(consisting of North 45 feet of South 510 feet of East 120 feet of West 980 of Southwest 1/4 of Northeast `/4 less
30 feet road on East in section 17, Township 29 South, Range 16 East); and PASS Ordinances #8261 -11,
#8262 -1 land #8263 -11 on first reading.

SUMMARY:
This voluntary annexation petition involves a 0.125 -acre property consisting of one parcel of land occupied by an
attached dwelling (duplex). It is located on the east side of Elizabeth Avenue approximately 405 feet north of Gulf -to-
Bay Boulevard. The applicant is requesting this annexation in order to receive sanitary sewer and solid waste service
from the City. The Planning and Development Department is requesting that the 0.032 -acres of abutting Elizabeth
Avenue right -of -way not currently within the City limits also be annexed. The property is contiguous to existing City
boundaries to the north, south, east and west. It is proposed that the property be assigned a Future Land Use Plan
designation of Residential Urban (RU) and a zoning category of Medium Density Residential (MDR).
The Planning and Development Department determined that the proposed annexation is consistent with the provisions
of Community Development Code Section 4 -604.E as follows:
• The property currently receives water service from the City. The closest sanitary sewer line is located in the
adjacent Elizabeth Avenue right -of -way. The applicant has paid the City's sewer impact and assessment fees
and is aware of the additional costs to extend City sewer service to this property. Collection of solid waste will
be provided by the City of Clearwater. The property is located within Police District III and service will be
administered through the district headquarters located at 2851 N. McMullen Booth Road. Fire and emergency
medical services will be provided to this property by Station #49 located at 565 Sky Harbor Drive. The City
has adequate capacity to serve this property with sanitary sewer, solid waste, police, fire and EMS service.
The proposed annexation will not have an adverse effect on public facilities and their levels of service; and
• The proposed annexation is consistent with and promotes the following objectives of the Clearwater
Comprehensive Plan:
Objective A.6.4: Due to the built -out character of the City of Clearwater, compact urban development
within the urban service area shall be promoted through application of the Clearwater Community
Development Code.
Objective A.7.2 Diversify and expand the City's tax base through the annexation of a variety of land
uses located within the Clearwater Planning Area.

• The proposed RU Future Land Use Plan category is consistent with the current Countywide Plan designation
of this property. This designation primarily permits residential uses at a density of 7.5 units per acre. The
proposed zoning district to be assigned to the property is the Medium Density Residential (MDR) District.
The use of the subject property is consistent with the uses allowed in the District; however, it is
nonconforming with regard to density and minimum lot dimension requirements. The proposed annexation is
therefore consistent with the Countywide Plan, City's Comprehensive Plan and Community Development
Code; and
• The property proposed for annexation is contiguous to existing City boundaries to the north, south, east and
west; therefore the annexation is consistent with Florida Statutes Chapter 171.044.

An elderly woman owns this duplex. Based on the survey she submitted there is about 15 feet from the property line to
the impervious area that could be called a driveway (not sure if it's concrete, asphalt or what). Then the impervious area
stretches 28 feet to the front steps of the south side of the duplex.
In the photograph there are vehicles parked on the north side of the duplex. My guess is the north unit parks in front of
its portion of the building and likewise with the south unit (no vehicles appear in that section possibly because of time of
day; I visited about 9arn, so those folks may have been at work).
I already sent a letter to the owner notifying her she would have to get a BTR when she was annexed in and I believe
Terry and Dee are aware of this. Not sure if any site visits from Terry's staff have been made to the property. I believe I
copied him on the PPC Letter but can't be sure as I purged most of my email sent folder last week.

All organizations that will be receiving an allocation will have agreements
prepared and executed by October 1, 2011. Staff monitors these organizations for
compliance on a yearly basis.
Economic Development and Housing Director Geri Campos Lopez provided a
PowerPoint presentation.
In response to a question, Ms. Campo Lopez said the Neighborhood Revitalization
Strategy Areas are defined by HUD and include the North Greenwood, East Gateway,
and Lake Belleview areas.
Concern was expressed regarding current housing stock deteriorating. It was
suggested efforts concentrate on rehabilitating current housing stock rather than adding
new housing.
One individual spoke in opposition and one individual spoke in support.
Vice Mayor George N. Cretekos moved to approve the City of Clearwater's Fiscal Year
2011 -16 Five -Year Consolidated Plan and Fiscal Year 2011 -12 Action Plan, to carry
forward the goals and objectives set forth in the Plan, as required by HUD, authorize the
City to enter into agreements with organizations contained in the Fiscal Year 2011 -12
Consolidated Action Plan, and authorize the appropriate officials to execute same. The
motion was duly seconded and upon roll call, the vote was:
"Ayes ": Mayor Frank Hibbard, Vice Mayor George N. Cretekos, Councilmember
