The Chair called the meeting to order at 9:00 a.m. at City Hall.
To provide continuity for research, items are in agenda order although not
necessarily discussed in' that order.
2 - Approval of Minutes
Member Hightower moved to approve the minutes of the regular meeting of January 13,
2005, as submitted in written summation to each board member. The motion was duly
seconded and carried unanimously.
3 - Emplovees to be Heard - None.
4 - Action Items:
a) Review and Action on Employee Requests for Regular Pensions:
1) Janice D. King, Development Services
2) Lois Klein, Library
3) Sam Brown, Jr., Solid Waste
4) Terry L. O'Neill, Fire
Member Hamilton moved to approve the requests for regular pensions for Janice D.
King, Lois Klein, Sam Brown, Jr., and Terry L. O'Neill. The motion was duly seconded and
carried unanimously.
b) Review and Action on Employee Requests to Vest Pensions:
1) Mark J. Petrie, Public Service
Mark J. Petrie, Public Service, has resigned his position after being employed by the City
for more than 13 years. He will qualify to receive his reduced pension beginning December 1,
2006.

. 2) Linda A. Burch, Police
Linda A. Burch, Police, has resigned her position after being employed by the City for
more than 10 years. She will qualify to receive her reduced pension beginning February 1,
2015.

Member Hightower moved to approve the requests to vest pensions for Mark J. Petrie
and Linda A. Burch. The motion was duly seconded and carried unanimously.
c) Approval of New Hires as Pian Members:
As of January 26, 2005, the City had 1797.14 of 1895.4 budgeted positions. Andrea
Wells originally was hired as part-time on September 30, 2002; changed to full-time and pension
eligible as of December 25, 2004. "

5 - Pendina/New Business
a) Cherie LePrevost - JCD Hearing
Pension Advisory Committee Attorney Stuart Kaufman reviewed the results of Cherie
LePrevost's IME (Independent Medical Exam), which indicated her disability is total and
permanent related to her ability to work as a paramedic and firefighter. The City has no
permanent light duty positions for public safety employees. No Pension Plan exclusions apply.
Member Jensen moved to enter the entire Pension Advisory Committee file into
evidence. The motion was duly seconded and carried unanimously.
Donald Anderson, representative for the applicant, offered a technical objection to
document 72, related to firefighter duties. Human Resources Director Joe Roseto said the
document is part of the IME report and is not from the City or Mr. Kaufman. While the IME
report indicates Ms. LeProvost could perform light duty, there never was an expectation the City
would provide a permanent light duty position. Mr. Kaufman recommended the document .
remain in evidence.
Consensus was to overrule the objection.
In response to a request, Mr. Kaufman said the City does not dispute that Ms.
LePrevost's disability is permanent and the result of physical, not psychological, issues.
Member Jensen moved that Cherie LePrevost's disability is the result of an in-service
injury. The motion was duly seconded and carried unanimously.
Member Jensen moved that Cherie LePrevost's disability is permanent in nature. The
motion was duly seconded and carried unanimously.
Member Jensen moved that Cherie LePrevost's disability is a total disability. The
motion was duly seconded and carried unanimously.
Member Jensen moved that no exclusions referenced in the Pension Plan are applicable
to Cherie LePrevost's disability. The motion was duly seconded and carried unanimously.
b) James Albright - Schedule Date for NJCD Hearing
Consensus was to schedule a disability hearing for James Albright on March 10, 2005.
c) Ronnie White (continued to date unknown)
Consensus was to schedule a disability hearing for Ronnie White for April 14, 2005.
Mr. Kaufman said Mr. White's current counsel, Donald Anderson, has agreed the two
cumulative videotapes related to this case would be sufficient.

. d) Mark Weinreich- Schedule Date for NJCD Hearing
Consensus was to schedule a disability hearing for Mark Weinreich for March 10, 2005.
6 ...;.. Director's Report
Mr. Roseto said staff is reviewing Pension Trustee/Pension Advisory Committee
recommendations made during the January 31, 2005 joint meeting and related issues. A report
on the City's perspective will be presented.
8 - Committee Members to be Heard
Member Jensen said next month he will discuss yesterday's presentation of the savings
& 1055 study.
Member Hamilton acknowledged the passing of Lois Klein, and sent condolences to
Police Chief Sid Klein.
9 - Adiournment
