8580-14ORDINANCE NO. 8580-14 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, RELATING TO PARKS, BEACHES, AND RECREATION; AMENDING CHAPTER 22, PARKS, BEACHES, RECREATION, ARTICLE II, USE REGULATIONS, SECTION 22.35, FISHING, CLARIFYING AREAS WHERE FISHING ON PUBLIC BEACHES IS RESTRICTED; PROVIDING AN EFFECTIVE DATE. WHEREAS, the Code of Ordinances empowers the city manager to regulate the time, place and manner in which City park property, including beaches, is to be used and enjoyed by the public; and WHEREAS, fishing from the beach creates an inherent safety conflict with the use of beaches for purposes of bathing and swimming; and WHEREAS, the City Council finds that prohibiting fishing in the areas on public beaches where the City holds those beaches out as being open to the public for bathing and swimming is in the best interest of the citizens and visitors to Clearwater, NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLEARWATER, FLORIDA; Section 1. That Chapter 22, Section 22.35 of the Code of Ordinances, City of Clearwater, Florida, is hereby amended to read as follows: Sec. 22.35. Fishing. Use Regulations* * * * * * * Ordinance No. 8580 -14 (6) No person shall at any time fish from public beaches in any area where bathing and swimming are permitted nor within any restricted area associated therewith or-in within theany area described in section 33.114. Section 2. This ordinance shall take effect immediately upon adoption.
