion was duly seconded and carried unanimously. ADJOURN - The meeting adjourned at 3:08 p.m.
