08/10/1988 MUNICIPAL CODE ENFORCEMENT BOARD August 10, 1988 Present: Robert Aude, Chairman Frank Morris Bruce Cardinal William Murray Tim Amburgy Absent: Phillip N. Elliott, Vice-Chairman James Angelis Also present: Rob Surette, Assistant City Attorney Shirley A. Corum, Secretary for the Board In order to provide continuity for research, the items will be listed in agenda order although not necessarily discussed in that order. The meeting was called to order by the Chairman at 1:05 p.m. in the Commission Meeting Room in City Hall. He outlined the procedures and advised any aggrieved party may appeal a final administrative order of the Municipal Code Enforcement Board to the Circuit Court of Pinellas County. Any such appeal must be filed within thirty (30) days of the execution of the order to be appealed. He noted that Florida Statute 286.0105 requires any party appealing a decision of this Board to have a record of the proceedings to support such an appeal. PUBLIC HEARINGS Lot Clearing List 88-08-1 - No action. Case No. 116-88 Henry W. Meister (Fire Code) (cont. from 7/13/88) Complied prior Case No. 118-88 Rick W. Hackbart (Occupational License) (cont. from 7/13/88) Complied prior Case No. 120-88 First Florida Business Services Inc. (Occupational License) (cont. from 7/13/88) Complied prior The Secretary to the Board requested the above listed cases be withdrawn as the violations have been corrected. Mr. Cardinal moved to withdraw Case Nos. 116, 118, and 120-88. The motion was duly seconded and carried unanimously. UNFINISHED BUSINESS Case No. 83-88 M. & E.J. Mitskevich (Quick Tan/Cash for Gold) Affidavit of Compliance Mr. Cardinal moved to accept the Affidavit of compliance. The motion was duly seconded and carried unanimously. Case No. 8-88 Joseph Simonelli Request for rehearing The Assistant City Attorney stated he spoke with Donald McFarland, attorney representing Mr. Simonelli, who stated they are now awaiting approval of the Department of Natural Resources which is needed in order for the Building Department to issue the required permits. Discussion ensued regarding the Board's policy of rehearing a case once the Board has issued an order, and the fact that Mr. Simonelli did construct the seawall prior to acquiring the necessary permits. Consensus of the Board was to address the accrued fine once compliance is reached. OTHER BOARD ACTION Fine Status Report The fine status report was reviewed. The Assistant City Attorney informed the Board several cases are being closed due to lien deficiencies. Discussion ensued regarding the status of the Jeralne Burt cases. The Assistant City Attorney stated he would come back to the Board next month with a status on these properties. NEW BUSINESS The Chairman of the Board welcomed its new member, Tim Amburgy. MINUTES Mr. Cardinal moved to approve the minutes of the meeting of July 13, 1988 as submitted. The motion was duly seconded and carried unanimously. The meeting adjourned at 1:34 p.m.
