The Chair called the meeting to order at 9:00 a.m. at City Hall.
To provide continuity for research, items are in agenda order although not
necessarily discussed in that order.
2 - Approval of Minutes: August 10, 2006
Member Hamilton moved to approve the minutes of the regular meeting of August 10,
2006, as submitted in written summation to each board member. The motion was duly
seconded and carried unanimously.
3 - Employees to be Heard - None.
4 - Action Items:
a. Review and Action on Employee Requests for Regular Pensions:
1. Jana R. Fine, Library
2. Nancy K. Peckham, Public Utilities
3. John R. Lee, Fire
Member Petersen moved to approve the requests for regular pensions for Jana R. Fine,
Nancy K. Peckham, and John R. Lee. The motion was duly seconded and carried
unanimously.
b. Review and Action on Employee Requests to Vest Pensions:

1. James D. Betts, Jr., Solid Waste
James D. Betts, Jr., Solid Waste, has resigned his position after being employed by the
City for more than 18 years. He will qualify to receive his reduced pension beginning
September 1, 2010.
Member Doran moved to recommend approval of the request by James D. Betts, Jr. to
vesthis pension. The motion was duly seconded and carried unanimously.

Laurie Sullivan originally was hired May 19, 2003; status changed to full-time and pension
eligible as of August 21, 2006.
The motion was duly seconded and carried unanimously.
5 - Pendinq/New Business
a. Lula Mae Brooks - Non-job-connected Disability Hearing
Human Resources Director Joe Roseto reviewed Lula Mae Brook's application for a
non-job-connected disability and the requirements of Code. None of the listed exclusions
applies and no meaningful work is available for her to perform. He referenced the August 16,
2006, letterfrom Michael J. Pickering, M.D., which reported that Ms. Brooks is disabled.
Member Schmalzbauer moved to accept into evidence the entire file, inclusive of the
personnel file, interrogatories, medical records, and the IME (Independent Medical Exam). The
motion was duly seconded and carried unanimously.
Ms. Brooks declined to make a statement.

Mr. Roseto said evidence indicates that Ms. Brooks is permanently disabled and there is
no reasonable expectation that she could return to work. The City did not contest the request.
Member Hamilton moved that Lula Mae Brooks is disabled due to a non-job-connected
sickness or injury, such disability is likely to be continuous and permanent from a cause other
than those listed as general disability exclusions, and such disability renders the participant
unable to perform any useful, meaningful, and necessary work for the employer in an available
position for which the participant is reasonably qualified or for which the participant may be
reasonably trained to perform. The motion was duly seconded and carried unanimously.
The committee thanked Ms. Brooks for her service to the City and wished her well.
6 - Director's Report - None.
7 - Committee Members to be Heard
Member Doran wished Jana Fine well, stating "Clearwater, baseball, jazz, beaches, and
so much more."
Member Schmalzbauer wished John Lee well and thanked him for his many years of
service to the PAC (Pension Advisory Committee). Mr. Roseto said recognition would be
provided.

The meeting adjourned at 9:10 a.m.
