WHEREAS, Prospect Park Development, LLC, (Owner) owner of real property adjoining the portion of right -of -way described herein and depicted in Exhibit "A" attached hereto, has requested that the City vacate said right -of -way; and WHEREAS, the Owner is planning to submit a plat for approval by the City of Clearwater over a tract of land that includes the herein described property; and WHEREAS, the City Council finds that said right -of -way is not necessary for public use, thus should be vacated, as these actions are in the best interest of the City and the general public; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLEARWATER, FLORIDA: Section 1. This vacation ordinance shall be null and void if this condition is not met within One Hundred Eighty (180) calendar days from the adoption of this ordinance. Section 2. The City Clerk shall record this ordinance in the Public Records of Pinellas County, Florida, following adoption. Section 3. This ordinance shall take effect immediately upon adoption.
