08/11/2004 . . . BOARD OF ADJUSTMENT AND APPEAL ON BUILDING/FLOOD CONTROL MEETING CITY OF CLEARWATER August 11, 2004 Present: John H. Logan, Jr. Edward H. To provide continuity for research, items are in agenda order although not necessarily discussed in that order. A. Approval of Minutes - Julv 14. 2004 Member Richter moved to approve the minutes of the regular meeting of July 14, 2004, as submitted in written summation to each board member. The motion was duly seconded and carried unanimously. B. Continued Reauests - None. C. New Reauests 1. 308 N. Osceola Avenue, Clearwater, Florida; Owners: TrinQle Development. 411 Cleveland Street. Clearwater. Doug Wilson, Image Builders, said the project will convert three adjacent single-family residential properties into apartments. He said the owner realized the demolition work could not be completed within the original 7-day time period required, and is requesting a time extension. All permits have been pulled. Plaster, siding, etc. needs to be removed. Building Construction Inspector Bill Wright said the need to remove asbestos from all units has delayed the project. Eve Witter, Tringle Development, reported a fire had occurred at the property on the day the new owner closed on the property. Mr. Wright said the owner has secured the building and regularly inspects the site. Mr. Wilson requested 45 to 60 days to complete necessary work. One of the structures needs to be moved. The demolition time will be extended, as no roadway exists to assist with the move. Building-Flood Control 2004-08-11 1 . . . Member Shand moved to approve Case #BAA 04-04, granting Tringle Development a 60-day extension, to October 12, 2004, for required demolition of property at 308 N. Osceola Avenue. The motion was duly seconded and carried unanimously. 2. 619 S. Gulfview Boulevard, Clearwater, Florida: Owners: William M. Shephard Tre., c/o Easley Mccaleb & Assoc., P. O. Box 173058, Tampa, Florida 33672: Representative: Fowler Associates, Architects: Request: Variance to the Florida BuildinCl Code to construct Clame room in portion of buildinCl located in velocity zone. Case #BAA 04-05, Parcel #17-29-15-05004-003-0010: Located: Bayside sub NO.5 Blk CLots 1 thru 5 & rip rts. Fowler and Associates Architects President Steve Fowler said this property includes 500 square-feet of infill in the parking garage on the ground floor of Shephard's Resort. He said the new VE (velocity) zone runs through this property. Although construction is not within the VE zone, rules related to this most severe flood zone applies to any portion of property that falls within a flood zone. Building Official Kevin Garriott said while the subject area is outside the VE zone, the property owner wishes the building, to be constructed, to be considered a separate entity. The original permit, issued under the former flood zone designation, expired. The property owners did not renew it within 30-days. Mr. Garriott reported construction is permitted at grade in flood zone A if buildings are flood-proofed, which is what this owner plans to do. William Shephard, Easley Mccaleb & Associates, said windows for the project have been ordered, tests done to locate mechanicals for floodproofing have been completed, trees have been moved, etc. When work stopped during Spring Break, the velocity zone was changed, and the permit expired, which presented a hardship for the owner. In response to a question, Mr. Garriott said many stand-alone buildings in this area are built below base flood elevations. All at-grade structures in flood zone A are flood-proofed. He said in a velocity zone, collapsible walls are required. This construction is not a true stand- alone building; it will be constructed on a portion of the parking garage. Concern was expressed a precedent may be established if the request is approved. Mr. Garriott reiterated that the most severe flood zone restrictions apply to a property when any portion is in a flood zone. Mr. Shephard said one corner, or 2.5% of the proposed building, is in the new VE zone. It was recommended the original permit be renewed, so that the project only needs to comply with previous flood maps. Member Walker moved that regarding Case #BAA 04-05 for 619 S. Gulfview Boulevard, to approve extending the original building permit for 60 days from today's date, to October 12, 2004. The motion was duly seconded and carried unanimously. Building-Flood Control 2004-08-11 2 . . . Other Mr. Garriott said a consortium of all Pinellas County beach communities discussed the new flood maps prior to their incorporation. Pinellas County generated computer models, etc. and opposed the new flood zone designations. The CCCL (Coastal Construction Control Line) was moved farther back than the flood zones, which will require FDEP (Florida Department of Environmental Protection) and other appropriate agencies to review everything constructed seaward of the CCCL.
