The Chair called the meeting to order at 1:12 p.m. at City Hall.
To provide continuity for research, items are in agenda order although not necessarily
discussed in that order.
ITEM #2 - Approval of Minutes:
Trustee Hooper moved to approve the minutes of the August 16, 1999, meeting, as
motion
recorded and submitted in written summation by the City Clerk to each Trustee. The
carried
was duly seconded and unanimously.
ITEM #3 - Request for Acceptance into Membership:
The City Manager presented the recommendation of the Pension Advisory Committee
to approve membership for the employee(s) listed below:

Trustee Clark moved to accept the recommendation of the Pension Advisory

ITEM #4 - Request for Pension:
The City Manager presented the PAC (Pension Advisory Committee) recommendation
Sara Ruby regular pension
that be granted a under Section(s) 2.393 and 2.397 of the
Employees' Pension Plan. Sara Ruby was employed on September 13, 1976, and her
pension service credit is effective on that date. Her pension will be effective October 1, 1999.
On August 12, 1999, the PAC approved this pension. Section 2.393 (p) provides for
normal retirement eligibility when a participant has reached age 55 and completed 20 years of
credited service or has completed 30 years of credited service. Ms. Ruby qualifies under the
age 55 and 20 years of service criteria. Based on an average yearly salary of approximately
$56,751 over the past 5 years, the formula for computing regular pensions, and Ms. Ruby's
selection of the Joint & Survivor Annuity, this pension will approximate $35,960 annually.
Trustee Johnson moved to accept the recommendation of the Pension Advisory

ITEM #5 - Request to Vest Pension:
Eugene M. Tobias, Jr.
The City Manager presented the PAC recommendation that
and James M. Lewin, Sr. vest their pensions
be allowed to under Section(s) 2.397 and
2.398 of the Employees' Pension Plan.
Eugene M. Tobias, Jr. was employed on March 29, 1989, and his pension service credit
is effective on that date. James M. Lewin, Sr. was employed on August 20, 1974, and his
pension service credit is effective on February 10, 1975.
The Employees’ Pension Plan provides that should an employee cease to be an
employee of the City of Clearwater after completing 10 or more years of creditable service
(pension participation), then such employee shall acquire a vested interest in the retirement
benefits. Vested pension payments commence on the first of the month following the month in
which the employee normally would have been eligible for retirement.
Section 2.393 (p) provides for normal retirement eligibility when a participant has
completed 20 years of credited service in a type of employment described as “hazardous duty”

and further specifically defines service of a Police Officer as meeting the hazardous duty
criteria. Mr. Tobias would have completed 20 years of hazardous duty service on March 29,
2009. His pension will be effective on April 1, 2009.
Section 2.393 (p) also provides for normal retirement eligibility when a participant has
reached age 55 and completed 20 years of credited service or has completed 30 years of
credited service. Mr. Lewin would have completed 30 years of service on February 10, 2005.
His pension will be effective March 1, 2005.
On August 12, 1999, the PAC approved these requests.
Trustee Hart moved to accept the recommendation of the Pension Advisory Committee.

ITEM #6 - Other Business:
In response to a question regarding legislative changes to Police and Fire pension
requirements affecting the Pension Plan, Pension Trustee Attorney Lee Dehner said, if
needed, ordinances must be enacted by December 31, 1999. The plan’s actuary is preparing
information regarding what improved benefits would be needed if ours do not meet the
minimum required. Mr. Dehner will have this information by October 1, 1999.
