AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
RELATING TO THE LAND DEVELOPMENT CODE; AMENDING
SECTIONS 35.11 AND 42.34, CODE OF ORDINANCES, TO
SPECIFY THAT DENSITY CALCULATIONS FOR NURSING
HOMES SHALL BE COMPUTED ON THE BASIS OF THREE
RESIDENTS EQUALS ONE UNIT, AND PARKING FOR NURSING
HOMES SHALL BE REQUIRED ON THE BASIS OF ONE SPACE
PER THREE PERSONS RESIDING IN THE FACILITY;
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. Section 35.11, Code of Ordinances, is amended to read:
Sec. 35.11. Definitions.
The following words, terms and phrases, when used in this development code, shall have
the meanings ascribed to them in this section, except where the context clearly indicates a
different meaning:
Nursing home means a health facility where persons are housed and furnished with meals
and continuing nursing care for compensation. For the purpose of computing density of a nursing
home, every three persons residing beds within the facility at maximum capacity shall be
seaside ed equal to one dwelling unit.
Sec. 42.34. Parking.
(6) Offstreet parking spaces.
(d) Schedule. The following shall be the minimum number of offstreet parking spaces
required for each land use, activity, building or structure permitted by this
development code. When the determination of the number of required offstreet
parking spaces results in a requirement of a fractional space, any fraction less than
one -half space shall be rounded down to the nearest whole number and any
fraction of one -half space or more shall be rounded up. Parking spaces required
on the basis of building floor area shall apply to gross floor area unless otherwise
specified. Parking spaces required for employees shall be based on the maximum
number of employees on duty or residing, or both, on the premises at any one
time, which would include any overlap of employees at a change of shift.

d. Nursing homes: One parking space per three persons residina
within the facility beds occupied at maximum capacity.
Section 2. The provisions of this ordinance are found and determined to be consistent
with the City of Clearwater Comprehensive Plan.
Section 3. This ordinance shall take effect immediately upon adoption.
