Section 1. The following- described property is hereby annexed into the City of
Clearwater and the boundary lines of the City are redefined accordingly:

The map attached as Exhibit B is hereby incorporated by reference.
Section 2. The provisions of this ordinance are found and determined to be
consistent with the City of Clearwater Comprehensive Plan. The City Council hereby
accepts the dedication of all easements, parks, rights -of -way and other dedications to the
public, which have heretofore been made by plat, deed or user within the annexed
property. The City Engineer, the City Clerk and the Planning and Development Director
are directed to include and show the property described herein upon the official maps and
records of the City.
Section 3. This ordinance shall take effect immediately upon adoption. The City
Clerk shall file certified copies of this ordinance, including the map attached hereto, with
the Clerk of the Circuit Court and with the County Administrator of Pinellas County,
Florida, within 7 days after adoption, and shall file a certified copy with the Florida
Department of State within 30 days after adoption.

Bounds Tract 44/01 in Section 03, Township 29 S, Range 15 E) together with all of the abutting Right of Way
of Kings Highway; and Pass Ordinances #8519 -14, #8520 -14 and #8521 -14 on first reading.

Zx and that the appropriate officials be authorized to execute same.
SUMMARY:
This voluntary annexation petition involves a 0.343 -acre property consisting of one parcel of land occupied by a
single - family dwelling. It is on the southeast corner of Kings Highway and Sandy Lane. The applicant is requesting
this annexation in order to receive sanitary sewer and solid waste service from the City. The Planning & Development
Department is also requesting that the abutting Right of Way of Kings Highway also be annexed. The property is
contiguous to existing City boundaries on all sides. It is proposed that the property be assigned a Future Land Use
Plan designation of Residential Low (RL) and a zoning category of Low Medium Density Residential (LMDR).
The Planning and Development Department determined that the proposed annexation is consistent with the provisions
of Clearwater Community Development Code Section 4 -604.E as follows:
The property currently receives water service from the City. The closest sewer line is located in the Kings
Highway right -of -way. The applicant has paid the City's sewer impact and assessment fees and is aware of the
additional costs to extend City sewer service to this property. Collection of solid waste will be provided by the
City of Clearwater. The property is located within Police District II and service will be administered through
the district headquarters located at 645 Pierce Street. Fire and emergency medical services will be provided to
this property by Station #51 located at 1720 Overbrook Avenue. The City has adequate capacity to serve this
property with sanitary sewer, solid waste, police, fire and EMS service. The proposed annexation will not have
an adverse effect on public facilities and their levels of service; and
• The proposed annexation is consistent with and promotes the following objective of the Clearwater
Comprehensive Plan:
Objective A.6.4 Due to the built -out character of the City of Clearwater, compact urban development
within the urban service area shall be promoted through application of the Clearwater Community
Development Code.
Objective A.7.2 Diversify and expand the City's tax base through the annexation of a variety of land
uses located within the Clearwater Planning Area.
Policy A.7.2.3 Continue to process voluntary annexations for single - family residential properties upon
request.
• The proposed residential Low (RL) Future Land Use Map •--ategory is consistent with the current Countywide
Plan designation of this property. This designation primarily permits residential uses at a density of 5 units
per acre. The proposed zoning district to be assigned to the property is the Low Medium Density Residential
(LMDR) District. The use of the subject property is consistent with the uses allowed in the district and the
property exceeds the district's minimum dimensional requirements. The proposed annexation is therefore
consistent with the Countywide Plan and the City's Comprehensive Plan and Community Development Code;
and
• The property proposed for annexation is contiguous to existing City boundaries in all directions; therefore, the
annexation is consistent with Florida Statutes Chapter 171.044.

The City of Clearwater Planning & Development Department has reviewed the above referenced Petition for
Annexation. The petition has been entered into the Department's filing system and assigned the case number
ANX2013- 10032. After a preliminary review of the submitted documents, staff determined that the application is
incomplete.
The following items and/or information are required in order to make your application complete:
1. Signed and sealed boundary survey that includes the total parcel area. (1 original and 14 copies)
Section 4- 202(C) of the Community Development Code states that if an application is deemed incomplete, the
deficiencies of the application shall be specified by Staff. No further development review action shall be taken
until the deficiencies are corrected and the application is deemed complete. Please submit the above information
by Wednesday, October 9, 2013 in order to keep this application on schedule for the November 7, 2013
Development Review Committee meeting.

Please be advised that the City of Clearwater is in receipt of applications for voluntary annexations for properties
located at 2071 The Mall (ANX2013- 10031) and 1734 Kings Highway (ANX2013- 10032). The subject parcels
are located within the City of Clearwater Planning Area and upon annexation into the City of Clearwater will be
served by city sanitary sewer (when made available) and solid waste service.
The proposed annexations are consistent with Florida law regarding municipal annexations pertaining to
contiguousness with existing city boundaries and compact concentration. A copy of the petitions for annexation
and related documents are enclosed.
