03/28/1990 MUNICIPAL CODE ENFORCEMENT BOARD March 28, 1990 Members present: William Murray, Chairman Bruce Cardinal, Vice-Chairman William Zinzow D. Wayne Wyatt Absent: James Angelis (excused) John McKinney (excused) Robert Aude (unexcused) Also present: Rob Surette, Assistant City Attorney Alan Zimmet, Attorney for the Board Cynthia E. Goudeau, Secretary for the Board In order to provide continuity for research, the items will be listed in agenda order although not necessarily discussed in that order. The meeting was called to order by the Chairman at 3:00 p.m. in the Commission Meeting Room in City Hall. He outlined the procedures and advised any aggrieved party may appeal a final administrative order of the Municipal Code Enforcement Board to the Circuit Court of Pinellas County. Any such appeal must be filed within thirty (30) days of the execution of the order to be appealed. He noted that Florida Statute 286.0105 requires any party appealing a decision of this Board to have a record of the proceedings to support such an appeal. PUBLIC HEARINGS Public Nuisance Clearing List - No cases. Case No. 15-90 Raka Concepts Inc. 611 Druid Rd. E., #302 (Occupational License) Continued from 3/14/90 The Secretary stated the Inspector's submitted a request to withdraw this case. Case No. 17-90 Augustine Loprinzi (d/b/a Augustino Guitar) 1929 Drew St. (Occupational License) Complied prior Case No. 18-90 L.D. Suttles, Jr. (d/b/a Upholstery to Go) 635 U.S. 19 N. (Occupational License) Complied prior Case No. 19-90 William Aldridge (d/b/a House of Aldridge) 1411 Betty Ln. N. (Occupational License) Complied prior Case No. 20-90 William Aldridge (d/b/a Personal Touch Cleaning Svce.) 1411 Betty Ln. N. (Occupational License) Complied prior Mr. Cardinal moved to withdraw Case Nos. 15-90, 17-90, 18-90, 19-90 and 20-90. The motion was duly seconded and carried unanimously. UNFINISHED BUSINESS Case No. 6-90 Lokey Motor Company (Development Code) 1220 US 19 S Affidavit of Compliance In response to questions, Rick Rosa, Development Code Inspector, stated the existing tents are permitted on a temporary basis which will expire about March 31st. He stated Lokey Motors was in compliance as of February 6th due to the removal of the cars from the grassy area as ordered by the Board. Lokey Motors then acquired the permitting for the tent display. Further discussion ensued regarding the fact that Lokey Motors is presently displaying vehicles on the grassy area. Mr. Rosa stated the original violation was due to the fact that they did not request permission to display the vehicles on the grass, and they are now in compliance. He stated there is a waiting period before another tent permit could be acquired. Mr. Wyatt moved to accept the Affidavit of Compliance in Case No. 6-90. The motion was duly seconded. Upon the vote being taken, Messrs. Cardinal, Murray and Wyatt voted "aye." Mr. Zinzow voted "nay." Motion carried. Mr. Zinzow expressed concern regarding "jerry-rigged" signs located at a Pawn Shop on Gulf-to-Bay Blvd. and another located on Cleveland St. He stated the signs were positioned right up to the sidewalk and he believed both businesses had been cited before. Inspector Rosa stated he would check into it. Case No. 90-2-2-1 Thelma A. Dingman Sunset Pt.Replat, Lots 26 & 27 Affidavit of Compliance Mr. Cardinal moved to accept the Affidavit of Compliance in Case No. 90-2-2-1. The motion was duly seconded and carried unanimously. MINUTES - Meeting of March 14, 1990 Mr. Zinzow moved to approve the minutes of the meeting of March 14, 1990 as submitted. The motion was duly seconded and carried unanimously. ADJOURN - 3:15 p.m.
