12/02/1991 TRUSTEES OF THE EMPLOYEES' PENSION FUND MEETING December 2, 1991 The City Commission, meeting as the Board of Trustees of the Employees Pension Fund, met in regular session at City Hall, Monday, December 2, 1991 at 11:50 A.M., with the following members present: Rita Garvey Chairperson Lee Regulski Trustee William Nunamaker Trustee Richard Fitzgerald Trustee Sue Berfield Trustee Also Present were: Michael J. Wright City Manager Milton A. Galbraith, Jr. City Attorney Cynthia E. Goudeau City Clerk ITEM #2 - Minutes: Trustee Berfield moved to approve the minutes of the November 18, 1991, meeting. The motion was duly seconded and carried unanimously. ITEM #3 - Remand Pension Request: The City Manager recommended the award of Daniel O'Connell's job-connected disability pension be remanded to the Pension Advisory Committee for further review as to the issue of job-connected versus non-job-connected disability. Mr. O'Connell's injury is described as hypertensive cardiovascular disease. A job-connected disability pension was approved by the Pension Advisory Committee on November 6, 1991, however, medical documentation from Dr. Carlos J. Bayron states, in part, that Officer O'Connell has a family history relating to hypertension and heart problems, that he has been a smoker until one year ago, and his condition is "... probably related to hypertension and poor physical conditioning and being a smoker in the past". Letters from Dr. Kaplan and Dr. Longacre do not relate that the condition of Officer O'Connell is the result of or was caused by his job as a Police Officer. Officer O'Connell did not file a worker's compensation claim relating to the disability. There is not substantial medical evidence to indicate that the condition of Officer O'Connell is related to his work as a Police Officer. H. M. Laursen, Human Resources Director, reiterated that none of the letters from the doctors indicates a job-connected disability. He stated Mr. O'Connell did file a Workers Compensation claim in 1986 after he experienced chest pains subsequent to a fight with an arrestee. There have been no claims since that time. Trustee Regulski moved to remand the job-connected disability to the Pension Advisory Committee. The motion was duly seconded and carried unanimously. ITEM #4 - Other Business: None.
