It appears many properties throughout the neighborhood are single family residential structures that encroach into the front setbacks; therefore our requested front setback variance would be consistent with the Neighborhood Plan. 2. 300 Midway Island is a single family one story detached dwelling, a permitted use. 3. The original home on 300 Midway Isle was built in 1971 and was built within 3" to 4" off the front setback line. The existing home has no formal front entry. It is physically impossible to add a functioning front entry without a front setback variance. 4. In noway will the proposed front entry cause any negative effects to abutting properties. The proposed entry should improve adjacent property values. 5. It appears several adjacent properties are structures that encroach into the front setback, therefore our requested front setback variance should be compatible with adjacent properties. 6. The existing home at 300 Midway Island (built 1971) has no formal entry; we would like to add a 'formal entry'. This will 'upgrade' the immediate vicinity with its aesthetic and functional value. 7. The design is cohesive with the community and city; it provides safety for the homeowner, upgrades the standards of aesthetics and function of the existing home, and adds value to the neighborhood and city as a whole. 8. It is the original concept that flexible standards were created for hardship instances such as ours. A home without a formal front entry is below the standards that the city hopes for, the city allowed this home to be built back in 1971 but it is now 2009, we hopefully evolve and progress for the better as we enter the future. Due to poor decisions in the past we are now before you, asking for permission to allow us to improve this home with a front setback variance, hoping you will understand and be flexible, so the homeowners will be safer when entering their home and the city can be proud of the structures that exist in their community. That the zoning of the property is Low Medium Density Residential / Island Estates Neighborhood Conservation District (LMDR/IENCOD), which is consistent with the underlying Residential Urban (RU) Land Use Plan category; 3. That the property is currently developed with a single - family residence; 4. That the existing walkway pavers encroach into the required 25 -foot front (east) setback; 5. That the existing walkway pavers encroach into the required seven and a half foot side (north) setback; 6. That the existing pool deck pavers encroach into the required 15 -foot rear (west) setback; and 7. That there is no outstanding Code Enforcement issues associated with the subject property that would prevent approval of this application. Conclusions of Law: 1. That the development proposal is inconsistent with the applicable portions of the Island Estates Neighborhood Plan as they pertain to reductions to the required front setback for buildings; 2.
