Present: 5 - Mayor George N. Cretekos, Councilmember Doreen Hock-DiPolito,

To provide continuity for research, items are listed in agenda order although not necessarily
discussed in that order.
1. Call to Order— Mayor Cretekos
The meeting was called to order at 3:10 p.m. at City Hall.
2. Citizens to be heard re items not on the agenda — None.
3. City Attorney Reports
3.1 Accept a full and final settlement of all claims against BP and others resulting from the
Deepwater Horizon oil spill and adopt Resolution 15-18.
Outside Counsel Kevin Dean said the Motley Rice firm has been
representing the City since May 2012. The firm was retained to pursue
the City's economic losses due to the oil pollution act. The settlement
amount is not confidential but the settlement releases proposed are
confidential. In April 2013, the firm filed suit for the City when the
demand to BP was denied. The settlement proposal presented to the
City was $8,139,039, which are unrestricted funds and due to the City within
60-90 days. The attorneys fees will be approximately$1,627,807.80. Mr.
Dean said the expenses incurred with the litigation are $30,878.99, which
includes forensic accounting fees that were paid to Dixon Hughes.
In response to questions, Mr. Dean said the firm believes the City's
settlement is fair and reasonable and recommends accepting this offer.
How the City of Tampa arrived at their calculations is not known. For the
City's demand, the firm calculated losses for 2010, which included
property tax loss, projected losses for five years, and applied a 2%
growth rate. Tourism taxes and enterprise funds losses were included in

the City's calculations. The claims facility will continue to operate
through 2020.
Councilmember Hamilton moved to accept a full and final
settlement of all claims against BP and others resulting from the
Deepwater Horizon oil spill. The motion was duly seconded and
carried unanimously.
Resolution 15 -18 was presented and read by title only.
Councilmember Doreen Hock - DiPolito moved to adopt Resolution
15 -18. The motion was duly seconded and upon roll call, the vote
was:
Ayes: 5 - Mayor Cretekos, Councilmember Hock - DiPolito, Councilmember
Jonson, Councilmember Hamilton and Vice Mayor Polglaze
