11/04/1996 TRUSTEES OF THE EMPLOYEES' PENSION FUND MEETING November 4, 1996 The City Commission, meeting as the Board of Trustees of the Employees' Pension Fund, met in regular session at City Hall, Monday, November 4, 1996 at 1:04 P.M., with the following members present: Rita Garvey Chairperson J. B. Johnson Trustee Robert Clark Trustee Ed Hooper Trustee Karen Seel Trustee Also Present were: Elizabeth M. Deptula City Manager Pamela K. Akin City Attorney Cynthia E. Goudeau City Clerk ITEM #2 - Minutes: Trustee Hooper moved to approve the minutes of the October 14, 1996, meeting. The motion was duly seconded and carried unanimously. ITEM #3 - Request for Acceptance into Membership: The City Manager presented the recommendation of the Pension Advisory Committee to approve membership for the employee(s) listed below: a) Robin I. Gomez b) Elizabeth M. Wood c) Jeanette Terry d) Von L. Watson e) Gregory Anderson f) Darrell Ford g) Alan L. Ruud h) Jessie Croskey i) Courtney Atkinson j) Jose Leon-Tapia k) Michelle Solaski Trustee Johnson moved to accept the recommendation of the Pension Advisory Committee. The motion was duly seconded and carried unanimously. ITEM #4 - Other Business: a) informational: Non-Job-Connected Disability Pension approved for Thomas J. Murray by PAC The PAC at its meeting of October 10, 1996, approved a non-job-connected disability pension for Thomas J. Murray. Mr. Murray was employed on October 19, 1970, and began participating in the Pension Plan on April 19, 1971. His resignation was October 10, 1996. Pursuant to Section 2.394 (e)(1)(G) and 2.397(c)(2) of Ordinance #5890-95, the PAC is authorized to investigate and determine the eligibility of participants for disability pension and to grant final approval. Mr. Murray’s pension was based on his disability which is described as myocarditis. Under the procedures established by the PAC for disability pensions, Mr. Murray submitted letters from two doctors, was sent for an independent medical evaluation (IME), and had a functional capacity evaluation. Dr. Robert Sanchez, the IME doctor, states “I feel that the patient is totally and permanently disabled.” The functional capacity evaluation reveals Mr. Murray “is able to work at the sedentary-light category of work according to the U.S. Department of Labor ... Since, at this time, the patient feels like he is under a good deal of stress, it will not be a good idea to place him in a situation where he would have to deal with complaints from the public. He needs for his cardiologist to determine whether his cardiac status is stable. He was told by his physician not to lift more than 40 pounds. That restriction will remain in effect until his physician decides otherwise.” The PAC determined his current condition precludes him from performing his current job or any alternate work assignment for the City. Based on an average salary of approximately $26,072 per year over the past five years, the formula for computing non-job-connected disability pensions, and Mr. Murray’s selection of the 100% Joint and Survivor Annuity, this pension will approximate $17,776 annually.
