The Chair called the meeting to order at 2:27 p.m. at the Municipal Services Building.
To provide continuity for research, items are in agenda order although not
necessarily discussed in that order.
A. Approval of Minutes - AUQust 13. 2003
Member Shah moved to approve the minutes of the regular meeting of August 13, 2003,
as submitted in written summation to each board member. The motion was duly seconded and
carried unanimously.

1. Case #BAA04-01 - 1160 Gulf Boulevard; Owners: Sand Kev Assoc. Ltd. Partners;
Representative: Edward H. Walker. Request a variance to the FEMA flood elevation of 11' or
12' for pool bar elevation from required V or AE zone. Located upland and accreted land desc
as from SW Sec cor run N89DE 843.4ft th N43DE386.07ft th N47D46'29"W; Parcel 17-29-15-
00000-330-0100.
Edward Walker, representative, said the Sheraton Sand Key is requesting a variance to
replace its old, dilapidated pool bar. Its replacement will be reconstructed on the south side of
the hotel in the flood elevation zone. It is difficult to pinpoint the exact location on the FEMA
(Federal Emergency Management Authority) map but the site's flood elevation is in either Zone
A or B.
The replacement pool bar is larger in diameter than the current one. Mr. Walker said it
would be impractical to put a pool bar six feet in the air, therefore it must be built at pool deck
level in the flood elevation zone. The bar will be built with steel columns, exposed beams, and a
metal roof. Construction costs will exceed the 50% rule for repairs to the existing tike hut style
cabana bar.
Building Official Kevin Garriott said several years ago, the City had constructed public
restrooms at Pier 60 Park at grade. He recommended flow-throughs be part of the proposed
pool bar's design to minimize the effects of potential water flow. Mr. Walker said a drain

connects to the hotel. Mr. Garriott recommended incorporating a hard connection or backflow
system with the sewer lines to prevent flooding. Mr. Walker said the electricity for the bar is on
a separate circuit from the hotel and the electricity for the proposed bar cannot be located above
the flood elevation zone. Although a disconnect switch is in the cabana on the north side of the
pool, Mr. Garriott recommended locating pool bar electricity in waterproof receptacles and
disconnect as a temporary structure to meet FEMA requirements. In response to a question,
Mr. Garriott said new commercial at-grade construction are flood-proof structures. Mr. Walker
said most of the existing building (which is not connected to the cabana in discussion) on the
property would meet the new flood elevation requirements. Mr. Garriott said all new
construction must comply with the new flood elevation requirements. If this new structure meets
FEMA requirements and objectives, FEMA most probably would not object to its construction
below flood elevations.
Member Shah moved to approve Case #BAA04-01 for 1160 Gulf Boulevard, a request
for a variance to the FEMA flood elevation, to construct a pool bar below the required flood
elevation, subject to the structure meeting the structural and electrical requirements. The
motion was duly seconded. Members Logan, Shah, and Richter voted "Aye"; Member Walker
abstained. Motion carried.
