10/26/1988 MUNICIPAL CODE ENFORCEMENT BOARD October 26, 1988 Members present: Robert Aude, Chairman Phillip N. Elliott, Vice-Chairman James Angelis Frank Morris Bruce Cardinal William Murray Absent: Tim Amburgy (unexcused) Also present: Rob Surette, Assistant City Attorney Cynthia E. Goudeau, Secretary for the Board In order to provide continuity for research, the items will be listed in agenda order although not necessarily discussed in that order. The meeting was called to order by the Chairman at 5:05 p.m. in the Commission Meeting Room in City Hall. He outlined the procedures and advised any aggrieved party may appeal a final administrative order of the Municipal Code Enforcement Board to the Circuit Court of Pinellas County. Any such appeal must be filed within thirty (30) days of the execution of the order to be appealed. He noted that Florida Statute 286.0105 requires any party appealing a decision of this Board to have a record of the proceedings to support such an appeal. PUBLIC HEARINGS Lot Clearing List 88-10-2 The Chairman asked if anyone was present to be heard concerning Lot Clearing List 88-10-2. There was no response. The Chairman then announced the Board will hear the inspector's testimony regarding the items on List 88-10-2 to have a record of the violations. Item No. 1 Orange/Blue Construction, Inc. c/o Gary L. Hunt re: Lot 2, Blk. G, Highland Est. of Clearwater, 2nd Addn. a/k/a 1753 Pamelia Street Vernon Packer, Sanitation Inspector, stated the lot was inspected on September 22, 1988 and the owner was given legal notice to correct the violation by October 25, 1988. He further stated there is high vegetation and debris on the lot. The Sanitation Department has on file the signed certified mail return receipt as proof of notice to the violator. Mr. Packer stated the lot was reinspected the morning of the hearing and the violation still exists. Item No. 2 Daniel W./Jody M. Brown re: Lot 17, Blk. D, Pinebrook Unit 2 a/k/a 1358 Pinebrook Drive Vernon Packer, Sanitation Inspector, stated the lot was inspected on September 16, 1988, and the owner was given legal notice to correct the violation by October 25, 1988. He further stated there is high vegetation in the back yard. The Sanitation Department has on file the signed certified mail return receipt as proof of notice to the violator. The lot was reinspected the morning of the hearing and the violation still exists. Item No. 3 Norris William re: Lot 2, BLk. C, Palm Park Sub. a/k/a 903 Engman Street Vernon Packer, Sanitation Inspector, stated the lot was inspected on August 29, 1988, and the owner was given legal notice to correct the violation by October 25, 1988. He further stated there is high vegetation and debris on the entire lot. The Sanitation Department has on file the signed certified mail return receipt as proof of notice to the violator. The lot was reinspected the morning of the hearing and is still in violation. Item No. 4 Edmund/Therese Morrissey (Old Brown's Chicken Restaurant) re: Parcel # 15/29/15/00000/420/0700 a/k/a 1200 E. Druid Road Vernon Packer, Sanitation Inspector, stated the lot was inspected September 19, 1988 and the owner was given legal notice to correct the violation by October 25, 1988. He further stated there is high vegetation and debris. He stated the lot has been partially cleared, but the lot is still in violation as of the morning of the hearing. He stated the Sanitation Dept. has on file the signed certified mail return receipt as proof of notice to the violator. Item No. 5 Gerald J. Schreifels, Michael C. Diana re: M&B 44.07, Sec. 21-29-15 a/k/a 1505 S. Ft. Harrison Ave. Vernon Packer, Sanitation Inspector, stated the lot was inspected and cited on June 21, 1988, and the owner was given legal notice to correct the violation by July 26, 1988. He stated the owners asked for and were granted extensions until October 25, 1988 to allow their attorney, John Frazier, time to try to keep the property from going into Title 11 proceedings. He stated the owner did not get the property back, and the lot is still in violation. Rob Surette, Assistant City Attorney, stated that the City could no longer proceed with this case as the property is in Title 11 proceedings. He recommended to the Board the case be discontinued. The Assistant City Attorney stated we are establishing a record showing that the parties in the above stated cases did not appear for the hearing. Mr. Elliott moved to dismiss Item No. 5 of Lot Clearing List 88-10-2 based on the Assistant City Attorney's recommendation. The motion was duly seconded and carried unanimously. The meeting adjourned at 5:20 p.m.
