03/08/2007 PENSION ADVISORY COMMITTEE MEETING MINUTES CITY OF CLEARWATER March 8, 2007 Present: Nathan Hightower Chair Tom Jensen Vice-Chair John Schmalzbauer Committee Member Carlen Petersen Committee Member/Councilmember John Doran Committee Member/Councilmember Stephen Sarnoff Committee Member J.B. Johnson Committee Member/Councilmember Also Present: Joe Roseto Human Resources Director Brenda Moses Board Reporter The Chair called the meeting to order at 9:00 a.m. at City Hall. To provide continuity for research, items are in agenda order although not necessarily discussed in that order. 2 - Approval of Minutes Member Petersen moved to approve the minutes of the regular meeting of February 8, motion 2007, as submitted in written summation to each board member. The was duly carried seconded and unanimously. 4 – Employees to be Heard – None. 5 – Action Items: a. Review and Action on Employee Requests for Regular Pensions: 1. Earthine Rayner, Solid Waste Member Petersen moved to approve the request for a regular pension for Earthine motioncarried Rayner. The was duly seconded and unanimously. b. Review and Action on Employee Requests to Vest Pensions: 1. Craig Reeves, Public Utilities 2. Fred Grunden, Public Utilities 3. Douglas Blackwell, Police Member Petersen moved to approve the requests by Craig Reeves, Fred Grunden, and motioncarried Douglas Blackwell to vest their pensions. The was duly seconded and unanimously. c. Rep. I/Customer Service 2/5/07 2/5/07 motioncarried The was duly seconded and unanimously. 5. Pending/New Business a. Vince Kirkland – Hearing for Job-connected Disability Pension AND b. Tyrone Booze – hearing for Job-connected Disability Pension Human Resources Director Joe Roseto said staff requests the hearings for Vince Kirkland and Tyrone Booze be continued. Mr. Booze’s attorney will not be ready to present her case for at least 2 months. Staff provided the PAC (Pension Advisory Committee) with a CD (Compact Disc) of pertinent information regarding that case. In Mr. Kirkland’s case, the IME (Independent Medical Examination) physician was emphatic in his recommendation, however there was a Worker’s Compensation perspective that showed some limitations. Staff had asked the Worker’s Compensation staff to schedule Mr. Kirkland for a functional capacity test, which was received a few days ago, and was provided to the PAC today. The results of that test have been forwarded to the Worker’s Compensation doctor for his final diagnosis. Mr. Roseto said the City has several positions that might accommodate Mr. Kirkland and also feels that he can return to his previous position. He said he has not discussed the matter with Mr. Kirkland’s attorney. He requested the PAC reschedule Mr. Kirkland’s disability hearing to April 12, 2007. Member Petersen moved to continue Vince Kirkland’s hearing for a job-connected motioncarried disability pension to April 12, 2007. The was duly seconded and unanimously. In response to a question, Mr. Roseto said that Mr. Kirkland is not currently receiving any compensation. 6. Director’s Reports Mr. Roseto reported that Members Jensen and Schmalzbauer’s terms expire the end of June 2007. The City will begin the election process for those two seats. 7. Committee Members to be Heard Pension Advisory 2007-03-08 2 . Chair Hiahtower inquired as to the status of the pension ordinance rewrite. Mr. Roseto reported that he expects the draft of the ordinance rewrite within the next two months, after which time it will be reviewed by the PAC's attorney, and be brought to the PAC. Committee Member Johnson reported this was his last PAC meeting. He wished the PAC well. Committee Members thanked Committee Member Johnson forhis service and wished him well. 8.
