07/29/1991 TRUSTEES OF THE EMPLOYEES' PENSION FUND MEETING July 29, 1991 The City Commission, meeting as the Board of Trustees of the Employees Pension Fund, met in regular session at City Hall, Monday, July 29, 1991 at 9:04 A.M., with the following members present: Rita Garvey Chairperson Lee Regulski Trustee William Nunamaker Trustee Richard Fitzgerald Trustee Sue Berfield Trustee Also Present were: Michael J. Wright City Manager Milton A. Galbraith, Jr. City Attorney Cynthia E. Goudeau City Clerk ITEM #2 - Minutes: Trustee Berfield moved to approve the minutes of the July 15, 1991, meeting. The motion was duly seconded and carried unanimously. ITEM #3 - Request for Job-Connected Disability Pension: The City Manager presented the recommendation of the Pension Advisory Committee that the employee(s) listed below be granted a job-connected disability pension under Section 26.35 and/or 26.27 of the Employees' Pension Plan. a) Cleven Wyatt Mr. Wyatt's injuries occurred when his City vehicle struck another vehicle which pulled in front of him to make a turn. Mr. Wyatt's permanent injuries include compression of the C5-C6 disk space and severe bulging at the L4-L5 level. Mr. Wyatt exhausted all sick leave benefits; and the Pension Advisory Committee approved a job-connected disability pension at its meeting on July 10, 1991. A question was raised whether in a situation such as this, with the employee requesting disability pension due to the negligence of another, if there is any way to collect from the person at fault. Trustee Regulski moved to accept the recommendation of the Pension Advisory Committee. The motion was duly seconded and carried unanimously. b) Raymond Piper Mr. Piper's injury is described as coronary artery disease. For the past six months he has suffered from recurrent angina. One physician states it's important to note that the angina is mainly precipitated when Mr. Piper is doing his job, specifically in high stress situations working as a police officer. In view of Mr. Piper's organic heart disease, previous myocardial infarction and recurrent angina, Dr. Lenz states Mr. Piper should be considered permanently disabled. Mike Laursen, Personnel Director, indicated there is an assumption that the stress resulting from being a Police Officer causes the disability to be job-connected. Trustee Regulski moved to accept the recommendation of the Pension Advisory Committee. The motion was duly seconded and carried unanimously. ITEM #4 - Request for Non-Job-Connected Disability Pension: The City Manager presented the recommendation of the Pension Advisory Committee that the employee listed below be granted a non-job-connected disability pension under Section 26.34 and/or 26.37 of the Employees' Pension Plan. Glenda Tarbox Ms. Tarbox suffers from amnesia with memory loss. Her memory impairment is considered a permanent disability. Dr. Vollbracht does not expect to see any improvement in her condition. Her ability to perform functions of her job are limited because of her memory difficulties. With this type of global amnesia there is no other work Ms. Tarbox could perform without difficulty. Trustee Berfield moved to accept the recommendation of the Pension Advisory Committee. The motion was duly seconded and carried unanimously. ITEM #5 - Request for Regular Pension: The City Manager presented the recommendation of the Pension Advisory Committee that the employee listed below be granted a regular pension under Section 26.34 and/or 26.37 of the Employees' Pension Plan. James V. Courson The Personnel Director stated Mr. Courson originally requested a job-connected disability pension however there was no evidence of on the job injury. The Pension Advisory Committee stated they would reconsider that request if any evidence can be found. In response to a question, it was indicated it was thought the alleged disability is a back problem. Trustee Regulski moved to accept the recommendation of the Pension Advisory Committee. The motion was duly seconded and carried unanimously. ITEM #6 - Appointment of Actuary for 1992 and 1993 valuations Coopers & Lybrand have been the actuaries for the Pension Plan since 1988. Staff has been very pleased with the service, responsiveness, and high quality work that Coopers has performed, and recommend approval of extending the agreement with them to provide actuarial services for the next two years. Dan Deignan, Finance Director, stated the first appointment of Coopers & Lybrand was four years ago and the service has been excellent. He reported they have requested no increase in fees for this extention. Trustee Regulski moved to extend the agreement with Coopers & Lybrand for a two year period for a fee not to exceed $13,000 each year. The motion was duly seconded and carried unanimously.
