SUMMARY: This voluntary annexation petition involves a 1.07 -acre property consisting of one parcel of land that is currently vacant. It is located on the west side of North Hercules Avenue, lying north of the Seaboard Coastline Railroad. The applicant is requesting this annexation in order to join this parcel with other parcels owned by the applicant located to the west of the subject property. The property is located within an enclave and is contiguous to existing City boundaries to the north and west. It is proposed that the property be assigned Future Land Use Plan designations of Industrial General (IG) and Industrial Limited (IL) and a zoning category of Industrial, Research and Technology (IRT). The Planning and Development Department determined that the proposed annexation is consistent with the provisions of Community Development Code Section 4 -604.E as follows: • The property is currently vacant but would receive water service from the City of Clearwater. The closest sanitary sewer line is located north of the property in the adjacent North Hercules Avenue right -of -way, but is not readily available to the property. The applicant is aware of the additional costs to extend City sewer service to this property. Collection of solid waste will be provided by the City of Clearwater. The property is located within Police District II and service will be administered through the district headquarters located at 645 Pierce Street. Fire and emergency medical services will be provided to this property by Station #48 located at 1700 N. Belcher Road. The City has adequate capacity to serve this property with sanitary sewer, water, solid waste, police, fire and EMS service. The proposed annexation will not have an adverse effect on public facilities and their levels of service; and The proposed annexation is consistent with and promotes the following objective of the Clearwater Comprehensive Plan: Objective A.6.4: Due to the built -out character of the City of Clearwater, compact urban development within the urban service area shall be promoted through application of the Clearwater Community Development Code. On the contrary, the voluntary annexation would enable the parcel to become a part of a new manufacturing facility in the City ensuring its full association, socially and economically with the City. Moreover, the parcel is reasonably compact as it is concentrated in a single 1.26 acre area. Lastly, the voluntary annexation of the parcel will not result in the creation of an enclave. Conversely, the voluntary annexation will result in the reduction in size of an existing enclave. Thus, the voluntary annexation of the parcel by the City will actually result in the fulfillment of the Legislature's intent in enacting the Municipal Annexation or Contraction Act by reducing the size of an existing enclave and making our client's parcel part of a geographically unified and compact Clearwater. Again, my understanding is that no party with standing to challenge the voluntary annexation of our client's parcel objects to its annexation by the City. Further, annexing the parcel will permit our client to develop a new manufacturing facility in the City of Clearwater in line with the City's economic development plan resulting in new jobs in the City. I have enclosed a draft survey of the facility which will be developed on the twelve parcels owned by our client for your review. I would appreciate the opportunity to meet with you at your earliest convenience to discuss our client's petition and to further discuss why the voluntary annexation is permissible under Section 171.044, Florida Statues.
