07-12 RESOLUTION NO. 07-12 A RESOLUTION REGARDING OUTDOOR ADVERTISING; URGING THE PINELLAS DELEGATION TO OPPOSE LEGISLATION THAT PERMITS THE RECONSTRUCTION OF NONCONFORMING BILLBOARDS THAT ARE DESTROYED BY NATURAL DISASTERS; PROVIDING AN EFFECTIVE DATE. WHEREAS, following the 2004 hurricane season, the State of Florida and the Florida Department of Transportation allowed the reconstruction of approximately 131 nonconforming billboards that were considered destroyed; and WHEREAS, Clearwater has an over twenty year history of controlling the visual impact of oversize signs and has defended these rights vigorously in courts of law; and WHEREAS, House Bill 1583 and Senate Bill 2750 contain language which would allow the reconstruction of billboards that are virtually destroyed by natural causes; and WHEREAS, the current Florida Administrative Code section 14-10.007 provides a more restrictive standard for determining whether a nonconforming billboard is destroyed than the definition proposed by these bills; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CLEARWATER, FLORIDA: Section 1: The City of Clearwater does hereby express its opposition to House Bill 1583 and Senate Bill 2750, or similar legislation. Section 2: The City of Clearwater urges the Pinellas Legislative Delegation to work against House Bill 1583 and Senate Bill 2750, or similar legislation. Section 3: The City Clerk is directed to send copies of this Resolution to members of the Pinellas Legislative Delegation, the Governor, the Florida League of Cities and the Suncoast League of Cities.
