WRITTEN SUBMITTAL REQUIREMENTS: (Code Section 3- 1807.C) Signage proposed as part of a Comprehensive Sign Program may deviate from the minimum sign standards in terms of numbers of signs per business and /or parcel of land, maximum area of sign face per parcel of land and the total area of sign faces per business or parcel of land, subject to compliance with the flexibility criteria outlined below. As part of the program, all sign types shall be reviewed for the business and /or the development parcel to achieve compliance in so far as possible with these current regulations. A master sign program for shopping centers, including all out parcels, and office complexes shall include all types of signs for all tenants /uses within the development parcel. These will be reviewed as a Comprehensive Sign Program application. All existing and proposed signs must be architecturally integrated into the design of the building and /or site using similar and coordinated design and style features, materials and colors, etc. Attached signs shall be horizontally and vertically proportionately located on each facade with no protrusions above roof lines, over windows, trim, cornices or other-building features. ❑ Provide complete responses to the COMPREHENSIVE SIGN PROGRAM CRITERIA including how the criteria are met: 1. Architectural Theme. How is the design, character, location and /or materials of all signs proposed in the comprehensive sign program demonstrably more attractive than signs otherwise permitted on the parcel proposed for development under the minimum signs standards? Additionally, demonstrate how the proposed signage improves the community character. With regard to the width of signs, the Code does not specifically mention how wide a sign can be but does discuss that per Section 3- 1 807.C.5, that the signage proposed in a comprehensive sign program shall not have an adverse impact on the community character of the City of Clearwater. As a 13'9" sign is proposed, if approved it would set a precedent on future signage. And historically we have approved signage having a width between 6 to 10 feet. Along US 19 we have approved the signs at l Oft but rarely do so outside of sites with frontage along US 19. Let me know if I can be of further assistance. With regard to the width, we historically have approved signage at 8 to 10 feet wide. As proposed and at 13'9 ", this is not a width we would support. Last, through the Comprehensive Sign Program we do not support pole structures. ANALYSIS: Existing Conditions The site is 1.207 acres, located on the east side of US 19 North, south of the intersection of Nursery Road. It has approximately 180 feet of frontage on US 9 North. The site also fronts on a private road, which leads to Bay Aristocrat Village. The site has been developed with a 3,960 square foot restaurant (Steak `N Shake). The design of the building is typical of other Steak N Shake restaurants in the Tampa Bay region (white building, flat roof, red awnings and black and white awnings). The site has two curbs cuts, one on US 19 North and the other on the private access roadway leading to Bay Aristocrat Village. The site includes four existing attached signs: a 12 square foot awning sign located on the north facade, an 81 square foot wall sign located on the north facade, a 29 square foot wall sign located on the south facade, a 29 square foot wall sign located on the west (front entrance) facade. All signs are visible from the property lines. The vegetation on the site has grown to some extent. Trimming or pruning of trees on the north side of the site will help toward improving visibility of the signage there. With landscape maintenance occurring on the north side of the site, there will be sufficient visibility. West and south elevation signs are clearly visible from a distance of 300 feet. The billboard is non - conforming with respect to area and height. The billboard is visible from well beyond the property lines. Viacom leases the billboard which is expected to terminate on August 31, 2004. According to city records, at one time the billboard was larger, measuring 600 square feet and 50 feet in height. Staff Report — Case SGN2003 -07025 - Page 2 c, Site History The Steak `N Shake site was formerly zoned Highway Commercial District under the former Land Development Code. Under those provisions, the maximum freestanding sign area permitted per lot was 112 square feet. The attached signs maximum sign area was 150 square feet. A variance application was submitted in 1997, requesting a 98.9 square foot freestanding sign and an area variance of 586.9 square feet to permit 698.9 square feet of freestanding sign area. The staff report prepared at that time noted the billboard was 600 square feet in area and measured 50 feet in height. (Staff recently measured the sign at 400 square feet, although not a precise measurement.) The Planning Department recommended denial of the variance application. The basis for denial included: the property contains a legally nonconforming freestanding sign that exceeds the sign area and height; the new building is readily identifiable as a Steak N Shake restaurant; and the attached signs on the three sides of the building are viewable from at least 300 feet distance as approached from the north, south or west. The applicant withdrew the variance application on April 15, 1998 (prior to determination by the City Commission). Proposal The applicant is proposing one freestanding sign (monument - style), 56 square foot, 12 feet in height. The proposed monument -style freestanding sign has a red background with white letters. The address has black numbers and is located on a red base. It is to be located approximately 25 feet north of the curb cut onto US Highway 19 North. The setback needs to be clarified and labeled on the site plan drawing, but appears to be close to five feet. The applicant provided a separate site plan drawing with photographs of signs affixed. The latter (photo illustrated) site plan shows the proposed freestanding sign located within the sight visibility triangle. The proposal also includes the removal of the billboard by August 31, 2004, upon lease expiration. All other existing signs are proposed to remain on site. Code Enforcement: There are no outstanding violations on record. C. COMPREHENSIVE SIGN PROGRAM (Section 3- 1807): 1. Architectural theme; The signs proposed in a comprehensive sign program shall be designed as a part of the architectural theme of the principal buildings proposed or developed on the parcel proposed for development and shall be constructed of materials and colors which reflect an integrated architectural vocabulary for the parcel proposed for development or the design, character, location and /or materials of all freestanding and attached signs proposed