AMENDMENT TO LEASE AGREEMENT - PIRATES PANTRYAMENDMENT TO LEASE AGREEMENT
THIS AMENDMENT is made and entered into this 9) day of (0 c-4t
2014 by and between the CITY OF CLEARWATER, FLORIDA, a municipal corporation
(hereinafter referred to as the "LESSOR "), and, Thomas C. Wolkowsky and Patricia A.
Wolkowsky, d/b /a Pirates Pantry, Room 4, 25 Causeway Boulevard, Clearwater, Florida 33767
(hereinafter referred to as the "LESSEE ").
WHEREAS, the Lessor and Lessee entered into a three year Lease Agreement on
October 1, 2011, and
herein;
WHEREAS, both parties agree to this Amendment to the Lease Agreement as provided
NOW THEREFORE, it is mutually agreed as follows:
1. Paragraph 1 of the Lease Agreement shall be amended as follows:
In light of the option to extend being exercised, this lease shall be for a four (4)
year lease term ending on September 30, 2015. The Lessor retains the right to
terminate this lease for any municipal need consistent with the Lessor's charter; as
well as failure to pay rent in a timely manner or change in use of the property. In
addition, Lessor may terminate this lease if the State of Florida or any of its
agencies or political subdivisions thereof acquires the demised property or any
portion thereof for a public purpose. This right of termination is in addition to the
right of termination set out in paragraph 14 of this agreement.
2. All of the terms and conditions of the Lease Agreement are incorporated herein
by reference and shall continue in full force and effect throughout the remaining
term of this Lease Agreement.
