Dear Sirs:
The City of Clearwater recently advised you of the receipt of an application for voluntary
annexation for property located at 3030 Union Street (ANX2013-4008). This property is
comprised of two parcels located within the City of Clearwater Planning Area which upon
annexation into the City of Clearwater will be served by city sanitary sewer and solid waste
service. This annexation will now be processed through two unique cases (new case ANX2013-
05011), and the overall amount of land proposed for annexation is reduced.
The proposed annexation is consistent with Florida law regarding municipal annexations
pertaining to contiguousness with existing city boundaries and compact concentration. A copy of
the revised legal descriptions for the two parcels of land proposed to be annexed is enclosed.

L BACKGROUND
Section �(12) of Chapter 88-464, La�vs of Florida, as amended, requires the Council to
review and make a recommendation to the affected municipality for each annexation of
ten acres or more as to the ability of the municipality to provide municipal services to the
territory proposed to be annexed. Although this report is primarily for the purpose of
determining if the City has the ability to provide the proposed annexation area with urban
services, it is also used to identify any other issues with respect to the annexation.
The City has indicated in its submission material that it has the ability to provide
municipal services to the area proposed for annexation.
The proposed annexation area is located on the north side of Union St., to the west of

Annexation, the area consists of two parcels. The properties are designated Residential
Suburban and Water on the Countywide Plan Map. The existing uses on the properties
are a single-family home and horse stables. The area to be annexed includes 19.9 acres.
It should be noted that PPC staff has completed a cursory review of this voluntary
annexation for the purposes of tracking annexations in Pinellas County.

The Council adopted a finding that the City of Clearwater has the Ability to Provide
Municipal Services to this area based on the Ability to Serve Report and authorized this

II. FINDINGS
In accordance with the ability to serve review criteria �f PPC Resolution No. 98-2, and
based upon the accompanying data and analysis, staff submits the following findings for
consideration:
A. The subject area is located within an established planning area pursuant to
Chapter 163, F.S. The City of Clearwater and Pinellas County have an interlocal
planning area agreement through September 30, 2020.

C. The City of Clearwater has the ability to provide sanitary sewer service, solid
waste pick up and disposal, law enforcement, fire and Emergency Medical
�ervices (�ivi�), ancl recreation anci iibrary services through city departinents,
county services, or private contractors.
D. The existing service district boundaries for the items noted above will not
change. It should be noted that the law enforcement seivice provider will change
from the Pinellas County Sheriff to the Clearwater Police Department.
III. REVIEW COMMENTS
A. Consistency with Chapter 171, F.S.: The area is contiguous to inunicipal
boundaries on its northern and western borders (i.e., a substantial part of a
boundary of the territory sought to be annexed is contiguous (Section
171.031(11), F.S.)), the area is reasonably compact (Section 171.031(i2), F.S.),
and no enclaves will be created (Section 171.031(13), F.S.). While this is not
part of the review criteria of PPC Resolution No. 98-2, staff finds the proposed
annexation complies with the above provisions.
B. Water: The area proposed for annexation is within the area served by the City
vi �iZaiw'a�2i p%riavi2 WatZT' systz���. The su�j�ct properties ai� cunenily ri�ii
connected to thP City's �otable ���ater s;�stem. V��ith :egard to �he ?evel of ser��ice
and coverage of the potable water system, water main extensions would be
required to connect these properties. Based on the existing use of the properties,
Clearwater indicates it has the capacity available in the city's water systein
should this area be connected in the future.
C. Sanitary Sewer: The proposed annexation is within the City of Clearwater
sanitary sewer service area. The subject properties are currently not connected to
the City's sewer system. With regard to the level of service and coverage of the
sewer system, sewer main extensions would be required to connect these
properties. Based on the existing use of the properties, Clearwater indicates it

has the capacity available in the city's sanitary sewer system should this area be
connected in the future.
D. Solid Waste: Currently, the residents and businesses in unincorporated Pinellas
County inust either contract with a private collection service or deliver their
solid waste to a Pinellas County Solid Waste Management collection facility.
Upon annexation, the City of Clearwater will be able to provide solid waste
services to the area. Clearwater will assuine solid waste collection
responsibilities as soon as practicable depending upon individual contracts and
the requirements of Section 171.062(4), F.S.�
E. Transportation: No rights-of-way are included with this annexation. There is a
mix of unincorporated and incorporated areas of right-of-way in this area. The
City and Pinellas County should consider ensuring that there is consistency
relative to right-of-way maintenance.
F. Law Enforcement: The Pinellas County Sheriff's Department serves the area
proposed for annexation. The Clearwater Police Department will serve the area
upon annexation. Clearwater indicates it has adequate law enforcement
capability to serve this area. Based on the adjacency to properties currently in the
City of Clearwater, Clearwater anticipates only minimal impact to the city's
police department operations.
G. Fire: The proposed area is in the Clearwater Fire District. By Interlocal

provided by the City of Clearwater and there will be no change in fire services
upon annexation. Furthennore, the fire district millage rate that is levied for this
proposed annexation area will no longer apply and fire service to the annexed

H. Emer�ency Medical Service (EMS): EMS is provided to this area through the
countywide EMS program (as administered and serviced through the fire
districts). The countywide EMS millage will continue to be levied in order to
support this service, regardless of jurisdiction.
I. Recreational Facilities: There is one single-family residence living in the
proposed annexation area; therefore, there will be a minimal demand for public

not anticipate additional impact to the city�'s parks system.
J. Libraries: The Clearwater library systein is part of the Pinellas Public Library
Cooperative and is open and available to all persons within the county regardless
of the location of their residence. Thus, annexation into the City of Clearwater
will have no affect on the availability of library services to the proposed
annexation area. Also, the library millage that is levied for this unincorporated
area will no longer apply and library service will be provided from the city ad
valorem tax revenue and fees.
In summary, based on the accompanyi�zg Findings II. A to D, it is reconzmended that
the Council adopt a finding that the City of Clearwater has the ability to provicle
municipal services to the described area and authorize this finding to be transmitted to
the City.
Planners Advisory Committee (PAC):
On July l, 2013, the PAC recommended adopting a finding that the City of Clearwater
has the ability to provide municipal services to this area (vote 8-0). The draft minutes
of the discussion on this case are provided as Attachment 1.

The City of Clearwater recently advised you of the receipt of an application for voluntary
annexation for property located at 3030 Union Street (ANX2013-4008). This property is
comprised of two parcels located within the City of Clearwater Planning Area which upon
annexation into the City of Clearwater will be served by city sanitary sewer and solid waste
service. This annexation will now be processed through two unique cases (new case ANX2013-
05011), and the overall amount of land proposed for annexation is reduced.
The proposed annexation is consistent with Florida law regarding municipal annexations
pertaining to contiguousness with existing city boundaries and compact concentration. A copy of
the revised legal descriptions for the two parcels of land proposed to be annexed is enclosed.