in a comprehensive sign program shall be demonstrably more attractive than signs otherwise permitted on the parcel proposed for development under the minimum signs standards. All signs must be architecturally integrated into /with the design of the building and /or site using similar and coordinated design features, materials and colors, etc.; The design of the proposed freestanding sign is a monument -style with a red base and sign background with white copy reading "Steak N Shake ". The colors are coordinated with the awnings on the building. The existing freestanding (billboard) sign is not Staff Report — Case SGN2003 -07025 - Page 3 architecturally - compatible or consistent with the proposed sign or the existing attached sings on the building. It measures approximately 40 feet by 10 feet (400 square feet) and extends 38 feet in height to the top. The drive -thru menu board is approximately 20 square feet and four feet in height. It is red with an asymmetrical base. Three of existing attached signs are red, similar to channel letters, installed on a raceway. The fourth attached sign includes white letters on a red awning. 2. The height of all freestanding signs proposed through the comprehensive sign program shall relate to the design of the sign and shall not exceed 14 feet in height, except in the D and T Districts, the height shall not exceed six feet in height; The height of the proposed freestanding sign is 12 feet in height. It measures eight feet in width and is consistent with the Code formula of 1' /2 times the width equals the sign height, up to 14 feet. The existing (billboard) freestanding sign as measured by staff is 38 feet in height. It exceeds the Code maximum by 24 feet. 3. Lighting. Any lighting proposed as a part of a comprehensive sign program is automatically controlled so that the lighting is turned off at 12 midnight or when the business is closed, whichever is later; The proposed sign cabinet is internally illuminated with fluorescent lamps and ballast. It is unclear from the application at what time the lighting for the proposed sign will be turned off. The billboard is lighted by external uplights. It is unknown how they are controlled or when they are turned off. The attached signs are internally illuminated. It is unknown when they are turned off. 4. Height, Area, Number and Location of Signs. The height, area, number and location of signs permitted through the Comprehensive Sign Program shall be determined by the Community Development Coordinator based on the following criteria: overall size of site, relationship between the building setback and sign location, frontage, access and visibility to the site, intended traffic circulation pattern, hierarchy of signage, scale and use of the project, consistency with Beach by Design, Clearwater Downtown Redevelopment Plan or any other applicable special area plan and submittal of a master sign plan for the development parcel /project. Additionally, the maximum permitted sign area shall be based on the following formula when evaluated against the above criteria: a) Attached signs — The maximum area permitted for attached signage shall range from one percent up to a maximum of six percent of the building fagade to which the sign is to be attached; The building has four attached signs totaling 151 square feet (109 square feet approved). The combined area of the two signs on the north elevation exceed the six percent maximum permitted area (93 square feet installed, 85 square feet permitted). Staff Report — Case SGN2003 -07025 - Page 4 b) Freestanding signs — The maximum permitted area of all freestanding signs on a site shall not exceed the range of sign area permitted by the street frontage or building facade calculation methods set forth in Section 1806.B.l.c.i.and ii; The maximum permitted area as calculated under the street frontage is 172.5 square feet; the maximum permitted area under the building fagade method is 14.25 square feet. In this case, the site would be permitted a maximum of 172.5 square feet. The combined area of all freestanding signs (400 square foot billboard, plus 56 square foot proposed sign) is 456 square feet. This exceeds the maximum permitted area by 283.5 square feet. 5. Community character. The signage proposed in a comprehensive sign program shall not have an adverse impact on the community character of the City of Clearwater; The existing billboard continues to have an adverse effect on the community as it detracts from the aesthetics of the city along a major north /south arterial. The attached signs on the three sides of the building are visible from the property lines. The vegetation on the site has grown to some extent. Trimming or pruning of trees on the north side of the site will help toward improving visibility of the signage there. With landscape maintenance occurring on the north side of the site, there will be sufficient visibility. West and south elevation signs are clearly visible from a distance of 300 feet. The site currently has abundant signage to identify this business. Although the design of the proposed freestanding sign is appropriate for the site and building, it will create unnecessary, excessive signage for the site. 6. Property values. The signage proposed in a comprehensive sign program will not have an adverse impact on the value of property in the immediate vicinity of the parcel proposed for development; The combination of existing attached and freestanding signs with the proposed sign will create an excess for a site of this size. Too many signs on site could result toward a negative impact on the surrounding property area. 7. Elimination of unattractive signage. The signage proposed in a comprehensive sign program will result in the elimination of existing unattractive signage or will result in an improvement to the appearance of the parcel proposed for development in comparison to signs otherwise permitted under the minimum sign standards; The removal or conformance to code of the billboard will be a positive contribution toward improving the community landscape. The lease of the billboard began on September 1, 1989 and continues for an initial term of 15 years (through August 31, 2004) and, thereafter, continues on a year -to -year basis until either party gives 60 days written notice of termination. The applicant cannot guarantee the removal of the billboard given the lease agreement terms. 8. Special area or scenic corridor plan. The signage proposed in a comprehensive sign Staff Report — Case SGN2003 -07025 - Page 5 program is consistent with any special area or scenic corridor plan which the City of Clearwater has prepared and adopted for the area in which the parcel proposed for development is located; The City has not adopted a special area or scenic corridor plan along US Highway 19 N.
