The City Engineer, the City Clerk and the Planning and Development Director are directed to include and show the property described herein upon the official maps and records of the City. Section 3. This ordinance shall take effect immediately upon adoption. The City Clerk shall file certified copies of this ordinance, including the map attached hereto, with the Clerk of the Circuit Court and with the County Administrator of Pinellas County, Florida, within 7 days after adoption, and shall file a certified copy with the Florida Department of State within 30 days after adoption. A to D, Adopt a Finding that the City of Clearwater has the Ability to Provide Municipal Services to this Area, and Authorize this Finding to be Transmitted to the City I. BACKGROUND Section 5(12) of Chapter 88 -464, Laws of Florida, as amended, requires the Council to review and make a recommendation to the affected municipality for each annexation of ten acres or more as to the ability of the municipality to provide municipal services to the territory proposed to be annexed. Although this report is primarily for the purpose of determining if the City has the ability to provide the proposed annexation area with urban services, it is also used to identify any other issues with respect to the annexation. The City has indicated in its submission material that it has the ability to provide municipal services to the area proposed for annexation. The proposed annexation area is located at the western terminus of Sunstream Ln., just to the west of Parkstream Ave. (see Map 2). Referred to by the City as the 2854 Sunstream Ln. Annexation, the area consists of one parcel. The property is designated Residential Low, Preservation, and Water on the Countywide Plan Map. The property is currently vacant and proposed to be developed with single - family homes. The area to be annexed includes 14.7 acres. It should be noted that PPC staff has completed a cursory review of this voluntary annexation for the purposes of tracking annexations in Pinellas County. PINELLAS PLANNING COUNCIL ACTION. The Council adopted a finding that the City of Clearwater has the Ability to Provide Municipal Services to this area based on the Ability to Serve Report and authorized this finding to be transmitted to the City (vote 8 -0). FINDINGS In accordance with the ability to serve review criteria of PPC Resolution No. 98 -2, and based upon the accompanying data and analysis, staff submits the following findings for consideration: A. The subject area is located within an established planning area pursuant to Chapter 163, F.S. The City of Clearwater and Pinellas County have an interlocal planning area agreement through September 30, 2020. B. The proposed annexation does not create any enclaves and will reduce an existing enclave. C. The City of Clearwater has the ability to provide sanitary sewer service, solid waste pick up and disposal, law enforcement, fire and Emergency Medical Services (EMS), and recreation and library services through city departments, county services, or private contractors. D. The existing service district boundaries for the items noted above will not change. It should be noted that the law enforcement service provider will change from the Pinellas County Sheriff to the Clearwater Police Department. I11. REVIEW COMMENTS A. Consistency with Chapter 171, F.S.: The area is contiguous to municipal boundaries on its northern, eastern, southern, and western borders (i.e., a substantial part of a boundary of the territory sought to be annexed is contiguous (Section 171.031(11), F.S.)), the area is reasonably compact (Section 171.031(12), F.S.), and no enclaves will be created (Section 171.031(13), F.S.). While this is not part of the review criteria of PPC Resolution No. 98 -2, staff finds the proposed annexation complies with the above provisions. B. Water: The area proposed for annexation is within the area served by the City of Clearwater potable water system. The subject properties are currently not connected to the City's potable water system. With regard to the level of service and coverage of the potable water system, water main extensions would be required to connect these properties. Based on the existing use of the properties, Clearwater indicates it has the capacity available in the city's water system should this area be connected in the future. C. Sanitary Sewer: The proposed annexation is within the City of Clearwater sanitary sewer service area. The subject properties are currently not connected to the City's sewer system. Solid Waste: Currently, the residents and businesses in unincorporated Pinellas County must either contract with a private collection service or deliver their solid waste to a Pinellas County Solid Waste Management collection facility. Upon annexation, the City of Clearwater will be able to provide solid waste services to the area. Clearwater will assume solid waste collection responsibilities as soon as practicable depending upon individual contracts and the requirements of Section 171.062(4), F.S.' E. Transportation: No rights -of -way are included with this annexation. The rights -of -way adjacent to the property are all local roads maintained by the City of Clearwater. F. Law Enforcement: The Pinellas County Sheriff's Department serves the area proposed for annexation. The Clearwater Police Department will serve the area upon annexation. Clearwater indicates it has adequate law enforcement capability to serve this area. Based on the adjacency to properties currently in the City of Clearwater, Clearwater anticipates only minimal impact to the city's police department operations. G. Fire: The proposed area is in the Clearwater Fire District. By Interlocal Agreement with Pinellas County, fire protection services to the district are provided by the City of Clearwater and there will be no change in fire services upon annexation. Furthermore, the fire district treillage rate that is levied for this proposed annexation area will no longer apply and fire service to the annexed area will be budgeted and provided out of the city's ad valorem tax revenue. Clearwater anticipates no increased impact to the city's fire department operations. H. Emergencv Medical Service (EMS): EMS is provided to this area through the countywide EMS program (as administered and serviced through the fire districts). The countywide EMS millage will continue to be levied in order to support this service, regardless of jurisdiction. I. Recreational Facilities: There are no residences living in the proposed annexation area, however the site is proposed to be developed with single - family ' If a property has had an exclusive contract for solid waste collection for at least six months before the annexation occurs, the solid waste provider may continue to provide services to the area for five years, or the remainder of the contract term, whichever is less (Section 171.062 (4), F.S.) 3 j9-- 1 SUBJECT. Ability to Serve Report No. 13 -3: Clearwater homes; therefore, there will be a demand for public recreational facilities. However, the City's parks and recreation department indicates it has adequate capacity in the city's parks system to serve the future residents. J. Libraries: The Clearwater library system is part of the Pinellas Public Library Cooperative and is open and available to all persons within the county regardless of the location of their residence. Thus, annexation into the City of Clearwater will have no affect on the availability of library services to the proposed annexation area. Also, the library millage that is levied for this unincorporated area will no longer apply and library service will be provided from the city ad valorem tax revenue and fees. In summary, based on the accompanying Findings II. A to D, it is recommended that the Council adopt a finding that the City of Clearwater has the ability, to provide municipal services to the described area and authorize this finding to be transmitted to the City. Planners Advisory Committee (PAC): On September 30, 2013, the PAC recommended adopting a finding that the City of Clearwater has the ability to provide municipal services to this area (vote 9 -0).
